Hello, will this be retrograded in? For example, what if a person filed bankruptcy in 2017? This is for federal student loans. Thank you for all the great information.

The DOJ process is only for bankruptcies that were pending in November 2022 or thereafter filed. If you filed a Chapter 7, it wouldn't apply b/c those cases last only three months or so, but if you were in a five year Chapter 13, and it wasn't yet discharged, you could take advantage of this. Otherwise, you'd have to file a new bankruptcy for any impact on federal student loans. If you have private loans, please do a strategy session with us as there are several things to talk about to have your private loans considered discharged in that bankruptcy after the fact.
