Something to be aware of is that the statement from Kjersti Flaa is only in there because after the article came out she reached out to them to say that she wasn't involved. They didn't fact check with her before they printed the article.

I always appreciate your ability to keep an open mind! I know which side I tend to be on at this time but I am very open to changing that position as more comes out. Setting aside the way she marketed the movie, BL using her husband as her representative in that meeting was probably the worst move she made. It's a really, really bizarre choice to use your husband in that capacity from the outside looking in. It comes across as a power play instead of a legitimate attempt to resolve problems on set. And if there is truth behind some of the more bizarre behaviors alleged, regardless of his intentions, at the very least JB needs to have some serious training about appropriate social boundaries.

I think both of your points are fair. I tried not to harp on RR too much primarily because I know how much I dislike him. May have gone too far in the other direction.

I love your analytical approach to these sensational cases. I sometimes feel like I am the only person in the world that did not follow the AH case. I avoided that trial because it would be too upsetting for me to hear the DV parts, or on the flip side, it would enrage me that someone was falsely accused. I am so glad that you are approaching your health recovery journey in such a pragmatic way. We need your calm voice in the LawTube universe!

I was that it was a PR move just because complaints are usually private and are only released if the complainant choses to do so. Also people have commented that it is unusual that the article isn't behind a paywall and includes a link to the complaint.

Looking forward to part two. I think there was a PR problem for Blake because of her horrible public persona. Her interviews were egregious. She used the movie for self promotion and business promotion. It came across badly sand tone deaf. Justin knew it was coming and kept records. I think the PR battle is more important than the legalities m.

I know that you aren't up to this part yet, Lively filed in New York in federal court. That is giving vibes of she doesn't want the public to know what is actually happening, that they will have to rely on news reports seeing as she chose a court that doesn't televise.

she literally couldn't file in CA and many of the litigants own homes in New York including Lively. I think if she filed in CA it would just get joined with the employment action. AND... who could blame her if she doesn't want the circus? You could make the same argument that Baldoni sued the New york times in ca specifically to create a media circus because his actual case is so weak.

She wanted the publicity because she is using it to improve her image that she herself tarnished by being completely tone deaf. I love this coverage but honestly to me both aren’t possible, the only possible thing on Blake’s side is sexual misconduct but even there “Falsus in uno, falsus in omnibus”. I think we’ve caught Blake in lies or exaggerations and so far have not caught Justin in any so objectively one should lean his way. Not saying he’s right but I’m leaning that way

I like your level-headed approach) a lot of people are painting the pr as diabolic but to me it seems that's what they do in their work and people shouldn't be surprised. I'd really like to see your analysis of Baldoni's lawsuit. I'm not familiar with US harassment laws so it would be interesting to see what is legitimately a problem and what is blown out of proportion .

1:48:10 as someone in the movie marketing space, this silly floral themed campaign sounds exactly like something an agency would come up with. Also "focus on the good not the bad" is the default on all movie campaigns. I can see how for THIS movie it might come across as tone deaf. But it's an extension of why you will see trailers for musicals that don't feature any songs - studios want to focus on what sells, not what makes sense for the film.

I'm missed hangouts and headlines and didnt' get notification in time to watch live. To me this thing has become so much a he said she said issue and really want to see the receipts and the validity of those receipts. there are conflicting stories about them entering her space while she was nude or breastfeeding and so I have to wonder if she did give permission once but they decided it was an open invitation? Personally as a male I would not feel comfortable entering an actor or actresses dressing room while they weere nude. Not because I'm a prude but because I think it would be awkward do I look do I not, is my facial expressions being misinterpretted? Safer to just not be in that scenario. Did a smear campaign happen? I don't know but if it was discussed and put on paper it may mean someone went forward even if not authorized and I do remember the bad press BL got. This will be an interesting case to watch if it goes to trial.

Johnny Depp (as much as I like him) and Amber Heard are waaaaaay less "celebrity" than Blake Lively and Ryan Reynolds. Just one metric: on Insta, they have almost 10x more followers. Another metric can be money: They make more like 20x Johnny did. Not saying it's fair, just keeping comparisons honest.

I think Box Office is still a better measure of popularity (celebrity) than followers. I’m not saying they are nothing. Just that Depp had decades of folks who knew him when that trial happened.

@HoegLaw Johnny is from another generation, and yes, he has decades of good work that made him known (and loved), but Reynolds Deadpool and Lively's GG made them known from a whole new generation that not necessarily know who Depp is (sadly)... to use audience as metric you have to input streaming services as well as cinema. Today a Johnny Depp movie puts a lot of people in the cinemas, but a Ryan Reynolds all but garantee theaters sold out.

I can understand some of her list of demands….she had had a baby and needed to protect herself from contact that might expose her to germs/viruses that could take home to her children. Also she (and every person) does have a right to privacy. In regard to the press junket, I’d see 1 video of her response to a woman reporter that made me not want to see ANYTHING w Ms Lively in it. I get that she and her female friend were probably getting tired of fluff questions like her costumes that men were not getting asked. They made their point in first sentence which could have been said in a better way than going on for several minutes, humiliating the young reporter. All it did was prove Ms Lively was very classless (at least in that moment)and should have stayed home. Damaged her own reputation.
