Jurisprudence on the Dissolution of Party Lists proved in Court to be affiliated with the CPP/NPA. (IN AID OF LEGISLATION). I. Introduction Jurisprudence, as the science of law, seeks to interpret and apply laws equitably to uphold justice and social order. In the Philippines, the evolution of land reform policies and the establishment of mechanisms to represent marginalized sectors have addressed the core grievances historically championed by the Communist Party of the Philippines/New People’s Army (CPP/NPA). This legal philosophy explores the rationale for the dissolution of party lists proved in Court to be affiliated with the CPP/NPA within the bounds of constitutionalism, agrarian reform, and political representation. II. Agrarian Reform as a Fulfillment of Core Grievances The primary impetus for the establishment of the CPP/NPA was the systemic inequity in land ownership and the resultant poverty among Filipino farmers. Landlords monopolized vast tracts of agricultural land, leaving tenant farmers in perpetual destitution. This dynamic created fertile ground for insurgency and justified the CPP/NPA’s armed struggle for land reform and social justice. President Corazon Aquino’s administration marked a turning point in addressing agrarian injustice through the Comprehensive Agrarian Reform Program (CARP). CARP sought to redistribute land to tenant farmers, empowering them economically and politically. By institutionalizing land reform, the government not only addressed the root cause of rural insurgency but also rendered the revolutionary aims of the CPP/NPA redundant. With CARP's legal foundation under Republic Act No. 6657, the state demonstrated its commitment to rectify agrarian disparities within the framework of the Constitution. III. Political Representation of Marginalized Sectors The 1987 Philippine Constitution institutionalized mechanisms to ensure the political representation of marginalized sectors. The Party-list System Act (Republic Act No. 7941) mandates the participation of underrepresented groups in legislative processes, aligning with the democratic ideal of inclusive governance. This legal avenue offers marginalized communities, including farmers and laborers, a peaceful and constitutional means to advocate for their interests, further diminishing the need for insurgent groups. The Commission on Elections (COMELEC) holds the duty to evaluate and approve party-list organizations that genuinely represent marginalized sectors. This responsibility safeguards the integrity of the party-list system by preventing groups with extraconstitutional agendas from exploiting democratic processes. The presence of party-list representatives from peasant, labor, and indigenous sectors underscores the efficacy of legal and peaceful political engagement in addressing systemic issues. IV. Jurisprudential Basis for Dissolution The CPP/NPA’s continued existence poses a direct contradiction to the spirit of the Constitution, which upholds peace, social justice, and the rule of law. Under the Doctrine of Redundancy in Law, when the legislative or executive branches enact measures that fulfill the objectives of a revolutionary movement, the movement's continued existence becomes legally untenable. The CPP/NPA’s revolutionary objectives have been substantially addressed through land reform programs and political representation mechanisms. Furthermore, the Revised Penal Code (RPC) classifies rebellion as a crime against public order. When the underlying grievances motivating rebellion are resolved through constitutional means, the continuation of rebellion constitutes a criminal act devoid of just cause. Jurisprudence affirms that rebellion cannot persist as a legitimate response when democratic institutions provide avenues for redress and reform. V. COMELEC’s Role in Upholding Constitutional Integrity COMELEC bears the constitutional mandate to ensure that party-list representations align with the national interest and the spirit of the Constitution. The Commission must exercise vigilance in disqualifying groups that, while purporting to represent marginalized sectors, undermine the stability of the Republic. By refusing accreditation to party-list organizations affiliated with or sympathetic to the CPP/NPA, COMELEC upholds the legal philosophy that democratic processes, rather than armed struggle, are the appropriate channels for societal change. VI. Conclusion The dissolution of party lists affiliated with the CPP/NPA aligns with the principles of jurisprudence, which advocate for the equitable application of law and the preservation of public order. With agrarian reform and political representation addressing the core grievances that once fueled insurgency, the legal foundation for the CPP/NPA’s existence has eroded. COMELEC’s proactive role in preserving the integrity of the party-list system ensures that the aspirations of the marginalized are addressed within the ambit of the Constitution, rendering extralegal movements obsolete. The continued existence of the CPP/NPA, therefore, constitutes an anomaly that undermines the democratic ideals enshrined in Philippine law.
