I had a signs up in my shop { All computers not picked up and paid within 30 days will be disposed off } I always phoned my customers 3 times, if I got no response, I would hold it for a couple of weeks then ether sell it or scrap it, never had a problem in 25 years, one guy came back after 9 months lol, what business has room to keep items in storage for that length of time, I think your being more than fair, going down the court route is hassle and stress no one needs hopefully you cane sort something out between yourselves.

I do the same mate. 30 days to pay the bill or the system is sold. I make sure the customer/client is Well Aware and signs a waver. I dont store and I dont Care about your gear. I repair it/upgrade it etc . If someone wants to make an Upgrade thats pricey they pay Upfront for parts + 10% towards the hourly or they pound sand. 30 years now and ive had One guy like you that came back a year later. I dont fuck about and I expect others to follow suit. Theres a reason my rates arent the cheapest, you Get what you pay for here and then some. Live and learn right? Cheers.

It sure would be helpful to have an engine test stand, although I realize that you rarely deal with complete engines. You would have an immediate answer to whether some of these problem engines are good or bad.

Lee, you're a good man. Next time I need work done, I'll look you up. But I think you're way too nice with this customer. He does not stick to his part of the deal. Tell him to get an engineer in within 2 weeks. If nothing happens, take his non-payment to the fast track court (small claims). Cease any communication with him. You really can't spend any more time on this. Good luck !

Once you start the small claims court action, stop all contact with the client. This guy is only trying to muddy the waters. Everything is then dealt with via the court. Once the client is faced with the courts he will be forced to confront reality. At that stage the client either decides to settle or play a much shorter game with the court

thats is not a good idea, "Pre-Action Protocol for Construction and Engineering Disputes 2nd edition". States: Section 3 Objectives. 3.1.2 to make appropriate attempts to resolve the matter without starting proceedings and, in particular, to consider the use of an appropriate form of ADR in order to do so.

@@thefreedomguyuk Previous obligations have no influence on the pre-action protocol, ADR will take into account all previous actions by both parties and draw their conclusion from it. My guess is the defendant is well aware of this, or taking legal advice on the matter, this is why they have requested ADR. Stopping all contact as recommended on first posted above is a bad move, as refusing to accept ADR is likely to result in the Court dismissing the case, or at the very least, it will be looked at unfavourably by the Court as you will have failed to attempt settlement out of Court. This is why the protocol states “in particular, to consider the use of an appropriate form of ADR in order to do so.”

You can send a letter warning him if he doesn't collect his engine within 30 days you will consider the engine has been abandoned and you will sell the engine, to off set your cost, and then start court proceedings to recover the rest of your cost. Warning him if you win in court this may affect his ability to get loans or overdrafts in the he future

Storage charges for customers parts seems a bit mild, agree with the charges but after a certain period of time there should be a clause where the items will be scraped at customers expense and all costs sough though legal means.

Issue a 14 days notice to pay. If he doesn't pay issue county court claim £70. The court will offer a resolution service before a hearing anyway

Myself along with a few other people, we suggested yourselves to Adam especially as he wants to go to around 500 brake horsepower that he would need the long stud conversion especially if he wants reliability and not to blow head gaskets etc

Send the Golf customer a letter stating that if you do not receive full payment within 14 days that you will dispose of the engine. It's time to add a storage charge clause to your estimates, your warranty, your T&Cs and to the footer of all of your emails. You also need to add a Romalpa Clause to your T&Cs and to your estimates.

Hello, these may sound a silly questions, re this engine. Did the customer try changing the oil pressure sender unit, did he connect up a mechanical oil pressure gauge to check the pressure at idle? Is he using the correct oil filter? (some cheap ones do not have a return valve built in, that allow the oil galleries to drain after engine shut down, not a good idea). Has the oil pressure release valve been checked to see it is not leaking or stuck open? Has the oil feed to the head been modified to increase oil flow to the cams etc? I had this on a so called, BMW E 30 "race" engine, that, caused low oil pressure at idle, it took me some time to find the problem! To me, these are basic checks.

So on the golf engine for what it’s worth here is my view: 1 - all replies to the customer state the facts only - don’t engage is any discussions, be clear and consistent, repeat your terms and conditions just cut and paste from your initial quote, 2 - 21 days notice of recovery of costs via the courts, 3 - pay up the court fee and let it run. Let us know the outcome in a few weeks. 4 either way move on.

A block can only be skimmed so much. As such, pistons are made for material to be taken off to the extent of the block they're made for. A.k.a, it does not affect their strength so long as the power that engine makes is what the pistons are rated for.

you're absolutely on the money with the golf engine, storage fees are a standard thing, the guy sounds like a chancer, he did post about this in a mk2 golf group and the comments didnt go his way so he deleted it, the bottom line is the thing is well out of warranty, you owe him nothing, obviously if you found something wrong with it you'd probably fix it out of goodwill, but you cant fix what isnt broken, unfortunately it looks like you're going to have to chase this guy to the ends of te earth, which probably isnt worth it, take legal advice, put a date on the matter that he must respond by, if no response scrap the engine and move on (or sell it to recoup)

If her wants to go to a dispute meeting, he'll lose. You have proof and he's seen it, that the engine is ok. Unless he can offer some proof that there is been a machining or assembly error, he's lost his case.

