Not only going through the process gets some money back, it also sends the right message that people can't get away with this sort of behaviours and will likely think twice before doing it again. If not then they know they have a free pass to not pay rent ever - well done and well deserved !

I am impressed with the British courts & government administration processes that phone calls actually get picked up & queries answered & clarified! 👍🏻 a rarity today cos most phone lines to any companies or government agencies are now directed to a Website to look at standard replies to commonly asked questions or else to send an email & then need get clarifications by emails again which is a bigger hassle 😳

Due to owning a fair few properties and from having no issues for many years I was simply trusting the referencing agent that my letting agent worked with. After going through this ordeal my agent has changed referencing agents and both them and me now vet the tenants before they are moved in. I`m now far more cautious of who I let to and if I find any red flags at all I decline the applications.

Hi Steve, I have had my letting agent change referencing companies. All potential tenant details are now sent to me and I go through them with a fine tooth comb, I then have my agent call 2 previous landlords and the current employer. Before you started the process for "Attachment for earnings", did you go with MCOL first? If yes, was it straightforward process or is it best to hire a solicitor? I am in the same boat too... I evicted the tenants using services from an eviction specialist, but, wanted to carry on the further process of getting the rent arrears by myself. Any help is greatly appreciated.

I`m now only purchasing properties that are C or above, the properties I have that are below C will never be able to achieve a C like so many other older properties out there. I would hazard a guess that there will be some leeway in the legislation that states that properties that can't achieve a C or above will be exempt, but we will have to wait and see. I'm pretty confident that the government won't turn around and say all tenants must leave C and below properties and the properties must then stay empty due to a low EPC rating.

Hi Mr Beanie Avocado, Yes it would have, however, I`m still in the green at the moment. 15 years of investing, 16 BTL properties, rent guarantee insurance is aprox £200 per year, these tenants owe me aprox £7k. Its a rare occurrence and covid helped the tenants on this one, moving forward I do far more research and checks on the tenants. If I had just one or two properties I would get the insurance for sure

Most people would not bother and this is exactly why tenants do what they do. Good for you! UK is crap for allowing this to happen. If you dont pay your rent you should leave , no excuses, if they genuinly were struggling the gov would have helped them pay it .

Although possibly not the best course of action when I consider the time and hassle its going to take me I fully intend to follow this tennant wherever she works until they have paid me back in full. wow! the system is broken, makes my blood boil. this is why i always ask all my tenants to pay 4-6 months advance rent plus deposit. shortage of properties, plenty of international students with deep pockets and plenty of highly qualified skilled workers (dr's, nurses, engineers, IT professionals etc) coming from overseas. they will pay what ever you ask. as the alternative is very expensive - air b & b's and hotels. it high turn over but you avoid idiots who do this. right now a i have Nigerian young student couple with 1 yr old baby girl wanting to end tenancy early - after 5 months. i've already got them to pay all the rent upfront before they moved in sep as i had feeling they would try something like this.. sadly most tenants like them do. will see if they pay the 6th months rent... they're planning on staying in uk after studies like 90% of international students. i've already told them that i will do money order claim/attachment of earning if they try anything funny. either they comply with 12 month contract and pay all rent etc or i let them break contract once i find alternative tenants, however they will loose the deposit for ending tenancy early. if i can't find an alternative tenant to take over. i make sure my tenants are liable for the entire term of tenancy.

Hi Stephen, Thanks very much for watching and for your comment. In this scenario I knew that the tenants didn't have anything of value so an enforcement of debt would have been a waste of my time. If you have some non paying tenants and you know they have savings or assets then the enforcement of debt route could wok for you. I hope this helps

There is rent guarantee insurance that I could have taken out, however, I`ve worked out the cost across my portfolio for the time I have owned my properties and I would be more out of pocket if I would have insured against loss of rent. This situation is rare and was exacerbated by COVID. Moving forward the checks I have carried out on potential tenants is far more in-depth. Thanks again
