Dr. Sally Smith testified for the defense in a $220 million case against Johns Hopkins All Children’s Hospital that was the premise for the Netflix documentary ‘Take Care of Maya.’
Dr. Smith worked for All Children’s Hospital, before it was acquired by Johns Hopkins, for 12 years and also worked with the Child Protection Team in Pinellas County.
Witness testimony continued today in a $200 million lawsuit against Johns Hopkins All Children’s Hospital that was featured in the Netflix documentary ‘Take Care of Maya’. In 2016, at just 10 years old, Maya Kowalski was admitted to Johns Hopkins All Children's Hospital for severe pain and was removed from the custody of her parents after staff accused them of "medical abuse." Her mother, Beata Kowalski, hung herself in her garage on Jan. 7, 2016, after going months without seeing her due to the medical abuse allegations, according to the family's attorney, Greg Anderson.

She has a God complex. It is a trait seen by many doctors. They are the overachievers that have always won. So, there is no room for doubt. That blind spot is a chink in Doctor Sally’s armor here.

She put an innocent dad in jail for 8 months because of her reports. The man was thankfully found completely innocent but the fact that he spent 8 months in jail… This lady is a monster.

I dont understand where the monster part is. She sounds very knowledgeable and I would absolutely want her on my team. Not all neurologist or anesthesiologist are worth their tuition they paid.

@@bancatorres2455 context matters. Crps is the worst pain where life no longer seems worth living. Crps has the highest suicide rate among all pain syndromes. So yes they will go to extremes. That doesn’t disregard the fact that the prosecutor was only looking to take maya and did not care for her circumstance.

@@theghost4282 Let's say she didn't have CRPS, and someone was poisoning her. Which actually matches the symptoms better than the current studies on CRPS. Let's say she was poised to death. Then everyone would be saying this woman didn't work hard enough. She was out to protect the child. The current symptoms did not match the textbook diagnosis. The saddest and most tragic part is that most illness that have anything to do with neurology no longer match textbook definitions after COVID. (much like my Chiari, which I almost committed suicide this last weekend because of the pain). It took me 10 neurosurgeons to finally find one that will do my neurosurgery for the exact same reason. This is such a tragic story, but I would throw the blame on science and the lack of neuro understanding that we have. And about the Mom... Sorry when you are a mom and have a sick child you dont get permission to commit suicide. That was the worst move her mother could have made. That is sickening to me... Coming from a sick person that wishes, i had a mom to hold me while I cry because nothing helps the pain and the burning pain in my hands and arms at times that comes with Chiari another issue most neurologists dont know about but should.

@@bancatorres2455 the issue is she didn’t even acknowledge the other side and brought it before a judge. She presented a one sided hit piece. If you believe in your diagnoses over the objection of other docs you note it and explain why. You do not completely dismiss it and not even mention it to the judge with whom is deciding about removing the child from the parents. If this “investigator” believed, with your diagnoses, that you were faking the pain, she testified she would have no problem going to court and having you arrested because “it’s not her job” to bring evidence to the contrary of her opinion. You have all the medical records, all of the doctors opinion and because she didn’t believe you none of that matters. There is no blame on science, there is blame on the close minded god complex “investigator” named Sally smith whom refuses to look at different perspectives like what nearly every science requires. “Science fails because humans run it”

@@amineantion I am a board certified physician specializing in obstetrics and gynecology. I have represented many families trying to understand the care their loved ones are receiving. “Informed consent” use to be a legal requirement in medicine most physicians and hospitals respected.

Dont worry, its a Viral Case, so many People know this Creature by now, she will have a hard time showing her face in public again, let alone be still allowed to perform as a doctor or expert anywhere anymore since her licenses got terminated a 100% after all the damage she caused out of her grotesque personality.

oh my goodness that’s a big deal. I can’t imagine the streets just done with the defense and their witnesses because they are cruel. it’s an awful place an awful place and it shouldn’t even hospital save lives. They were killing Mýa little by little she was dying and then her mom ends up dying in the way she was treated was so in humane that prisoners didn’t get treated like that because anyone being treated this way would cry if not kill their selves sadly, especially with this added on disorder she wants her mother and she’ll never see your mother again it’s so awful

