So the fake gun gets you in trouble… IF you use it in commission of a crime. I’d say the fake gun isn’t really the problem, then.

Not in all areas. I can have a G19 on my hip, 100% legal in Philly but I can't order an Airsoft or BB gun G19 and train with it in Philly. I can't even have it shipped to my house. I know plenty of people who run MilSim for fun and green gas pistol to practice at home. It's actually a crime to have an airsoft or bb gun in the city. If you're training and not actually doing something stupid it's largely unenforced in the city. NJ having ANY BB gun even unloaded on your person in the woods, in your vehicle enroute or even at home but don't have an NJ FOID card it's a crime and treated the same as a firearm. Discharge in most counties is treated as discharge of a firearm. Airsoft and paintball is good to go though. So absolutely even an unloaded, replica of a real firearm can get you charged. I work in NJ in the Tactical Medical training area and we use airsoft and BB not to fire projectiles but to use for searches and air feedback. Never loaded with anything and I have to keep blue painted, bb guns locked in my Pelican case like it's an actual gun. I was not aware of this and a cop at a class was like "Hey, I wouldn't care on a stop. But NJ State Police is notorious for things like arresting people for these type of things. Do you have a lock box or Pelican case that locks? Might want to put that in there driving home. You have PA plates and already are a target for NJSP so just letting you know" I've kept it locked up ever since.

Either tried in court, or talked into a plea deal. Once convicted, the deal is sealed. The sentence is temporary (unless sentenced to life or death), the conviction is permanent, unless you eventually have it expunged or are pardoned. My late Dad owned several firearms when he passed away one of which was a handgun. In this city there was a handgun registry you were required to comply with to stay legal. My family and I could not locate the card we were required to maintain to prove compliance with the law. As the only member of my family who owned firearms I had to bring the handgun to the local police for a replacement firearms registry card with my Dad's death certificate to prove my legal standing to receive a duplicate handgun registration card. It was not a big deal whatsoever.

So one of these scenarios is of concern to me right now. I purchased an AR-15 pistol lower from PSA. I've had it for a few weeks. I just ordered an 8.5 inch 300 blackout upper for it that should be here tomorrow. I'm just worried that I am missing something that I need to do before I can just slap that upper on. Is there anything that identifies my lower as a pistol other than the fact that it has a brace instead of a stock? I'm not aware of it being registered anywhere. Am I good or do I need to be worried? I know any advice wouldn't hold legal weight but just curious what others thoughts are

You could call your local gun store and tell them what you have and exactly what you plan to do with it. They should know the laws that apply. Best of luck.

You are good to go. Keep it a pistol, caliber doesn't matter, and you're right with the law. If still in doubt a call to a local gun store MAY get you correct information but it may not. Whoever happens to answer your call MAY be the most knowledgeable person there OR they could be the new guy who thinks it's better to make stuff up than say, "I don't know, let me ask the boss". If you want the most rock solid answer to any legal question you have about your state's laws, the ONLY person you ask is Your state's Attorney General. An employee or intern will answer the phone, they will write down your question and contact information, when able they will research the current law books and when they believe they have found the answer they'll run it by the boss and if they agree you'll get a call with the answer to your question. An answer you can trust without question. Be sure to take notes with date, time, to whom you spoke, when they called back the code section, sub section and anything else worthy of documenting.

@@renaissanceman7145 Good advice, but better yet - have the AG's office mail or email you the reply so that you can have a hard copy of it. @@andrewdobbs7000 If they're willing to do that, I agree, that would be the best option. However, you know how govt offices are, they often require payment for anything physical. For example, why do we have to pay "court costs" when taxes already fund the courts? If no one asked a court for anything for an entire fiscal year, everyone working there would still get paid, the electricity would remain on and every printer would still be full of paper and ink, right? Sorry for the rant, too often things don't operate as they should.

If I may add to the part where you said that by Federal law you have to be 21 to buy a handgun, that's not the case for the state of Montana. To buy a handgun in Montana you have to be at least 18, have been born in Montana or have resided in Montana for 6 months, have a photo I.D., and pass a background check which normally only takes maybe at most 30 minutes. No license is required to carry openly or concealed, but really it depends on the local and state laws.

If a relative who has died, and who you have inheritance rights from, owns any NFA item that is not in trust, YOU FILL OUT A FORM 5. You do not pay the tax stamp, a Form 5 has no fee attached. You simply change the registration of those items from them to you.

At 17:15ish, you said you can buy the stock for your AR type pistol without the tax stamp and you're fine. Not quite, merely possessing a stock and an AR pistol together can be construed as "Constructive Possession" if F-troop and/or the local DA want to. So if you have an AR pistol and you want to SBR it, get your paperwork in order before buying the stock just to be safe.

I’m not sure if I misunderstood you or if you made a mistake, to my knowledge any state that passes constitutional carry anyone can carry in that state, concealed or open without having a concealed weapons permit, whether you’re from that state or any other state visiting that state, correct me if I’m wrong, but I think I’m right
@carlosettineri8309
@carlosettineri8309 2 ай бұрын
It depends on the state, some of the "Constitutional carry" states are actually permit-less carry, which could mean that residents of the state don't need a permit, but nonresidents need to get a nonresident permit, if the state offers that, or have a permit from a state which has reciprocity with that state. As always, the best thing to do is to do your research for any states you will be visiting to confirm if they are true constitutional carry states or ones with permit-less carry. Ignorance of the particulars of carry in a state you visit will not protect you from the possibility of being prosecuted for violations committed because you didn't know.
