I am on h1b in new jersey, my employer has filed a amendment for address change from texas to new jersey and also change in salary, the amendment is filed in july, I wanted to travel my home country and comeback after a month, since my amendement is in review should i travel or it will be risky?

I don’t like recommending traveling with a pending case. Better to upgrade to premium processing so there is no doubt.

Technically yes you can file. USCIS might issue an rfe awaiting adjudication of the extension. Please ensure you speak with your attorney about the timing of it all.

If your job title is wrong, you can file an amendment immediately. Ensure the SOC occupation is correct and the job duties also. Your attorney may suggest waiting

Hi Sachin, thanks for sharing this very informative video, pls let me know your suggestion in below scenario whether amendment is required; 1. Extension for previous client included client as well as home address (due to work from home) for which petition was approved till Mar 2023 2. Contract with previous client is now over and now I will be working with a new client, same employer (100% remote work from home) 3. New client is more than 50 miles and in different state but my home address from where I will continue to work is not changing and my job title, duties are not changing Do I need to file amendment?

Not necessarily if the salary change isn’t significant. Have to evaluate if job duties or occupation has changed.

Hello, when you are not in the United States then you are not in H1b status. If you are outside of the country for a prolonged period of time, then it may have an impact on future h1 extension eligibility. For example, you’ll have to go for stamping after a new petition is approved or you may receive a 221g administrative processing so the consulate may determine whether the job is still available to you. If there’s third party placement, that would complicate the matters even more.