Make sure you copy and save all correspondence, and definitely record all conversations. Basically, do everything you can to cover your arse. This guy is pushing his luck, he's convinced himself its your problem, not his. By agreeing to check the engine over, you threw him a bone, he saw it as an admission. This smells all day long like its going to go legal. Do not dispose of the engine under any circumstances, unless advised by a court to do so. A pain, I know, but thats the nature of disputes.

Saw a shop that runs builds via an electric drive on the crank , to confirm pressures . they rigged up an oil supply tube and the block drains into a catch pan. seems to be the best answer. or stick the engine in and use a wet line analogue gauge you calibrated that will show pressures.

And what if an independent engineer deems you are at fault. When I was building engines we had a test stand that I made so could run engines make sure oil pressure ok. Obviously you can’t do that with an incomplete motor. Only other thing I used to do was record everything, mobile phones great for that. Then the customer gets a complete record of their build

They built it and supplied parts so their contract it with supplier. I’d have been asking for replacement bearings and fitting them and invoicing supplier as this may bite them if the suppliers make a mistake with it.

@@whitacrebespoke I hear what you say but it sounded to me that the original contract was between the engine owners and Craddocks. The fact that Craddocks sub-contracted the works to Baram is I believe a side issue. Also I understand that Baram are not doing anything to the engine other than sending it to Craddocks. All sounds convoluted to me. Maybe I have misunderstood the process as when all is said and done the cam bearings manufacturer must be footing the cost of the correct replacements.

get solicitor to create a LIEN on the engine for the outstanding costs. customer informed he has a designated time to pay and collect the engine or it may be sold to recover the debt owed and any monies in excess of the debt returned to the owner, seems fair to me.

I like watching your videos, which are mainly about when reality gets in way and things do not go to plan. But i would bet that the videos are about less than 3-4% of the total number of engines that go through your hands. As in 3-4% of engines you work on have an issue. Nothing is perfect. I wish you well. When i built cosworth DFV engines for a living there were still issues.

About this golf engine, could it be less of a headache to reassemble it as it was received, write a letter stating your findings, and ship it back to his home address? I'm just thinking that for what little is at stake labor wise, it may not be worth the time and effort to go to court, just cut the loss where it's at and move on. Just a thought, great videos, keep up the good work.

It could be the customer is having trouble finding an independent engineer that will: 1) work for free, or cheaply 2) lacks integrity enough to rule in favor of the customer regardless of findings. Pretending that the situation is unclear and continuous clarity is requested is often just a deflection, a means of creating delay through confusion. The perp often hopes to wear the opposing party down to the point of them throwing their hands up and giving them their way.

I don't know how the law works in your part of the world but can't you do what tow truck companies do with vehicles? Up front in the service agreement state that goods not picked up after x days will be auctioned to recover debts owed and storage costs. Or maybe a small claim judgement in your favor is needed first?

You'll have no problems dealing with John Craddock's. They're a very reputable company in the Land Rover world and good to deal with. On the golf engine just sue the bugger and just before you put the paperwork into the court send him the very first email stating your terms of agreement on what was going to be done and remind him of what he had to do and so far has failed to do. Give him seven days to pay up and if he doesn't, then put the paperwork straight into the court and from then on do not respond to any further communication from him. Once the paperwork is in the matter is under the law ( Sub judicae)

Your assessment and course of action is 100% correct as long as it's on paper. He failed to get the engine inspected by an independent engineer so he will fail in any court action. This guy is a scammer. ☘️☘️

Lee, you've been too nice, too accomodating. This individual has dragged this out beyond all reason, and you have permitted it to occur. That is YOUR fault, it's beyond time to take a mechanic's lien on engine, I doubt he'll ever pay, even if you go to court, and it appears he's playing a series of delay tactics. You've already spent many times the monetary value labor/parts of original bill in added concessions, delays and back and forth re-negotiations requiring YOUR time, which IS a cost to the business. Get the mechanic's lien executed and you can then sell or gift away the engine DONE ! He won't get the engineer, and notice HE's not insisting on one being brought in, he wants another roll of dice with ADR to see if he can get out from under the entire bill and obligations. I guarantee some of your other more local customer's with a Golf would love to take on getting a spare engine with requirements being that they install it AS IS and bring it to your shop immediately after installation to be tested and run in by yourselves to verify there was NEVER a problem with original job. This will also allow you to get KZbin content on task and some compensation monetarily as well as restoring reputation re Golf engine services. He's already gotten car running with another engine, he doesn't need the one he requested you build up anymore, maybe you can avoid lien if you get him to sign off ownership of engine in exchange for bill and promise to END to this issue NOW.

How much money and time have you wasted at this point about this engine. Ship it back the way it is and move on . Just do work for big money engines. And try an avoiding these type of jobs . Probably nothing wronge with the engine just the customer looking to get a few quid out of it all.