@@WarriorWomann have you watched the trial? Those specialists you speak of are anesthesiologists who are using large infusions of ketamine in a non fda approved way on a 9 year old. A TON of ketamine. Much like the quack they sent her to for the 5 day coma in Mexico. Did you read mom’s emails and all the issues while she was in that coma? Aspiration, breathing issues, blood pressure problems, bad nightmares. Who would subject their child to that? That specialist you also speak of, when realizing his extensive ketamine infusions were causing Maya issues sent her to JH’s..JH’s saved Maya from those crazed buy here pay here anesthesiologists gone mad. That’s how I know. Any questions? Think logically. JH is the #1 children’s hospital in Fl this year. They have professionals working there saving true sick kids with cancer/burns who are dying. Shame on this family for causing their daughters issues and Maya has psychological issues herself but then suing the hospital. Shame for running Smith, a 30 year pediatrician child abuse expert and DCF for protecting this child. Clearly mom had mental issues cause who hangs thenselves in a garage? And then blame a hospital for the cockamamie things you’re doing to your own child? Hang herself for her son to find. JH, Tampa General, and other providers were right about it all. 200 million? These cases are tragic. There are never happy outcomes. Those ketamine doses, high dose narcotics, and the ketamine coma are absolutely inappropriate treatment of pediatric pain disorders. The story has all the hallmarks of munchausen by proxy - doctor shopping, RN mother, mysterious symptoms indiagnosable by multiple experts until the parent finds a quack doc willing to lean into the disorder and provide “care” that somehow fulfills the abusers need for medical attention. I would 100% raise a case like this to the child abuse experts in my hospital and CPS - especially when the abuser proved resistant to actual evidence based care. It was 100% appropriate of JHACH to change those treatments for Maya. While we don’t have their side of the story, it is almost certain that Maya was treated by a competent non-quack pediatric pain management team including appropriate PT/OT and psychiatry/ psychology while hospitalized. That hospital is a good pediatric hospital. This would be standard of care and has been the case for similar pain patients at all three children’s hospitals I’ve worked at. Honestly, the video footage of maya while hospitalized, while cherry picked to show Maya in bed, manages to show that she gets her legs into position which require at least 4/5 strength: the footage of her hanging off a walker by her knees, diving into a pool from her knees suggests fairly normal leg strength. I’m sure the producers didn’t realize this when picking the footage. As for “ the ketamine worked” …. Yeah …. Just about everything gets better on massive doses of ketamine.

The audacity to double down on the stand in this trial when she opted to settle her part so she was no longer named in the lawsuit. If this is how she felt she shouldn’t have settled, but she settled out of the spotlight and now here with all the attention on her, she says she was 100% right. What a piece of work.

It makes you wonder how some of these people get these jobs and why they're not people making sure people hired in medical facilities are actually qualified to do their jobs. I know every different job in the medical field requires board exams and different things they must do every so often to remain qualified and licensed. But I think in some cases it's not enough especially when you have people like this lady working out there

I saw a doctor reacting to the documentary and he said that it took 9 months of research and knowing a patient before he concluded the diagnosis. He said 10 minutes of meeting with a child with no other proof is not how it works. He does not practice in the states though

She’s been Mia-diagnosing child abuse in other cases, as reported in “Take Care of Maya”. The difference in this case is that the Kowalski’s fought back. Other families did not have the monetary resources to take her to court. She’s scary because she honestly thinks her opinion is superior than others. She’s evil and shouldn’t be near innocent children.

At the very least, have someone who looks at the evidence objectively - is obligated by (HINT FL, fix the law) to consider and report all sides. Not just say “I disagree with the treatment and therefore the docs prescribing it are not “credible” and therefore I can disregard their opinions.

Only a pediatric clinical neuropsychologist is trained to assess and evaluate a child for conversion disorder. I've not heard any mention of Maya seeing a professional qualified to make this diagnosis. In 33 years as a psychotherapist every doctor and therapist I've worked with has always refered patients suspected of having conversion disorder to a neuropsychologist for evaluation. None of my colleagues have ever diagnosed a patient without a neuropsychologists evaluation . Never once. This so called doctor is awful on every level. Shame shame.

