You can request the hospital to provide duplicate copy of birth certificate. And also request to issue copy of discharge certificate.

Sir, my father died on 8 may 2021 at District hospital, Basti( Uttar Pradesh). Hospital gave me death certificate mentioning 2 lines about cause of death. But, insurance company asking me to submit Medical cause of death(form no.4) and death summary. But hospital refused me to give medical cause of death certificate (form no.4) and death summery, since last six month. Hospital's medical superintendent is saying we only provide death not afore mentioned documents. Sir, plz tell me, what can be done now?

Dr has to keep indoor medical records for 3 years as per medical ethics regulation. If one demands records within 3 yrs then dr is legally obliged to give the records. After 3 years, if dr has record available with him then he can give and if not available he will say records not available as dr is not responsible to keep records after 3 years.

Law nowhere says that hospital can not take charges for record maintenance.. Law only mandates that cause of death certificate shall be issued free of cost. For other records no guidelines. Hence, at present the hospitals can charge a reasonable amount for the administrative purposes including photocopying the documents.

Actually for legal purposes birth certificate issued by registrar of births and deaths is required. Birth certificate are also issued by hospital authority like medical superintendent or CMO.. but, you also need to collect certificate from registrar.

If available with the hospital, then only you can get. It is not mandatory for the doctors to keep IPD records beyond 3 years. However, some hospital, do preserve the record beyond 3 yrs.
