dear sir, my wife died last month and i have one minor 17 years old daughter and nadra issuing me succession cirtificate decline letter in this regard and asking me to go to the court. if I'm natural guardian of my daughter what should i do to get succession cirtificate. my wife left our home and she was working women so settlement is also there. plz let me know. thanks

Sad to hear about demise of your wife. If your marriage was intact than you and your daughter are entitled for inheritence along with mother father of your wife or her brothers and sisters as the case .ay be. Secondly there must be some factual controversy in succession which led to denial certificate but no problem at all now you can go to civil court for succession certificate. Thirdly, if daughter is in your custody than you should apply for gaurdianship of property of your daughter and if she is not in your custody you should also seek custody of your daughter fron gaurdian court.

@@advocateonline83 our marriage was intact. her father and mother are not alive. factual discrepancy was nat yet appeared because i met nadra officer and asked about reqirements for succession cirtificate and after knowing that one of my child is minor he told me that nadra can't process this because of minor therefore i have to go to court. i don't know what should i ask to court if I'm natural gaurdian and we all ( me, my son and daughter ) live together.