If you watch the documentary, you learned that this hospital has a repeated history of what they did to Maya to other children and their parents and all of them had the same situation because of this woman. It was even advised by locals to not take their children to that hospital, and even other doctors were advising this to parents, because they were aware of her and her constant cry for a wolf and ruining families.

There are MANY MANY MANY more that could not reach out... a year ago there was a news article put out about her, and if I am correct, people were trying to get a massive lawsuit against her, but a lot of the people who took a case plan to work to get their child back, in the paperwork it states that by accepting this case plan, you cannot go after the hospital or Dr's on the case... so those people get screwed out of justice... and when you are dealing with family court, logic and reasoning stops, they don't need actual proof they just need a "well it could or could've happened" and you lose your child

Why didn’t they prosecute the physicians who diagnosed CRPS and gave high doses of meds if it’s child abuse. They are the ones who actually did it. It’s clear they wanted to punish Beata for being pushy and “difficult”. And Smith was willing to help them out. Maya was a bright expressive smart girl with loving relations in her family. What signs of abuse did she have on her?? Or emotionally?? Such BS.

Regarding Dr. Sally Smith testimony. This is a disgrace. Don't make excuses for yourself and say that was "not my responsibility." If you only tell part of the story that is a lie of omission. Tell the whole truth. It is clear to me that the staff handling this case conspired against Maya and her whole family. Give some people a little power and it goes to their head. Why would a hospital who has treated hundreds of thousands of kids and a pediatrician/medical investigator who has literally saved the lives of almost 4000 children from medical abuse not to mention the lives she's saved just as a pediatrician treating sick babies & children just up and decide to "have it out" for the Kowalskis. This is a perfect example of how terrible Healthcare is. As someone with a rare diagnosis, i can tell you this is how they treat you and it's disgusting. It happens more than you think. She needs to lose her license ignoring her diagnosis and pushing her own beliefs. If you have a chronic illness you are basically left without much help and fighting "drs" that try to label it as in your head. It needs to change badly.

I have a chronic disability as well. I can say that the health care system is horrible. I have also worked in healthcare and saw the discrimination/injustices. I've been laughed at, told my pain wasn't that bad and openly mocked at like I had Mental Retardation during routine physical exams. For the most part, people are looking for empathetic Dr that can refer PT and measures to maintain or improve ability functioning.

If you can find a good Acupuncturist, give it a try. They are more wellness oriented, rather than sickness oriented and it's been around since 2500 BC. Earlier methods utilized sharpened stones and long sharp bones around 6000 BCE. It has helped me tremendously. The Acupuncture history is very interesting. I also find it telling that the insurance companies do not include Acupuncture in their "Health" plans, LMAO! Godspeed!

You know your body and if something is wrong. It was so many years for me before I got diagnosed and even still I deal with that from ignorant drs who can't do a simple search to learn about diagnosis they don't understand. This dr person had an office in the hospital, acted like an attending physician, would come around like a hospital doctor BUT SHES WORKING FOR THE STATE! I am a Fraud Examiner and I looked into these cases in other states with these so-called specialized child abuse doctors, and I’m seeing a trend of this type of woman in these positions… I personally know of at least one case where are the father was charged criminally and his and was forced to Plead guilty, even though he was innocent innocent

As a fellow CRPS sufferer (it was called RSD at the time I was diagnosed..they’ve since changed the name but it’s the same dark beast) this entire case breaks my heart. When I was diagnosed it was barely understood by only a handful of physicians I came across, and we’ve come a long way since I was first diagnosed, but we’re still not nearly far enough in education regarding this horrible affliction. I hope this case will keep this topic in the limelight and that great strides will be made toward treatment and protecting those who have CRPS as well as the families who care for them diligently. I’m so very glad to know that this family has won their case against Johns Hopkins and this doctor.

How the HELL is she carrying around medical records she “printed out”? As far as I know and for 18 years, every year, i took a class about protected medical information and how it is handled. THIS is NOT how it s handled. If she wanted to walk around with someone’s record she probably needed to hired an attorney to represent her not over step and do what she wanted to do, how she wanted to do it. I have CRPS...i was diagnosed 13 years ago and physicians just like this are the reason why it goes undiagnosed for YEARS before receiving proper treatment. She is every CRPS patients' nightmare.

