Thank you Ginny for everything you do. I wanted to comment so hopefully it will help other people. I submitted documents early in December and today I received a letter from EDD saying my documents meet the legal requirements and no further action is required. Thank goodness!!!!! I was unemployed because I was actively searching for work and I had received job offers through email and text messages from recruiters. However after the pandemic hit, we were shut down and were not even allowed to leave our home only for essential needs. The job offers disappeared due to this. I submitted all the emails and text messages showing I was looking for work, contacting recruiters and the job offers I received via text message and emails. I wrote a cover letter detailing all the documents I was submitting and explained we weren’t allowed to work due to our Governor shutting us down. I had no official offer letters just my text and emails. I hope this helps people. 🙏🏼🙏🏼😘😘😘💕💕

Hi Jenny I just wanted to let you know that I reached out to my legislator, for my particular city and they were more than generous in helping. They offered to submit all my paperwork through their portal and act as an advocate on my behalf because I do have proof that I had submitted the right forms prior. Ironically though I got a letter in the mail on Monday stating that after reviewing my records They saw I had submitted the right paperwork and I needed to do no further action. So I suppose everything is closed out now and I couldn’t be more grateful. I didn’t need this battle that’s for sure but thank you for your continued support and information always.

If you look at the EDD's latest press release. It says 1.4 million people were sent PUA verification. Only 1 out of five responded. Out of the 1 of five they said 90% of documents were accepted. Sounds like people are submitting wrong things, or no way they can "track" the documentation to you. I think that's encouraging, hope it helps decrease anxiety. Not fun under any circumstance. If this same rate lasts until the deadline in a month, the EDD is going to have to address what they plan to do exactly to hundreds of thousands of people. They absolutely should be addressing this a whole lot more right now. It would take them years to complete the collection process for that many people based on their backlog record previously. These people really have some kind of nerve to disqualify anyone who bothers to send them anything when so many are sending nothing at all! Completely contemptible.

The EDD website it self DOES NOT say they can/will garnish wages OR levy your Bank Acct. It says everything else he said but NOT garnishing wages or levying a bank acct.

1st EDD approved the money to ppl during pandemic, than they want it back. If you don't pay back they will put a red flag on your status when look for work, immigration, garnishment. 2nd EDD need to look into each of individual case before approval benefits at the pandemic. If EDD put a red flag on ppl when they try to look for a job so they have money to pay them back. That doesn't make sense.?????

The EDD doesn't want to accept any more responsibility for this mess than they already have. And they have done nothing but come off badly. So they are putting it all on the people now. We can see that very clearly now with the reports of them not accepting what many people provide. They should be signing off on each and every person's account, so long as they send them anything as opposed to nothing.

Call the edd number but then press 2 Spanish, yes Spanish ( they maybe can answer in Spanish but if you speak english they will respond in English remember If a Edd Employee speaking Spanish for sure they need Speak English,they working for a the State then )press 2 like an employer then press 4 regular questions for employers . ( please wait for the machine asking you to press those numbers do not press all numbers faster )The system wont transfer you to a Spanish representative this will. Transfer you to English representative doesn’t matter you an employee or employer I been using this way 10times the 10 times they Answer and 1 wait around 1 to 15 minutes promise they always answer. I discovered this method by mistake but notified it works one day i called 5 times and the 5 times the responding in. Around 10 minutes, wish this works for you. Btw thanks for your Videos Ms Silver

I asked Shelley on the millions channel to do this too, but at some point soon Ginny, can you ask your EDD contact to give an approximate percentage of the PUA cases in which nobody has sent them anything for employment verification? They should have some type of estimate. There's just over a month left for everyone to get this done. I'm betting the number of people who haven't turned in anything or who are facing overpayment is going to be very high. And I don't think the EDD has the capability of pursuing that many people in this way. My guess is it's hundreds of thousands of people.

That interpretation isn't what is being said here - they do not "red flag you so you can't apply for a job" rather, if you submitted a *false statement* then you must disclose on your job applications that you provided a false statement to a government agency. If you did not submit a false statement, then this would not at all impact your future employment.

If you WERE ELIGIBLE all you have to do is make sure that your INCOME from your employment or self-employment in 2019 MATCHES what YOU CLAIMED you made in 2019 to qualify for the UI benefits!!! This requires filing your 2019 taxes if you haven't OR FILING AN AMENDED RETURN for 2019 if the numbers you gave the CA EDD did not match your actual return.

For example I was planning to start my own make-up services on clients in Spring of 2020, when I filed for PUA I said that I made $0 in 2019 since I did not perform any work. So far I have submitted my make-up business plan to them, also I obtained a paper from my son’s school stating he was on zoom but haven’t sent that in yet because I did not know I can use school papers. As a 78 year old senior who earned less than 11 thousand dollars in social security last year, what will happen if my verification is denied and I haven't the means to pay the money back that i received ? The cost of living where I live is over 49,000 dollars a year to live as a single person? So I've already spent the money I received. You will just need to provide documentation of your work history prior to unemployment - the amount would line up with what you claimed on your application so amount earned would not matter.

