I have no idea where this story is taking place. And in the US, each state has their own unique flavor of estate management. I can't claim to be an expert of the field in even one state. But generally speaking, if you have property you need a will. That will, will layout all of your wishes including funeral expenses. Now with Grandma well aware she was sick and likely dying, I have to scratch my head if no will was in place. If there is a will, why is anybody fighting other than poorly handling their grief on the passing? Now, assuming no will is in place, an administrator can be setup to run the estate. Generally speaking if the family of heirs can't agree to who that can be, the estate sits in limbo until either (1) an agreement is reached on who will administer the estate or (2) somebody does it once they legally can. I don't know if every state in the US is the same, but in mine if no decision has been reached within three months of the person passing, the first one who shows up at the clerk of court is the winner or loser depending on your point of view. Now, the estate pays for the funeral if there is any money left. Funeral expenses is priority number one I believe. So even if the family pays for it out of pocket, the estate will still need to cover that expense before the estate is settled. Now, estates without wills cover financial assets. Generally speaking not physical assets like homes. These generally can be brought into the estate only if (1) everybody agrees to it (recommend getting that in writing) (2) the property is needed to cover the bills. The short of it all is that if you have minors involved if you own physical property, you need a will. Generally speaking, inheritance goes like this. Children, grandchildren, great grand kids, etc. No children? Then parents. No parents, then siblings. From siblings it goes to nieces and nephews. So unless the grandkids are next in line, there is nothing to really argue about. Their cut is likely to be so small as to be hardly making it worth while to even be involved. The more inheritors the more diluted the estate gets (without a will).

Family fortunes can be wonderful or they can be the worst thing ever. OP's grandmother left the money to the one who SHOWED how much the grandmother was loved and SHOWED her concern for the grandmother. As the old saying goes, "Talk is cheap." My story doesn't involve millions, maybe a couple of thousand and some jewelry, but it caused a rift between my family and my godmother. My mom's sister (let's call her H) told my mom and me (64 year-old female), on the day of my 16th birthday, that she was giving me an antique Cameo dinner ring and that she had named me executor of her estate. Well, my godmother (call her Z) overheard this and was livid -- if you don't want to hear something you won't like, then don't eavesdrop on private conversations. Z was mean to H during their visit to my parents' home and on the trip back to their home town -- she was also upset with her mother and the other two aunts that had come with her because they thought it was a good idea (H had talked with the aunts - her sisters, actually - and her brothers about what she had planned and they all supported it). H died when I was about 31. As executor of the estate, I had to make the arrangements for the funeral, put her money into an account that allowed her brothers access so they could pay property taxes and do some upkeep to her home until it could be sold. Yes, the money WAS left to me. NO, I did NOT go overboard with the funeral expenses -- she was a person who lived frugally and did not want an elaborate funeral. And, NO, I did NOT keep any money when I moved it into the account that gave my uncles access. I got two other rings, a few books, and furniture -- the house was put in my uncles' names so they could sell it. Z stayed angry with H and me long after H's death. The reason H named me executor and put my name on her bank accounts was that Z had manipulated her father's brother and her own parents into naming her as their sole heir (cutting out her brothers and sisters from her parents estate and her cousins from their fathers estate). H knew I would do what was right with the money and not go too far nor skimp too much with the funeral arrangements. Z approached me the day of H's funeral telling me she hoped I spent the rest of H's money as frugally on myself as I did her funeral and that I did NOT deserve any of H's money NOR the rings I got. Z never apologized for the things she said to me, my mom, or H; but I forgave her as did my mom. I did learn that the LOVE of money is the root of evil due to that experience.

I wish OP the best if luck. Money usually causes more family issues than most people understand. Some people think that they have a say on their parents or grandparents money. Unfortunately I have a similar story. My grand parents died last year (October and December). I don't know if they left much in the way of inheritance, I never really cared about that kind of thing, but the youngest of my aunts managed to get a power of attorney and took everything left behind. 2 properties and then some. All she ever did was get black out drunk, disappear for weeks on end, abandon her son who literally ended his own life. This has been nothing but drama since it happened. I wanted to forgive her for the way she treated me in the past, and my faith will have me do that anyway. But I know I will never have to see her again and I don't soo much as care one bit. I only dread when my parents die I will have to go through the same with my sister. She is every bit as much the same type of person. Any time my mother tries to reconcile with my sister, it always becomes about money that my sister needs. My mother pays her light bill, helps her get a car, and it's never enough to satisfy my sister. I'm unfortunate that I have to live with my parents. Medical issues, lack of work, bad luck and decisions. Once my parent pass I will become homeless so my sister can get her half of everything.