As a pediatric nurse in Tampa bay I can tell you this is not how we are supposed to treat patients and families. In nursing school we are taught to take the patients pain rating as they tell it, not what we think their pain is. I take my patients here all the time. This hospital accuses every family of child abuse. Medical professionals I work with have taken their children to the ER there and were accused over a simple curling iron burn that the child pulled down on himself among MANY OTHERS. NOT TO MENTION CATHI BEDYS FORMER ARREST FOR CHILD ABUSE WAY BEFORE EVER WORKING AT JHAC!!! This is not about the family getting money or whatever half of you think. This is about calling attention to a serious problem among healthcare professionals at this hospital and everywhere. Mothers of patients I care for are AFRAID to take their child there due to unfounded claims way before this case and the documentary. I want to go downtown and stand outside of the doors and protest but that wouldn’t be fair to the current patients now would it? The entire system failed this family. CPS DCF nurses doctors everyone whos only job was to protect. There is no way JH is winning this case.

You are correct. I am a retired nurse, pain is part of the 5 VITAL SIGNS THAT EVERY PATIENT MUST BE ASSESSED ON. PAIN IS DIFFERENT IN EACH PERSON. WE ARE NOT SUPPOSE TO USE OUR OWN BELIEFS AS A OPTION IN CONTROLLING A PATIENTS PAIN. THIS DOCTOR HAD ALREADY DECIDED SHE WAS GOING TO ACCUSE THEM OF CHILD ABUSE. I FEEL HORRIBLY FOR THIS FAMILY. This doctor is going to hopefully lose her license to practice medicine anywhere in the USA on children or adults. She is not a real professional doctor.

Clearly you don't understand how an investigation into child abuse or neglect works. Her job is not to "weigh up" evidence or look for things to negate the concerns of the medical staff etc. She either finds evidence of medical abuse or she doesn't. Giving credit to the parents is a job for the parents lawyers in a family court. Sally Smith's job is to do an independent medical evaluation and report the findings.. It's not even her who decides if DCF will follow through to requesting a court order. Her role is not with DCF or the hospital. She is from a seperate entity. It's not rocket science.

He also had Runkle of the Bailey on, a criminal defense lawyer and both said that what she did was not right. So it appears that you don’t know. Her job is to “weigh up” evidence for either child abuse or not. I suggest you go watch his recap last night so you can be informed correctly. Rob is a family lawyer and is very aware of this process.

This woman is a beast. I would be terrified if she was to “investigate” anyone I know or care about because she is very close minded, it’s HER opinion and nothing can or will change that. She is not the type of person that should ever be medical director for child abuse investigations, because she does in with the opinion that they automatically are guilty. An intern is still a student and usually has not graduated. The internship is an academic requirement for program completion and graduation. A license would only be accessible if all requirements have been met.

With doctors they are licenced doctors and then interns. So I assume that's the case here. She was presumably a licenced clinical social care worker on an internship at the place of work. Often licenced people are hired on an internship for a period of time before being offered a full time position. Its so they can pay less for you than if you were just hired straight up. They are them on a provisional licence basically. You can Google it.

She can’t see past her ego! She makes things fit her own narrative. She did this to countless other families! Maya’s family sued her individually and she settled out of court because she knows she’s guilty as hell. In the Netflix documentary, a mother sent her a Christmas card every year to show she didn’t successfully tear apart her family for claiming child abuse. The dr wrote back one year admitting she MAY HAVE seen things in the wrong light. SHE IS A DISGRACE AND SHOULD GET HER MEDICAL LICENSE STRIPPED.

This is scary. Is she getting paid per child that she refers to child services? What would be her resson for behaving like this? Who then was the family supposed to turn to for an unbiased investigation? She is basically saying that her job is to find any evidence of child abuse, ignoring whatever else may come. Maya being possibly misdiagnosed is not child abuse. We like to believe that if we're innocent, we'd be proven so. Parents have spent time in jail because of this woman. No objectivity.

The more I listen to this case, the more I think this is a systematic issue. If one person can be given that much power and there is essentially nothing the family can do to dispute it as child abuse investigators can pick and choose their information, this will continue happening. I'm sure she has helped a lot of people during her career but I'm sure she has destroyed just as many lives.

