Welcome to Harry Potter Theory. Today we’re discussing Magical LAW. That’s right, just like the muggle society, witches and wizards are confined to behaving within the framework of law and order.
We saw a little bit of this in the films- like when Harry had a disciplinary hearing before the Wizengamot. In this instance, Harry had performed underage magic (a Patronus Charm) in order to ward off Dementors attacking him and his cousin Dudley.
"Disciplinary hearing of the twelfth of August, into offences committed under the Decree for the Reasonable Restriction of Underage Sorcery and the International Statute of Secrecy by Harry James Potter, resident at number four, Privet Drive, Little Whinging, Surrey.”
Fortunately for Harry, Dumbledore stepped in and protected him- which resulted in Harry walking away with no charges.
However, underage magic is just ONE ‘law’ in a wizarding society that actually has a lot more laws than you may have thought. Today we’re going to be uncovering them- at least, all of the ones we have information on.
I should also add that I won’t be conflating ‘Law’ in the sense of legislation with ‘Law’ in the sense of a set of principles or scientific axioms.
I.e. the ‘Law’ for underage magic is a piece of legislation prohibiting the use of underage magic and GAMP’S LAW is a set of scientific principles.

What about when hermione repaired Harry’s glasses on the train and Ron was trying to do magic on his rat? Didn’t that break wizarding law?

I thought it was against wizardring laws to use liquid luck for sporting events or school exam or test.

Might be like doping in the muggle world, not illegal (in many countries, in some it is) according to a countries law, but instead banned by the sports organisation, who can only ban the person, not put then in prison, for example.

They didn’t know he specifically was doing magic…, only that magic was being done around him… and he was the only wizard in his neighborhood… remember Dobby and the Hover Charm?

@@Foxfire-xq5ij Interestingly enough, Dobby Apparating in and out didn't show up in the letter he was given. Meaning that in book 5 & 7, they could have picked Harry up by telling Dobby to fetch him.

If I understand this correctly, underage magic can be cast in the presence of Muggles only in an extremely dangerous situation, like the Dementors

Technically underage magic is not supposed to be done at all, even when not in the presence of a muggle. But yes, there was an exception for self-defense, or defense of another. And that raises the question of why Fudge bothered to emphasize Harry's use of magic in front of Dudley, since that had nothing to do with whether or not Harry was underage. And since Dudley was already aware of magic, and knew that Harry was a wizard, it could not be said to violate the statute of magical secrecy. Any more than the owls delivering letters to the Dursleys, or any number of other incidents where magical things were shown to them.

The reason that Fudge bothered to try Harry for it was because he had already been accused of a Hover Charm back in Chamber of Secrets which was in fact cast by Dobby the House Elf. Harry had gotten a warning that if anymore magic was detected, the trial, possible expulsion, and wand snapping would follow. Fudge tried to cling to that to make himself look good while denying that Voldemort was back to make Harry and Dumbledore look like fools which in turn backfired on Fudge when Voldemort showed up in the Ministry.

The only one you forgot is the law that whenever a new British prime Minister is elected, the head of the Ministry for Magic has to let them know about the presence of magical beings.

Doesn’t that make the whole secrecy thing absolutely pointless? What’s stoping that new prime minister from just exposing the entire magic world if they had somthing against them? And what could the ministry even do to stop that?

Goblins also do not accept the fact when a wizard buys something from goblins ownership goes to wizard. This caused a lot tension between the two species. Goblins need to also do better.

@@nickgennady yes, it is a two way street, the Goblins are not unaware of the customs of other races, they just want to use the system that is to their advantages.

@@drackestalentorgen166 I almost guarantee that is true, they would also likely justify it as such activities are not part of the Wizards tradition. While I may seem to be hard on goblins, they can and have stood their own ground, have their own power, and are not just victims here.

Using an Unforgivable Curse *against another human* leads to a lifetime sentence in Azkaban according to "Moody" in GoF. It is not stated if using an Unforgivable against a non-human is even prohibited.

That was Barty Crouch Jr. but yes this is a small breach- Cruel as it is you can train the curses on animals and I think it's also possible on magical creatures. Horrific in anyway. But as for the Avada Kedavra I would train in the room of requirement on objects. When the curse hit an object the object explodes.

