In illustration (a) of Sec '19A'...B threats A to prosecute him for the forged note..here threat of prosecuting was not false,A had really forged the prmsry note..& in Coercion topic,we learnt that threat of true prosecution is not coercion.So if we see similar situation in a question that someone is threatening the other person for the prosecution of offence that he has actually done..will it be coercion and will be voidable under 19 or will it be undue inflnce viodable under 19A or it will be no offence if we go by what we learnt in coercion topic..someone plz clarify this in depth..thank u..God bless all

There is , Under section 19 of the act, the party who wants to avoid the contract has to restore the benefit which he received. While under section 19A either the contract can be fully avoided like in the above case. But also the court has one more option that the contract may be performed but at the conditions that court seems just and reasonable. Suppose, the moneylender gave the 100 rs on 100% interest. Here the court can change the interest rate to whatever they think is reasonable. And the contract may be performed.

A is entitled to succeed to an estate at the death of B; B dies: C, having received intelligence of B’s death, prevents the intelligence reaching A, and thus induces A to sell him his interest in the estate. The sale is voidable at the option of A. Here c wants to take the benifit of B's death by concealing TGE fact from A, so that A would sell him the property in a low price, as A do not know that after the death of B he become the owner so under inducement he sold the property, hence contract become voidable

B is working on the land of A, who knew that land has precios mineral but he did not tell to A. Lateron he himself purchased the land and A sold out at meagre price because he did not know about special features of his land. When A came to know that his land was precious then he said B had commited fraud by active concealment as per section 17 (2). The contract is voidable.

Sir S.64 and S.19A m likha h ki jis party k option pr contract voidable h agr usne koi benefit liya h vo restore krega. Whether the other party commit any act mention in S.15,16,17,18 get benefit under that contract is bound to restore or not?? If yes then why?? Because provision deal with person at whose option contract is voidable. Thank you sir..

Sir, section 64 me kaha gya h ki, jo contract ko voidable ghoshit karwayega, agar usne koi benefit gain ki h to usse dusri party ko restore karna hoga. Mera question ye h ki, jis party ne CUFM ka prayog kiya, agar vo koi benefit gain karta h, to kya court usse order ni degi Aggreived ko restore karne ka. Agar degi to vo kon se section k according degi?? Please answer Sir.
