Now there needs to be a prequel showing James Gordon's & Alfred Pennyworth's training. Gordon & Alfred are kicking multiple Talon's asses in hand to hand combat, Batman has a extremely difficult time defeating one Talon. Gotham would not even need Batman until Gordon was in Gordon's 40's, plus Gordon has no issues pulling the trigger to kill, less villains.

Not legally. Because Gotham is a FOX-produced series, Warner Bros. had a few restrictions on what the showrunners could and couldn’t use in the show, chief among them was the fact that they were forbidden from using the Joker name in the fear that the show would “dilute” the brand, since the DCEU was just getting started when the show began (which is ironic, seeing as they gave us Jared Leto’s rendition of “Joker” and nothing else related to the character in the main DCEU, since Joaquin Phoenix’s film takes place in a different continuity).
