There is an important amendment in Maharashtra Cooperative Societies Act (MCS Act), making Associate Membership of a housing society easier. One can now become an Associate Member of a society with fewer formalities and hindrances. Housing guru Ramesh Prabhu, chief of Maharashtra Societies Welfare Association (MSWA), explains the significance of this recent amendment.

Sir, in how much period from making an application with fees should the Managing Committee take and communicate decision about the application to the applicant and the Member and what are the consequences if it is not done? Which are the relevant clauses under MCS Act Amendment 2019?

Sir, Normally all CHS get newly published copy of model bye laws and adopt them as they are. Do the time to time amendments in the main housing societies act are all incorporated in the newly published model bye laws ? As observed societies are not aware of amendments in the main act. For example in 2019 amendments in the main act there are changes in associate, provisional membership cliterias and also their rights. Are these amendments in the act rflect in the newly published model bye laws ? Also the prescribed forms for associate, provisional membership as per the new amendments are not available. Where we do get those or does CHS have to draft its own forms ?

Sir can a joint holder or associate member hold a post as Secretary/Chaiman/Treasurer or Committee member in a Housing Society even though the first holder is alive and change presence in AGM or Society meetings by either attending convientely at different times

Sir, A associate member married on 17 Dec 2006 having 3 children hasbeen declared a managing committee member by the Returning election officer on 16 th Jan 2022. can the associate member be disqualified. Given to understand rule applicable effective 3 rd Sept 2001. Thank you.

Can you also please share the updated Form to be submitted to society for becoming an Associate member? I could not find any form updated after 2019 amendment. All forms are old and contain text about admitting name of new Associate member on share certificate. Please help 🙏

Thanks got good clarity on the subject. I have a query - once associate member is admitted and is also elected as a committee member by contesting election, can first member who had recommended the associate member still be allowed to attend the meeting in absence of that elected associate member?

Is valid approval / recommendation from original member MANDATORY to make any body see Associate Member . Is Associate Membership to be Given after approval from MC and then GBM ? Sir is there a prescribed format or form for application for admission of an associate member as per the latest amendment of 9 March 2019 as detailed in the above video ? As due to the above amendment, the old prescribed format of associate member has become obsolete. There is no updated form. However you can use the existing form (5) by striking out the relevant words/sentences. Can email it. Just let me know.

Byelaws 146/154/etc. specifies office bearers can be penalized for its violations....can the process be simplified within the chsl. & how? Thus they will not act like gangsters.

Quick and dirty way is: Co-opt new members to the committee. Usually, in most societies, nobody objects to this. If they do, that's a second-level issue, and it will have far-reaching social consequences for them.

Nd trustees have conveyance to give to builders.nd trustees asking for 5 crs for conveyance Nd again after new tower building is ready they want conveyance back in their custody.logically this is not right currently we live is society Nd after in tower society been made with new members Nd conveyance remains with tower new Nd old members in case of landlord.then landlord doesn't remain owner.but here trustees wants to remain land owner Nd want to have conveyance right back means our generation after 40 yrs agar tower will have to be rebuilt like today what we have trustees again will ask fat money amt like today 5 crs they want.so this is wrong being done sir

If associate name is not registered in share certificate although he is related as you said , is it not a loop open for the entry of someone who is related but not officially holding name in the share certificate. Just by having a direct relationship may not confirmed the authentication of shares in the property

The Associate Member is a person whose name must not be in the share certificate. Prior to amendment an Associate Member’s name was to be endorsed on the share certificate.

I wonder whether Maharashtra government even applies its mind while making laws. As per our national pledge, all Indians are brother and sisters. Hence now a member can introduce his driver as his brother and make him attend all meetings.

Regarding Maharashatra Co operstive Societyies(Amendement) Ordinance-2019, which is deemed to have come in force in the 09-03-2019, the booklet, you can get it from Maharashtra State Welfare Association, situated at Andheri(W)58. Tel no. 022 42551414/32, E mail MSWA.hg@ gmail. Com. Or You can also contact--Thane District Co operstive Housing Federation Ltd. Thane 400601 Tel no. 25332286/25363277. E maail-thanedisthsgfed75@gmail.com For all your CHS enquiry. Society forms, etc to contact them. You are all aware that as per Article-24-A of Co-operstive act, 1960, Co operative education and training has been made mandatory for all office bearers/members of Co-operative societies. This training is also given through maswa's Ofice. By such educational training for your C H S members, you can more information on the Sct/Rules, changes made periodically information in the Act/Rules and you can also have question/answer timing etc. For more information on the subject, suggest all CHS members to contact either MSWA or Thane Dist. Sur we trustees asking for 5 crs for conveyance to builder on behalf of society.nd again they want back conveyance in their custody.this is absolutely wrong .Even landlord after conveyance transferred nd new tower is ready landlord doesn't remain landlord nd tower becomes society nd conveyance being given to society new nd old members but here trustees r charging noe big fat smt for transferring conveyance nd sgai they want back conveyance custody.tell what our society do

@@duediligence1742 if you are a close relative of the original member as defined in the Act--2019, then with the prior permission of the original member you can apply for an Associate Membership with your society. It is not necessary to have your name in the share certificate. In fact as per New amendement Act-2019 Associate members name must not be in the share certificate.. A joint owner of a property whose name doesn't stand first in a share certificate is called as Joint Member and not as Associate member as was the position in the previous definition.

@@FaktPuneri As per Msharashstra Cooperative Society Act-1960,amendement 2019, the definition of Associate Member is--Associate Member means husband wife, father, mother brother sister son, daughter, son in law, daughter in law, nephew, niece a per son admitted to Membership of a Housing Society on written recommendation of a Member to excercise his rights and duties with his written prior consent and whose name doesn't stand in the share certificate. Act 2019,--
