If I have an LLC that is used for cash-based investments and trading of stocks and cryptocurrencies, can my SDIRA account invest in that LLC directly? If not, can an LLC be formed in such a way that it allows for both cash and ira dollars to be invested the same way?

1) No - you cannot invest your IRA in an LLC that you own (instead you need to invest in a new LLC that is solely owned by the IRA). 2) No - the LLC is solely owned by your IRA and you can’t pool with non-retirement funds.

Are you allowed to do swaps and exchange crypto from a hardware wallet like Ledger Nano X? It comes with a built in exchange.

@@mysolo401kfinancial3 i think you misunderstood my question,,,, Holding and Swapping Crypto on a Ledger Nano Hardware wallet does not use any account with an exchange, you just use it, no identification or EIN required,,, its non custodial service, you hold the private keys,,, You might fund the wallet using a credit or debit card linked to the LLC checking account for example, or you can fund an exchange account and withdraw the crypto to a hardware wallet for "offline storage" But once the crypto is on the hardware, you can do swaps between currencies on the hardware wallet ,,, is this allowed?

You certainly would need a separate wallet for retirement funds. It appears that the scenario that you describe is akin to a private transaction where the crypto is traded outside the context of an exchange. If so, you would want to be certain that the transaction is with a non-disqualified person and that the transaction is not tied directly/indirectly with a transaction involving cryptocurrencies that are owned outside of your retirement account.

I understand that LLC is owned by the Roth IRA. If the cryptocurrency exchange will allow the crypto to be transferred to a physical wallet, this is acceptable provided that it is a dedicated and segregated wallet (i.e. not used to store personal assets) which is not stored at the Roth IRA owner's physical residence but rather in a safety deposit box associated with a bank account in the name of the same LLC. The value of the crypto stored on the wallet can be calculated based on the fair market value and amount of such particular cryptocurrency.

One reason that some choose to use is a physical wallet is to mitigate the risk of leaving the cryptocurrencies on the exchange and the exchange later closes/goes under.

He's referring to a hardware crypto wallet like a ledger nano which allows you to withdraw your crypto from the exchange. So you'll be in control crypto on an "offline" storage device on your personal possession. As compared to storing on the exchange which can be hacked and stolen.

Two questions: (1) When a Self-directed IRA LLC gets a non-recourse loan, should the lender send the funds directly to the Self-directed IRA LLC bank account OR the IRA Custodian/Administrator? (2) Can one day trade in a Self-directed IRA LLC's crypto exchange account?

1) If the LLC is borrowing funds via a non-recourse loan, the LLC would be the borrower and the funds would be provided by the lender to the LLC 2) While the LLC may open a brokerage account to trade stocks, etc., some brokerages have high minimum balance requirements to open a brokerage account.

What is most important is that the account is opened in the name of the LLC and EIN of the LLC that is owned by your IRA regardless of whether the exchange categorizes the account as a business or personal account in the records of the exchange. That said, the account will typically be a business account in the records of the exchange.

Under the IRS rules the IRA account needs to be at a financial institution or trust company (specifically one that allows for investments that you want such as an LLC).

You can’t transfer funds from your 401k to the LLC that you use to operate your business in order to invest in cryptocurrency. Instead, if you were eligible to set up a solo 401(k) (e.g. because you don’t have any full-time employees working for you) you could set up a solo 401k that allows you to invest in cryptocurrency and then open an account at the cryptocurrency exchange in the name of the solo 401(k) in order to invest.