That's not particularly right though, in the film adaptation Barty-Crouch-Moody says it himself: Hermione: "(...). The *use*of any one of them will.." Moody: "..earn you a one-way ticket to Azkaban." It's illegal to use them in general yet it might be an issue of traceability. Using it against humanoid creatures or humans might stand out more then insects or smaller animals.

I wonder if it would be illegal for anyone who has proven to be good at divinations to take part in games of chance such as gambling? For example could Trelawney be allowed to bet on quiddich matches if she's able to determine which team will win using the sight?

The fact that divination has credibility issues even in the magical community could keep Seers like Trelawney out of trouble in that regard. On the other hand, the use of Felix Felicis is strictly forbidden in the field of sports and that is something not mentioned in the video. I could probably see a ban of its use in casinos opened and operated by wizards, particularly in the U.S.

Ive always wondered about the death eaters masks. Did each of them create their own or did voldemort design them specifically for each of them? What did each characters mask look like? Were there different features on them because of tasks achieved or anything?? Thank you!

Too bad the books doesn't explain anything about it but I thought about it as well. If I had to imagine I would say that the mask would carry a trait from the family from which the DE is decedent from or maybe even something about the DE personality will be shown as a painting on the mask. Just an idea because it was a left an eternal mystery.

What I have noticed about the masks, at least ones made for film production anyway that while they are all different most of them have the mouth area with a "stitched-shut" like effect. It's almost like a speak no evil thing I would theorise. Part of their code of silence in their dealings for their dark deeds under Voldemorts name I would assume. But their eyes are wide open. So they certainly like to see the evil occurring around them.

In OotP both film and book, Fudge was trying to make Harry guilty no matter what just to prevent more talks on Voldemort's return; turning the hearing into a criminal trial. The Anti-Werewolf Legislation was created by Umbridge, thinking of them as "half-breed" which she is prejudice against but their really "*FULL*" on both sides depending their forms (not counting animagus). The Anti-Werewolf Legislation was most likely repealed by Shacklebolt when he became minister.

@@olesuhr727 considering the muggles in fantastic beasts don’t have much trouble spotting magic if they’re actually looking and the girl that harry was flirting with at the train station in half blood prince (the movie) i’d say yes. i’m trying to think of any canon examples but the only thing i can think of is the muggles who saw the Ron’s dad’s flying car.

@Ole Hason Muggles don’t see all magic because as Stan Shunpike says they “don’t see nothing, don’t look properly” or something along those lines. So they don’t see wizards passing through platform 9 3/4 or the Knight bus, but see disappearing glass at the zoo, exploding trash cans at Mad Eye’s house, Weasleys flying car, Expandjng Aunt Marge, Floating Cake at the Dursley’s, etc.

I have never understood why veritaserum could not be used legally. If a suspect of a crime requested that they were telling the truth and wished that it be verified, then a tincture of the potion could be applied to gain the whole truth of the crime in question. Perhaps the fact that an antidote to veritaserum was known and available was the reason.

Veritaserum is like a polygraph; it is not failsafe, especially if the recipient knows they’re taking it.

Veritaserum, legilimens while unde rVeritaserum, Priori Incantattem and The Unbreakable Vow. There are so many ways to obtain the truth, not a single one was used on Sirius.

Truth is subjective literally. Sirius black for decades "knew" that Harry's parents were betrayed by Peter prettigrue, and that he was dead...up until a few days before the movie/book. Just because someone "knows" a true doesn't make it so. Slughorn literally had the truth of what info he gave out about horcruxes removed from his head. There's so many ways to circumvent the truth that a truth serum and or spell is about as useful as any other plot device that has multiple counters

Question, can a muggle stumble upon the wizarding world since it is technically still on earth such as a helicopter flying over? Also do world leaders know of the existence of the Wizarding World

This is explained in the books. If someone was flying over Hogwarts they would see just a broken ruined castle or some such and there are warding spells were if a Muggle got too close to an area they would immediately remember something important that they forgot and leave to go do it, etc. and some places have spells to be unmappable. And others have secret keeper places where muggles would not know of it but only wizards would. Etc.

@@nima6150 Correct, with the only country to actually have a more laxed take on the International Statute of Secrecy being the United States, this was mainly due to the repeal of Rappaport's Law in the 60s with a MACUSA rep officially stating when it was repeal "A Witch or Wizard can openly and freely form friendships and romantic relationships with Non-Majs and be allowed to reveal their true nature to their families and romantic partners and only to their families, and romantic partners along with approved use of magic in the presence of Non-Majs in situations where said Witch or Wizard has to defend himself or herself, and innocent Non-Majs from a magical threat, however afterwards said Witch or Wizard would have to go see his/her local Aurors Department and fill out a incident report stating that he/she was in a situation where he/she had no choice but to use magic in order to defend himself/herself and innocent Non-Majs in the area from the magical threat in question."

