Sir I was an employee in an Engineering College a( a Pvt organisation ) approved by AICETE.and worked as an instructor from 15/5/2003 to 31/3/2023.I was an employ in a Govt. Institution and fron there I taken VRS and joined here after 20 years of service. I joined on regular post with a salary of 5000 lump sum salary. This was increased upto 23000 at 2023. My problem is that I am not given the provident fund money and gratuity so far. I informed the matter to the Ao, principal, and management but they are keeping mum without answering. What step I should take against non paymant sir. Please reply. I am Balakrishnan, pala, kottayam dt.

@@shabeeracs Thank you for the reply. However, Section 4(2) of the Payment of Gratuity Act. The section spells out the condition on the eligibility of an employee for gratuity in the event of him not completing the full five year period. The section says that for every completed year of service in excess of six months, the employer shall pay gratuity to an employee. That means if an employee works in the establishment for more than 6 months in a year, he shall be eligible to get gratuity at the prescribed rate. So, if an employee completes 4 years and 6 months of continuous service in the same establishment, he is eligible to get gratuity as per the Payment of Gratuity Act 1972. Could you please advise on this?