If you earned income and didn't report it when you submitted the biweekly certifications, you collect d benefits which you weren't entitled to and submitted a false statement since the form asks if you worked and earned income. Yes, you will be required to pay back any of the amount which should not have been collected due to your unreported income and a possible 30% penalty. Hopefully because you corrected this on your own instead of the edF finding out from your employers tax reporting, the false statement penalty can be removed/appealed. When you receive the overpayment notice, file an appeal with the instructions on the form included in the notice.

I have been pending since Feb 2021, the other day i received a phone appointment call out of the blue. I have certified every week. During the call i was asked a question i wasn't sure with the date so i asked for a moment to look at my papers. He told he did not have the to wait and hung up, a whole 2 min and 20 secs was the lenght of the appointment call, now i received a letter denying my claim. Hello, Ginny. My dilemma is that I need to send in declarations from massage clients I worked on since they were cash payments. I already had my appeals hearing by phone and am supposed to submit the sworn statements this week. The thing is in the appeal hearing I stated that I posted an ad on social media, which i did. The clients I had were not from social media leads, they were from word of mouth and client I had in the past. Do you know if EDD investigators will actually contact them and ask them how they found out about my services? I'm scared to submit their SWORN statements and not have it match with what I said in the appeals hearing. I want to submit the statements for my services rendered but I'm worried they will ask them how they found out about my services. Sorry if I left out information

Appeals is a legal process,a judge and court is involved claimants are getting sured for the money back.Phone contacts rarely have the authority to forgive the debt. Claimants are not aware that legal representation should be aquired to go against claims by employers and edd.Both which have attorneys.

Hi Ginny How are you? Thanks for all you bring to the community. Something really odd is happening, I sent EDD my job offer contract from April 2020 I couldn’t accept the job because at the time the senior residence where I got the offer was riddled with Covid. I had to turn the job offer down - however I also sent in my 2020 tax returns. They accepted it everything‘s good but recently since December 31, 2021 they have been loading my debit card with $114 daily. I don’t know why this is happening and I cannot reach them. Is anyone else experiencing the same thing?

That's a good question. The answer is you continue to pay interest even if you go on a payment plan.

Hi! I need help! I attempted to start my own business in the beginning of covid. Putting 40 hours non payed into my own business Unfortunately it did not work out because I had to keep my kids homeschool because covid. Now I clearly stated I made $0. How do I get prove of that? I try doing my taxes but they said sinces I made $0 Theirs no reason to apply it on our taxes. (My husband files married) So I have no proves for my buisness now what should I do? 1099 is acceptable! EDD's media dept confirmed this to me via email.

How long do you think they are going be sending out overpayment notices? I'm expecting one for my mom but she hasn't heard anything but i'm praying they skip over her. I helped her fill it out for PUA and I could have sworn they asked for gross... If i remember correctly I wasn't the only one who remember seeing gross instead of net. It's not farfetched that they would put gross instead of net, this was at the very beginning of the pandemic and EDD were making mistakes left and right trying to rush PUA through.

Edd I remembered they only ask for net income only. That's why the weekly pay not much Other like loans sbda ask for gross. That's why they look back what we claim exactly or not. and they took back over payment

I forsure made some mistakes certifying some of my weeks back 2020, but until now I haven’t gotten any mail yet. Recently I had a mistake too and emailed and contacted edd right away about the unintentional mistake and got paid, but no overpayment mail yet. Am I going to jail if I agreed to pay back overpayment? I have a fear of law and I’m stressing myself to much right now even tho i dont have an overpayment letter yet since I have anxiety and depression 😅 I don’t want to go to jail, I can work on repaying it than being in jail 😅 please someone answer my question hehe. I got my letter saying I didn't send anything or didn't send appropriate documents (I sent receipts and appointments that were made with clients) so I appealed. But does anyone know what that's like? Is it just a phone call and what do they even ask? If it's a phone call how do I show them what I sent in? Helpppp!

Hi Ginny, I just had started my business and had a couple of jobs , but the customers canceled them at the beginning of March. So I don't have anything to show edd, I did finally pick up some jobs in Oct of this year and I have contracts and receipts for those. I was sending in my affidavit along with those docs. Will that be enough? I also purchased a Van in May of 2020 to provide pickup and delivery service. I do have a EIN # For the business. I suppose I could reach out to the customers that cancelled way back then. Any feedback is totally appreciated:-)

Hi Ginny, I was working part-time/on-call while I was receiving unemployment, I also was using my remaining sick/vacation hours during this time. Now, I received a phone call from someone from EDD stating my previous employer reported I earned more than what I had reported on my certification. I was only reporting the hours I worked not the sick/vacation hours. Was I supposed to report my sick/vacation also? I haven't gotten a letter from EDD regarding overpayment, but the person who called me stated I should be getting a letter soon with date and time of my interview about this. I am freaking out.