You need to start planning now. You need to see what you can do to earn money and get yourself out of this mess. Make sure there is a will so you can at least get half. Make sure that you, not your sister, get power of attorney or let the lawyers handle it. Remind your parents of what happened when your grandparents died if you have to and tell them that their last act of care for their children is to get this sorted out.

They were shocked because they are full of themselves and believe that they should just get something because they're related. Some people never grow up, stop to think of anyone else but their own selves, that's why. Your will means that you get to decide who get's your stuff when you're gone, period. Other don't get to decide what is YOUR WILL. "Fair or unfair" a person decides what goes to who. After all it was her stuff. We can't contest a person's will as it is theirs to begin with. We can only ask if we can have something if someone else doesn't want or need it. BUT we can't force nor should we cooerse someone to give us anything. What you might do is give everyone a piece each, that is something that they like to remember her by, that is if they won't sell it for money. You don't owe them anything. Your grandma was wise in that she chose you, because you aren't the materialist, like your other relatives.

Once the matriarch of the family passes, so does the closeness of the family whether money is involved or not.

Can OP not sue the department for false arrest? I’d imagine some kinda civil rights were violated here.

The cops made themselves look like idiots for trying to arrest someone based on rumors and hearsay. With a minimum of investigation, they would have realized what was happening.

I don't know if my grandmother on my mother's side had an actual will or not. Most of my aunts and uncles except for one aunt attack like vultures and took everything she had no matter whom it was supposed to go to. My sister and I was promised a few small things, but we got nothing. In fact one uncle took her car but charged his sister the upkeep for it, till my father said that it was wrong, so he put it up on blocks. I kept in contact with the one aunt that didn't try to take everything, but lost contact with her too. Now they all have passed away never talking to them sense about 78. Now it is just my 2 brothers and sister left. It scares me to the point of a full-blown panic attack just thinking about either of them passing on. I'm 62 and each one is 4 years older than the other. For some reason I seem to be in the worst condition of the lot. I'm permanently disable with a messed up back and I have Parkinson's Disease that I've had for about 7 years and it has taken its toll on my health, suffering from severe depression and anxiety.

Instead of an extravegant funeral, which she can't see, everyone bring something that means something to them that they would like to gift her and place it in the coffin with her. Not flowers because they die, but maybe something made of clothe, or jewlery, just something that doesn't rot, not money either, but something nice. Pharoahs were buried with their belonging, and this would be just a last I love you for her. You had a great grandma and what they should of learned from her was how to love, because her god wasn't money.

Hope OP keeps the young members of the family in mind as she never mentioned anything nasty done by them. Her grandmother would have wanted her to help them in their time of need, but she should also keep in mind the parents could manipulate them to get at the money.

This young woman had it right all along. Her grandmother was full of wisdom. She knew her kids and they proved their metal or should I say lack of it when their mother was sick and they never comforted her, helped her or would even change her diaper. She knew what her children had turned into and gave the inheritance to the one person who cared for her and loved her. Her granddaughter. Their greed and evilness came out when they received none of the inheritance.

OP should retain the lawyer and sue for false arrest. Even if they arrested her uncles, she's got a right to sue for false arrest and be compensated for it.

Who is the executor of Grandma's estate? I presume her lawyer. Get what you need from the estate to give grandma a decent funeral and get it taken care of. All the relatives are responsible for their own actions and can face whatever consequences are coming their way.

This is exactly what happened to me many years ago. My parents passed away in an accident and left me the entire inheritance. I have 2 sisters and one brother who when they turned 18 left the family to live away from everyone. Years passed and no word from anybody. The will gave me the money then all of a sudden everyone was at the door with their hands out. Even uncles, aunts, cousins I've never met where crawling out of the woodwork.