Given the Underage magic restriction, I'm curious about Hermione's line to Ron on the Hogwarts Express prior to their 1st year. "I've only tried a few simple spells, but they've all worked for me." Given what we know of Hermione, I imagine she read each of her school books cover to cover right after leaving Diagon Alley. It's reasonable to assume she then might have practiced some of the spells in the "Standard Book of Spells". How does this worK? We know it's not accidental magic as she demonstrates a spell on Harry's glasses. Further, what about students practicing during the summer holiday? Don't McGonagall and Flitwick allude to this somewhere? How about Harry using spells like "lumos" to read? This may have been only in the movie, but it did cause me to wonder if there are certain spells that are more permissible than others, though I would imagine any spell has the potential to reveal the Wizarding World to muggles.

On the point of Hermione practicing before the first school year, I have personally always assumed that the Trace is placed on young witches and wizards when they first arrive at their magical school, whichever it ends up being. If that weren't the case, I don't really know of any other unifying moment that they all go through that would distinguish someone to be "old enough to get the Trace".

@@Molotover if the trace wasn't on them until they arrived at school, how then would the owl find Harry to deliver his admission letter? Better yet, how would Hagrid find Harry after the Dursley's tried to relocate and hide from the owls? Same as for how Dumbledore found Tom Riddle in the orphanage and knew he'd been using magic already.

@@Deezy_Ankh I of course don't have set in stone anwsers, but owls seem to also know how to locate adult witches and wizards just fine, so I don't really think they use the trace to function. For how Hagrid and Dumbledore know of the kids locations, the Hogwarts founders enchanted the Quill of Acceptance and Book of Admittance to keep track of every child showing any signs of magical abilities, and deem them accepted to the school, so I would imagine it also provides the details for where the invitation letter would have to be sent. As to wether this particular magic is based on the trace, no one is permitted in the tower with the book and quill since no one in modern times knows how it works, and besides, the ministry was formed a good bit after the founding of Hogwarts, so I doubt they are directly the same thing, but might be similar.

When Harry was put on trial for it, the big key was that he performed the magic in the presence of a Muggle. So his lumos spells when he was alone, or Hermione's practice presumably in Diagon Alley or even on the train would not have violated the law since there were no Muggles present.

1. I don't think it is illegal to use it before starting at Hogwarts. 2. They migth be talking about the homework that does NOT include spells. 3. The lumos thing was just in the movies, they made it up and you would be prosecuted for that probably.

It's odd that the US has such strict regulations on registration of wands but in the UK it seems like the right of every wizard to keep and bear wands, shall not be infringed.

7:20 Our view of goblins is too limited to judge the law as unjust. In the little we have seen war with goblins has been long and bloody. Goblins have shown a propensity for cruelty and control of magic that when combined with wands may have been quite adequate reasons to forbid goblin access. From again the limited view it appears that the goblin wars stopped about the same time they were forbidden wands. Remember too, goblins are not men; most of them would consider it an insult to be treated as peers to men. They think and reason in a distinct and alien manner and you can not judge from our current view point the law to be just or unjust.

Wizard guidelines. There is a spell that causes people to forget also a bird that does the same thing also do they have magick sensing eyes or is it a more science approach to magic?

I feel that the wand use law should be removed when goblins share their magic tech. I see no reason why house Elfs should not be allowed to carry wands.

The biggest issue I have with a lot of these laws are that the defendant has to prove innocence as opposed to the prosecution proving guilt.

How does Hogsmeade exist? Like how do they keep a whole city for witches and wizards secret? How does the statue in Godrick’s Hollow work? How does the statue know that there’s a wizard looking at it? Can a squib see it? An underage wizard or witch that lives there as a muggle, but doesn’t know yet that they are a witch or wizard?

I wonder what the punishment for using the Imperius curse to get someone who was action paralyzed in a disaster to safety would be. I mean, on one hand it's one of the Unforgivable Curses. On the other, it was used explicitly to save a life.