The arrogancy is so strong there! I get doctors can be arrogant but she kinda takes it above a notch. It's like she thinks she's the smartest person in the room and the smartest person in medicine and child protection laws... I'm glad the jury didn't agree with it. Sadly, with tort law and the caps in FL the appellate court can reduce greatly the monetary judgement. It would be awesome the other families she's harmed that they as well bring her to justice and maybe enough would cause her to be unemployed and possibly to have a few records of discipline on her license and then revoked.

As someone who’s father has been diagnosed with narcissistic personality disorder (is a diagnosed narcissist) and as someone who has a whole host of (mostly rare) health issues, including CRPS (what Maya has) I am highly suspicious that this woman is a narcissist. She reminds me of my dad so much, and especially as a child with CRPS (so obviously I know what it’s like to be a child with this condition and who knows how doctors can be when it comes to all rare conditions but specifically this one) she is a classic example of a narcissist who was given too much power and someone died because of it. The way she believes that she is the smartest person in the room, she must be right even though she is not trained in this, that even though this child has a diagnosis of this disease and was diagnosed by a specialist in this disease but that doesn’t matter because she knows better than a specialist, that she continues to insist that she was never wrong despite there being concrete evidence that she was, etc. are all signs of a classic narcissist. My dad is the same way. He knows best. He, as an engineer who designs guns (that’s his specialty) insisted that he knew more about building a house than anyone else, so much so that he ended up firing everyone else who he hired to build our house because he didn’t think that they knew better than him (despite it being their job, he was insistent that he knew more, and he didn’t, by the way, there were lots of problems with the house lol) He will never, ever, EVER admit that he was wrong even if there is concrete evidence that he was because he can’t be wrong. Everything is always about him and because he thinks this it must be true even if there is concrete evidence that it isn’t it must be because he thinks it is. She is a narcissist, I have no doubt about it, and she should be locked up. The way she (and everyone else, but specifically her) treated this child is absolutely horrendous and makes me physically sick. Like I said, I am a kid who has many (rare) medical issues, including crps, but I also have gastroparesis, immunodeficiency, POTS and dysautonomia, mast cell activation syndrome (MCAS) ehlers Danlos syndrome, and more, this case makes me absolutely sick. I was also wrongfully diagnosed with FND (what this woman often refers to as conversion disorder, the old name for it) and funny enough the person/people who wrongfully diagnosed me with it were the people at a pediatric pain rehabilitation center (PPRC) and the PPRC I went to is actually the program that the program they wanted to send her to was based off of (if that makes sense) I was diagnosed with this condition with zero testing (which, by the way, this diagnosis is a diagnosis of exclusion. It’s diagnosed when they have done every test, when they have ruled out every physical cause, that’s when this diagnosis can be made, just thought I should add that piece of information). In the end, I went to a program for this disorder, it did nothing, the pt and ot there immediately noticed that I had obvious neurological abnormalities (klonis) that CANNOT be caused by conversion disorder and my mom was advised to seek a second opinion. We did, we went to another FND specialist (who this program recommended) and he immediately asked what tests I had done. When we said none, he was shocked. Upon simple neurological examination, he was like “you have obvious neurological abnormalities, how did they diagnose you with this without any tests when you have obvious neurological abnormalities?” Me and my mom were both blindsided. Fast forward a few months, i saw multiple different doctors (including neurologists and FND specialists) and every single one of them agreed that this was NOT conversion disorder. When I went back to the PPRC for my follow up, we learned that I did in fact have these neurological abnormalities when I was there, but that they werent “significant enough” to mean anything, so they never mentioned them. Keep in mind, I was given a psychological diagnosis by these people. A diagnosis that makes treatment for everything else much harder as now everything is blamed on this psychological disorder. They refuse to take this diagnosis off of my chart (despite agreeing with the other doctors that further tests are necessary) even though 5 neurologists, 3 FND specialists, 2 orthopedics, 3 physical therapists, 2 occupational therapists, and everyone else have all stated that this is in no way shape or form functional neurological disorder and that this is most definitely some sort of (rare) neurological condition that they simply haven’t diagnosed yet. The person who diagnosed me is not an FND specialist, they are not an FND treatment center, but they refuse to admit that they were wrong and that I don’t have FND despite everyone else (including multiple experts in FND) saying that I don’t have it. Everyone believes I have dystonia and another rare condition that we don’t know what it is yet. Just because you don’t know what’s wrong doesn’t mean it’s psychological! This entire case is absolutely sick and it makes me physically sick! This woman especially needs to be held accountable and locked up! She is evil and needs to be held accountable for what she did!

