Its also pertinent to note that this code will simultaneously increases the burden of Income tax returns of an employee, if the basic component gets increases... Hope, its a statute intended to benefit both employees and revenue of the nation... ultimately this code will bite the employers pocket.

Retaining allowance is paid when an employee is retained by the employer when the factory or establishment is not working. Some other part in our country there was a system of engaging seasonal labours in some industries in which the labours were getting employment gainfully for six-seven months in a year and remaining months unemployed. During unemployment, they use to get retaining allowance so that they are available to the employer in next season. The retaining allowance is also paid in pursuance of the Report of the Second Central Industrial Wage Board on the Sugar Industry and subsequently in implementation of the Award of the Industrial Court.

The answer for your question about the RA is as follows Retaining Allowance (RA) is paid to workers during the off reasons for their forced idleness. This will come within the purview of wages as per section 2 (21) of Payment of the bonus act 1965. Reference for the same is the case of Chalthan Vidyut Sehkari Udyog vs. Government Labour Officer, AIR 1981 SC 905; 2 SCR 738

Thank you sir, should we decrease the basic due to financial trouble/salary breakup change. Example: I have been paying 13k as basic since 5years. But now i am going to change to 12k as basic.No change of take home. PF contribution will be reduced.

Sir it is 50 percent on total remuneration . Remuneration means gross salary, but in this example 50 percent is calculated on Basic+DA

Another neat and precise presentation by your sir, a thought to ponder about, is there a possibility of interpreting that apart from the expressly excluded allowances under the Def. of "wages" under COW, 19, any other "wage" component paid by whatsoever name, would be deemed "wages" as the def. states that "wages" means all remuneration and "wages" for the purpose of this Code & other Codes would become a dynamic figure especially when incentives are paid thereby effecting PF & other social security contributions