It can't be used like that as you have to give the commands unless your sitting with them every day you might as well just do the thing and the curse needs a working body if your paralysed your Nevers are damaged the spell wouldn't even work in said body part as it doesn't control you it makes you loose all responsibility and frees your mind making you obey any command from the caster

I wonder if Hagrid created blast ended screwts by flauting the law of creating new creatures like that (they don't seem to be a creature listed in Newt's Fantastic Beasts book). If so, it seems the Ministry of Magic wasn't too bothered by it, as they used some of them in the Third Task.

Hermione mentioned a law that gave the Ministry of magic a window of 30 days to withhold inheritance in order to investigate its use and origin, ie the deluminator that Dumbledore left Ron Weasley in his will.

I believe the law on Werewolf conduct and registry is a modern version of the trials that werewolves had to go through in the Puritan period. Which is curious, as the witches and wizards received such treatment at the hands of Muggles. So you'd think they'd have a closer relationship, not a segregated one.

Pretty sure goblins would immediately declare war on humanity if they actually all got ahold of wands. Wands give humans only a slight advantage over the other magical hominids when well trained in it's use. A goblin just picking up a wand would pose a challenge for several skilled wizards at once. I don't think goblins have ever shown any care for humans at any point in the lore, and active disdain throughout most of their history. If I'm not mistaken, muggle weapons were more effective against them until wands and staves were developed, Elves are a bit less vindictive and even with wands wouldnt pose much of a threat to humans. They wouldn't have much interest in gaining power through training in any case, so they're an afterthought in the legislation. At worst, a cruel master gets their comeuppance. They already have excellent magic control and channeling it through a stick will be little more than an inconvenience for them. I can hear the conversation now, "What would Kreacher do with a wand, sir? Shall I clean it?" - "I want you to use it" - "For what sir?" - "Magic!" - "Kreacher can already do magic, sir" - "This will make it stronger" - "Oh, it must be very heavy if Kreacher's magic cannot lift it." Then there are the other magical creatures nobody considers. Centaurs also aren't allowed to have wands, but like elves have little interest in them. Giants could use a staff as a wand, but probably couldn't learn the discipline. Acromantula could probably make use of them too, there's a terrifying thought. What I find curious is why people only ever advocate for the one race who looks enviously at the wands to be given the wands. I'm the first person I've ever seen bring up the centaurs. That might just be anecdotal, but it's always goblins. Don't forget, it's Hagrid that first tells us their nature, and he looks for the good in all magical creatures. Anyone gonna try tell me Hagrid is a goblin racist? There's an uneasy peace between goblin and wizard kind in the hogwarts universe, and it's not being maintained by the goblins. It's a good job it's fiction because clueless do-gooders would accidentally cause the enslavement of all mankind to forever make wands for our diminutive overlords.

I guess why Rappaport's law is present. (It's pury my theory) There are 11 main schools (smaller ones aren't important), and they're gathering muggle-raised students from the territories where conflicting muggle groups live(judging by that Harry Potter school mapping) Meanwhile, pureblood mages are all pureblood mages, with no inside-group discrimination. If non-purebloods were that united, they would be impossible to control and discriminate. But when "lower castes" aren't united, this way, since school, everyone is "at own place": 1. United pureblood human houses 2. [sunni vs shiite vs israelite] vs halfbloods 3. Beings (even more various and with own psychology and magic systems) 4. Beasts (some of which are sentient, but for various reasons, disregarded) In USA, problematic existence of "Untermensh" was solved the other way, that didn't involve slavery or genocide: by complete isolation. It got especially important when ppl have grown more united there, unlike middle east school Durmstrang have done other way: mudbloods are allowed in schools only as lab rats for darker magic. If I'm right, the indian/chinese 11th school must be either 1. Totalitarian to the non-purebloods, like outright genocide and/or slavery 2. Have no centralized school, being kind of third-world magic community with primitive education and no valuable artifacts 3. Both

Some of these laws just suck in my opinion Like the Animagus Registry, and the dueling ban, like smh come on Failing to register as an animagus and going to Azkaban for it just seem a bit harsh isn’t it? And why try to ban dueling, it could be a fun pass time, and be a potential sport..why try to get rid of it?

One important aspect of Wizarding law that wasn’t mentioned was patent, trademark, and copyright law. Without these, there is no real incentive for research and invention.

Actually that’s probably giving her too much credit, she just didn’t care about the implications, because to include topics and mirrors to real life like that, you must first respect and understand that, then cover that within your series. You don’t create a world like that, just to tell a fun story that involves none of those themes what so ever. You can’t have a universe like that, then just ignore those topics.