This is a wider issue. How can there be child abuse when parents choose one diagnosis/treatment plan over another just because the investigators/ other medical providers disagree? It should not be child abuse for parents to follow the advice of licensed and practicing physicians, which is what happened in this case.

It was considered medical abuse because of what Maya was exposed to, not because one treatment was chosen over another. . She was being given large amounts of drugs other than ketamine (as if it wasn't bad enough she got 10 times an adult dose for sedation) These drugs included benzos, opiates, sedatives, dilaudid, huge amounts of magnesium, steroids and more, all at the same time. Some of these drugs are hard core narcotics. This tiny 10yr old had cholesterol of 370? She was malnourished, her immune system was severely compromised and at no stage did Beata stop any doctor and ask them what these drugs were potentially doing to her or ask for lab evidence to reassure her they were doing the best for her. What parent just sits there and agrees to pump their little girl full of dangerous drugs and not question the treatment or the doctor? I would question a simple prescription for antibiotics and make sure my child needed them. Most parents are at that end of the scale. This was one of the biggest red flags.

The ketamine was not legal to be administered, in the US, the way Maya first received it, down in MEXICO! The doc that recommended it, sent her to Mexico. There was a reason hospital docs in the US would not do this. End of... Instead of badgering this hospital's staff, they should have discharged their daughter and taken her back to Mexico. I believe the reason they didn't, is because it would have cost them THOUSANDS OF DOLLARS, out of pocket. They seemed to wish to avoid that, and tried using their insurance coverage here in the US while attempting to "force" the docs to do what Maya received in Mexico. Let that sink in.

Despite this being another doctors Diagnosis and Had been prescribing the Medication, had contacted the Doctors and made it a abundantly clear she had CRPS and HE PRESCRIBED THE DOSAGE.. THATS CHILD ABUSE? Could you imagine being that little girl ?! Living in a Hospital for 3 months witb little to zero contact with her parents..She had to have been terrified

Well, she still thinks that she is right and that Mya never had CRPS. She still contends that this was Munchausen's by Proxy. You do know that Mya recovered do you not? You do know that she never got another drop of Ketamine after this hospital put a stop to it and she still recovered? 2016 was the last Ketamine she ever got and she recovered without it. Obviously, she didn't need it. That doesn't bode well for CRPS now does it?

This was a proffer so the jury was not in the room, It’s to help the judge decide which things are relevant and can go in front of the jury, I didn’t watch the whole trial so I’m not sure how much of this line of questioning actually got to be asked with the jury present

⁠@@dekulrunothe judge has already decided what is relevant at the pre trial hearing. In California Motions in limine are filed 10 days before trial. Jury was present during Dr Smith’s testimony. This is a civil trial. The only time a witness does not testify in front of a jury is during an arbitration hearing. I have been a legal assistant since 1998 and have assisted in many trials. I am currently working on a case that is set for trial for 12/16/24. Pretrial conference is set for 12/6/24. We received the judge’s pre trial order a few days ago.

Considering they were awarded over $60 million against dr. Smith alone as a family I’m betting somebody is going to be going after her too. I honestly hope now that the civil case is done they go for criminal now and push for it. They have the momentum and I’m sure they are weighing options now.

I honestly don't see the difference. How can you determine thst someone is abused from their injury (i.e. physical), mentsl and/or emotional state without asking (i.e. investigating!) the reason(s) for the things observed?

To all the people supporting this woman in any way...she did not do her job correctly, period. She is still very arrogant. The jury is not stupid. Because of this woman's so called claims and findings, the mother wasn't allowed to even hug her daughter in the courtroom which caused her to break down and die by suicide only after which was her daughter's custody given back to her family. This case is very heartbreaking. Maya was being treated with ketamine before and she did improve and was able to lead a better quality of life. I really hope that if you support this woman, you get to experience every single thing the family had to go through because of HER lapse in judgement.
