Criminal trials have to start with examination and testimony of victims as witnesses. Here victims are the hostages. Before anything ICC should have issued habeas corpus on the petition filed by South Africa. Now before issue of any warrant or procedure it should ask hostages be produced for examination and testimony. What trial will ICC conduct without prime witnesses to begin with.
