Eminent domain is meant to acquire land for projects that are meant for the public good. They are taking property without a compelling reason.

The bureaucrats responsible for these illegal acts should face consequences. Given that their own homes have been bought with ill gotten gains from their criminal employment, it's only fitting these bureaucrats' homes should be confiscated through civil forfeiture. Then they'll get a small taste of what it's like.

I'm horrified but not shocked. Mr. Birmbaum is a community asset. He was my most important piano teacher even though I studied with others at a university. To hear him play is to be alive. Please do anything to help him keep his homebase and fight CRDA. Sincerely, Ann

its not often i watch a youtube ad, i live in canada and have no impact in the USA for such matters and wish i could do something about things like this, all i can really do is say i do not support such terrible disrespect towards people who choose to want to keep their home no matter what and wish this man the best of luck against such disrespect. in time all this crap in the USA will trigger a civil war and probably should, all those that fought in the war for independence would be rolling in their graves if they could see what the country has and is becoming :(

Justin Wilson Senior Director of Communications Arlington, Va.- In a ruling that may bring an end to the years-long battle to save Charlie Birnbaum’s longtime family home from condemnation, Judge Julio Mendez today ruled that the Casino Reinvestment Development Authority’s attempt to take Birnbaum’s property was “a manifest abuse of the eminent domain power” and dismissed the state’s condemnation action once and for all. “This is a victory for property rights, common sense, and the people of New Jersey,” said Institute for Justice (IJ) Senior Attorney Robert McNamara. “The CRDA’s position was that they could take Charlie’s property for any reason or for no reason, just because they wanted it. Today’s ruling emphatically says otherwise.”

@@cdreid99999 the bank screwed them, they sued the bank, and won in court. between the judge making his decision, and the ruling being announced, the bank declared bankruptcy, so the property was transferred to the FDIC. the board of directors of the bank and the board of the directors of the FDIC was, to a man, the same people.

@Kevin Cortes: you are comparing two completely different things. When Europeans usurped Native Americans' land, there were no papers of ownership or buildings. They used the lands and lived off the bounty it provided. I am not denying the injustice of what was done to indigenous people, because it was WRONG! This isn't 300 years ago, it is now! This man and his family PAID MONEY for their property, and have a right to expect to get fair value if/when they decide to sell it. Atlantic City wants to expropriate this land (under the guise of Eminent domain), though they have no specific use for it. So, it is purely for speculative purposes! To take someone's property for no good use, or to benefit the community, is reprehensible. A casino does not benefit the community. It benefits the city & the gaming establishment. This isn't the American way! This is the American Way of Greed, and should not be tolerated or accepted by any individual.

In 2000 the city of Philadelphia took my buddy's truck repair shop. It was a big shop on almost an acre in a run down industrial area. They claimed they were going to make it a park. It was crazy because the whole neighborhood was contaminated. His property was formerly a galvanizing plant, there was an auto battery plant next to it, and an old abandoned chemical company on the other side, the whole place was old factories built in the 1920's and 30's. And some idiot from the city decided they were going to make it a park for kids to play. When they tore the buildings down there was asbestos, spilled chemicals, lead contamination, and giant (10,000 gallon +) underground storage tanks from like 1930 under the buildings. And the city's plan was for kids to play there. Now the whole place is overgrown vacant lots where people go to illegally dump crap

I live in Barrie Ontario Canada. A few years back Barrie chose to close Barrie Central highschool, the oldest highschool in Barrie. The Forced kids to find a new school dividing their friends and put many school workers out of a job. It has been at least 10yrs and it is still just an empty lot...

A tax to move out of state? That is unconstitutional. It prevents interstate travel which is guaranteed by the Constitution. Thats like Californias exit tax. They can’t legally do that. Even if the GOVERNMENT USES EMINENT DOMAIN TO SEIZE PROPERTY, THEY HAVE TO COMPENSATE YOU WITH A FAIR MARKET VALUE SETTLEMENT. I would sue the piss out of the CONTRACTOR, the CITY AND THE STATE. THE SQUEAKY WHEEL GETS THE GREASE.

The problem is poor planning by the casino....it should have chosen a plot of land large enough to accommodate it's future expansion... instead it choose a limited plot and now it's using a law meant specifically for public use..... not private for profit use.. The Supreme Court showed it's corrupt body when it ruled in favor of this theft..