@@rubydragon1034 I don’t hate Harry Potter, I enjoy the universe and stories that have been told. I also never said they had be tolkien levels, nowhere near that, way to blow things out of proportion. It’s a pretty simple thing to understand, if you make a universe with complex social issues, you can’t just ignore them. Simple as that. It’s not my fault the author of the series is a horrible person irl, and is stupid when it comes to this element of world building. Bold assumptions you’ve made, all of which were wrong, if you assumed less, you’d be a lot smarter as well.

Idk If any cannon Harry Potter content exists about this idea, but once the muggles gain advanced technology and weapons that can potentially substitute for magic what are the wizard worlds opinion on this? How do they feel knowing that while they have magic , muggles have nucular weapons and radiation , hypersonic jets , the internet , ability to perform space exploration, fully automatic machine guns, smart phones and other incredible advanced yet compact devices, Bluetooth , virtual reality , and so many others that make magic (or at least most of the common spells ) look like a joke ? Do they feel threatened ? Would they try to advance magics evolution to keep even footing ? Would they think it’s a new dangerous type of magic and try to regulate it with obvious failure ?Or would they simply just not understand what any of it was and brush it of ? I don’t remember the exact movie details perfectly but I do remember a wizard in muggle studies (I think it was Ron’s dad) asking Harry what the purpose of a rubber duck was🤨 I’m certain I’m completely wrong and I apologize if I am but if I am right like seriously … it’s bad enough that wizard or not your still human , your not THAT detached from muggles , but somone specializing in MUGGLE STUDIES!? Makes me think they are in for a while mess with there horrific lack of understanding

Probably reasonable in the point of 'Is this a low-risk QOL spell? If so, it can be used if you can be sure not to expose yourself. Is this spell one with more noticeable effects? If so, no.'

Personally if I had the ability, I would cancel the law prohibit Elves and Goblins from caring a wand. Because by allowing them to have a wand it would have created a bond of trust which was so important especially with Goblins. Now the dueling law I can understand- They probably don't want it to be unsupervised and witches and wizards will act like it's the wild west and start to kill each other in the streets. Dueling competitions is a thing. Now as for the unforgivable curses, I wonder if a wizard or a witch will be forgiven for using them in a case of life risking situation or a higher goal. For example- Harry had to use the Impirius curse for breaking into Gringots bank for getting the cup horcrux. He had no choice otherwise the mission would have failed, but he did no damage with it only what's necessary. He had Travers under his control a prized DE and he didn't command him to kill himself, he ordered him to hide while he controlled a Goblin to get to the vault and open it. As for the status of secrecy I can understand that because of the time period. Think about the obsession of Salazar Slytherin not to accept Muggle Born students it made sense in a way duo to the period in which he lived. He saw witches and wizards being slaughtered by Muggles so it wasn't for no reason, Salazar Slytherin wasn't a bad person he just saw things in a single way.

The trial was so stupid. "underage magic". It was a patronus charm, not like he was trying crazy potentially harmful magic. He does worse things to his family with his magic when he was much younger and that's no problem.

I think the Crups law needs to go. In this day and age of scientific understanding pertaining to genetics and mutation, a fork-tailed dog wouldn't be especially noteworthy. There are mutations producing two-headed snakes, extra fingers, webbed fingers, and tails in humans, and other oddities. There's no need to clip the tail of a crups when it can be passed off as a genetic anomaly. Yet another reason the wizarding world needs to keep up with muggle science and social progress.

So why would you expel an underage Wizard or which from performing Magic or even going to school whenever the trace breaks at 17 when they just go and perform unchecked magic that they they could do because they're no longer bound by those rules and then government didn't teach them correctly so now they're doing bad Magic

They're still bound by the rules. It's just that now if they use magic illegally or violate the statute of secrecy then the Ministry will come down on them. I image they will either be sent to Azkaban or have their memories wiped about the magic and the wizarding world.

Many laws are bad ideas, just like in the real world. Imagine if there was a law that said you're not allowed to do math outside of school, if you're under 17. And of course, the law gets violated all the time without consequence - and not just by accident, such as the vanishing glass, or Aunt Marge. Hermione's "oculus reparo", and Harry's "lumos maxima", etc., and all the various uses of magical items outside of school.
