Questions: what if my wife wants to file for an h2b for my mom because she's due in May and she wants to go back to work after maternity leave, she wants to try to file for my mom instead of paying for day care. can we bypass the PWD or will it fall under an emergency and just get a quick answer?

The H2B Visa worker is already in the US and had a contract renewal. How does he know the status of his visa(before leaving the country of origin, the validity of the visa is only 8months)? Does it mean that once contract is renewed, the visa is also extended? What are his rights, limitations and privileges while working under the H2B visa? Does he have an option to move from one contractor/sponsor to another after he finish his contract from the original sponsor? It will be a great help if you can give light to this matter.

Hello @naturelover7433. You can check your I-94 record to see your status and date until which you can stay legally in the US. To access your I-94 record please visit i94.cbp.dhs.gov/I94/#/home and select Get Most Recent I-94. You can only stay in the US until the Admit Until Date. To stay after the expiration date you need to have an extension of stay or change of status from USCIS. Thank your feedback. Can US employer hire employees from non eligible countries under H2B program?

Thank you for your message. Generally NO, the employer cannot hire nationals of non-eligible countries under the H2B program. However, a national from a country not on the H2B list MAY only be the beneficiary of an approved H-2B petition IF the secretary of homeland security determines that it is in the U.S. interest for the national to be the beneficiary of such a petition.

Thank you for your message. You can change status in the US from B1/B2 status to H-2B status. However, change of status to H-2B is NOT done by filing form I-485. Form I-485 is an Application to Register Permanent Residence or Adjust Status.
