Sly of them to bring this is CA, which has some of the strongest consumer protection laws in the market. Get closer to Asia and further from France and they will find the juries they need to make their case. Petitions can be amended, but they are still running up hill both ways. I’ll be interested to follow this one, especially since so many are rooting against it. As a litigation attorney (though not in CA and not in Federal court) one knows never to underestimate their opponent. Plaintiffs don’t need to have to be a smoking gun, as whether the claims are sound or rebuttable is not the issue - it’s whether they fit within the confines of the law as it exists, and linked selling is illegal.

Interestingly Birkin & Kelly never been sold online! Of Course those gameplay exist but I chose not be part of but randomly walked in- being at the right place at the right time never get old. 😊

I think this lawsuit is one of the most frivolous I have ever heard. It would be impossible to prove that Hermès has an official policy regarding sales of these bags. You know I am an Hermès lover who is NOT on a “journey”. I’ve never been interested in a Birkin or a Kelly. However, I have noticed that no bags have been on display in the boutiques recently, and if I have gone in to buy other items, my SA has asked if I want a bag. “Bag” meaning any bag, because although they aren’t on display, the boutique does have a supply of many styles. Whether this is because people only care about getting a bag or for security reasons is unclear. However, I have never once been told that I needed to purchase anything before buying any bag. I was never encouraged to build a sales history or to buy from other categories. If someone chooses to play “the game”, that’s on them. No one guarantees a winner when you play.

Oops! 😬 I also thought to myself that maybe now is the time to go into store and ask for a quota bag while H is feeling particularly defensive about these accusations. I hear that in Paris it’s where the game is played most often. It seems like different stores do different things. They obviously don’t have a protocol for this type of behavior. Hermez needs to stay on top of management and make sure that all stores do the same thingand make sure all stores have the same criteria for purchasing a bag. It it’s their fault for being a little sloppy on oversight.

That’s not true when you say it’s hard to prove the predatory and commission structure of her MS. All they have to do is depose some sales associates, and under oath ask them if this commission structure is true. That would be very easy to prove. Also I’m sure a ton of people would come forward to testify that they have been in similar positions where they were forced to buy other items from Hermez in order to get the Birkin bag. It happens every day around the world. Very easy to prove. All you need to go is on KZbin and look at some of the videos of people that it has happened too. Hermez knows that they do it, it’s no secret anymore. It’s hard to prove if it’s illegal. One interesting thing is that it never says in the papers that you read that what they are doing is discriminatory. I think it’s very discriminatory to make some people buy other products before they buy the handbag and others not. That’s not fair. So yes, they do discriminate against some people. They need to have a blanket protocol that says either you have to buy items before you buy handbag, or you don’t. It should not be left up to the sales associates. There should be a policy. Either you let everybody buy a handbag or you make everybody buy something before you can buy a handbag.it’s pretty simple. Just be fair.

I can kinda see why this is a case. It’s hard to fight bc of all the KZbin videos that talk about having pre-spend. I would like one but I’m only a fan of the bags . So are other people lying when they say they have a pre-spend. lol i mean you can’t buy them and a few others online.

Almost sounds like they’re just trying to get publicity for the plaintiffs and/or lawyers out of a lawsuit… and it’s already making so many headlines!! And wow, if the prosecuting lawyers are this sloppy, they definitely don’t stand a chance against Hermes‘s top notch lawyers 🤣 be careful, they might try to hire you on as an expert consultant for the prosecution! 🤣 Also just wanted to say that I was skipping over most videos on this subject because of the inflated drama likely surrounding a lot of these videos for click bait, but when I saw that you had posted one, I knew that it was going to be thoughtful and as unbiased as an H lover could possibly be! 🧡🍊

Awww thank you for the kind comment! 🥰 I always try to be as factual and fair 🤓 as I can be and even though I love the H brand, I definitely wanted to give the plaintiffs a chance, so I went straight to the case itself. I do think people are feeling real pain about this, which is why they may be bringing the lawsuit, so in the end I think it really comes down to emotions than unlawful behavior. I think everything in that law suit is absolutely right. I hope they pay for this. Also your intentionally misleading everyone. I have seen so many videos from shoppers and influencers who have talked about Hermès sales practices. Also, they will win but likely settle out of court 🙄. Also, you're clearly biased, the courts can't ask a biased person to be on jury duty. Also your ideas about what can and can't happen in courts are lacking in a big way.
