There needs to be severe repercussions for the employer for lying to unemployment. There always seems to be a law to stop the worker from gaining unemployment. “You texted in sick instead of calling in sick” when there aren’t people constantly manning the phones. “You left early on your shift numerous times” when there was 1 incident that I actually had permission from the owner to do. “You were too short with a customer” when I never dealt with customers. Sick of being denied for no reason. They have too much fine print nowadays in every aspect of employment that they’ll get the win in court, not to mention paid lawyers that make more money if they win in court all whilst the average employee can’t afford such a luxury.

Thing about the "witness" is the fear of that witness losing their job, if they are a current employee, they won't do it due to "retaliation". If you have a witness make sure they have another job lined up, because if they don't, corporate will fabricate a story to get rid of that witness

And that employee should sue too. They should get an attorney to write a letter to that employer reminding them that it is absolutely illegal to retaliate. A lot of attorneys will take cases on a contingency fee basis.

One thing she could have asked the employer is if he had provided the signed document stating she received the handbook!!! Remember, it is up to the employer to prove whatever it is they are saying. He specifically stated she signed a document and attempted to use that against her. Always take advantage of when a judge asks if you have any questions for the other side. Sometimes doing that will help them hang their selves and less stress on you.

This is a breakdown of the case and the outcome if it was a real hearing: Based on the information presented the claimant was discharge for a third tardy after receiving one written warning. The claimant’s prior warnings she made an attempt to contact the employer to notify them of her being late and presented a valid reason why she was late due to caring for a sick child. Typical tardiness of less than 10 minutes shows that the claimant was making a valid attempt to arrive to work on time as scheduled. The employer chose not to excuse any type of tardiness regardless of the reason. The final tardiness was also due to reasons outside the claimants control and the claimant showed a legitimate effort to arrive to work on as scheduled and was only a few minutes late again. The claimant had only received one prior warning which unemployment would view as an isolated incident and it was for a compelling reason. The final tardy was also for a compelling reason. If the claimant had received 3 prior warnings for tardiness that were within the claimants control and was discharged at that time it would result in a finding of misconduct and the claimant would have been disqualified for benefits. In this case the claimant was not discharged due to reasons of misconduct and the employer did not establish a willing disregard of the employer’s interests and the tardiness was not within the claimant’s control. State unemployment criteria needs a complete overhaul. All the states use the same unjust criteria. The new criteria needs to be the following in general; The state looks back from the time the worker first started working in the teenage years. They look at how many months the employee, employer, or self employed person has been working since that time. Then they look at how many months the worker has collected unemployment since he or she began working. The criteria needs to be approximately 15 per-cent of the months spent working, the citizen gets to collect that many months in unemployment compensation. Example, 100 months accrued working, 15 months accrued unemployment compensation. It ought to be paying an average salary of what the worker was making at all the previous jobs or all the previous jobs in the last 10 years. Whether the citizen was fired or quit the job has no bearing on eligibility of collecting. Please contact your U.S. or State Congressman for a bill in Congress to change the criteria for unemployment collection. All the states are generally the same, so maybe Federal legislation would be better, thank you.

I am an HR professionalnof 15 years and have participated in over 100 of these hearings as both an employer and an employee. This is not a usual case. Most companies will not fire an employee if the reason for the last absence or late arrival was generally outside of the employees control and if the employee at least offered supporting documents or evidence. This video was a good example the hearing procedure itself, but most cases that go to hearing are more complicated than this one.

Trucking is a shady industry. It's not an average job, so you really have no witnesses and the company can abuse you by denying you to get home and they know what they're doing when they do that to us. They try to get us to quit by making our lives miserable on the road and strand us for days without pay saying there just simply wasn't a load for us to deliver just to cover their ass

My denial letter said they denied me unemployment because I was discharged for absenteeism. But I wasn’t actually discharged i resigned due to health/family issues. My manager and the lady from Human Resources saw me write out and sign the paper saying I resigned due to health issues. Now I did miss a lot of days for my health issues but I have 90% of all the doctors notes from where I missed. They wrote me up 2 weeks before and on 4/14-4/15 my aunt died so I missed that Monday. Tuesday 4/16 is when they gave me the option of resigning or being terminated. I resigned due to health issues. So on my unemployment denial they said I couldn’t get it because I was discharged for absenteeism. Now since i wasn't discharged and resigned do you think I have a case just on that? Not to mention I resigned due to good cause and I have all my paper work from numerous doctors.

Thank you for this video. I am pending an appeal hearing on Monday after being denied unemployment benefits. Not only did the owner and gm come in with covid symptoms, they were not transparent. Over a 1/4 were sick by the time they told us about 1 case. They also had me shipping hazardous freight with falsified documents to cali by rail. Flash point between 70 - 90 degrees 😳 ides denied me originally because although the company misproperly handled covid, I should have done more to help them. What a joke. How do you continue to help a company that continously disregards safety? One employee had already given it to his young niece twice. Wish me luck!

@@kaytos4497 It really depends on the circumstance. For me, apparently my claim was not sufficient enough to receive benefits anymore. They wanted me to pay back what I got from the employer's benefits insurance (% of what the employer paid me for benefits). I appealed this and they found that I was still unable to receive benefits because I guess technically I quit when you really look at it. I appealed again to the higher court and they found that I once again was not eligible however, the employer because of the way they have their unemployment benefits insurance, they were not eligible for payback from me. Thus I did not receive anymore benefits, however, I didn't have to pay back the "Overpayment". They still send me invoices for the overpayment though, so I'm gonna have to see what they're doing over there and if I truly don't have to pay. Dealing with unemployment has been the best and worst experience of my professional life.

@@kaytos4497 Perfect! That actually sounds like you can win that. Just make sure you send them in with enough time for them to receive and process the transcripts as evidence. I guess also send screenshots as supporting evidence for your transcripts just in case they give you crap. Cover all of your bases and have a clear and concise testimony and you should be good. My case is very close to this max p. Only difference is my employer works off a point system. My points were pretty much exhausted due to the birth of my pre-mature child in which I ended up getting a disciplinary day off with no pay. I was told any other infractions could lead to me being terminated. Never did I think being 4 minutes late due to no fault of my own(that I can prove) would lead to me being terminated. My immediate supervisor was not in town and HR did the deed...do I have a case.

Question so I got denied on my unemployment because the employer said I quit when they terminated me and then ask me to resign as it was better for him when I was 13 weeks preggo he stated his terminated me due to me focus on my health and that from stress in my life I was making errors I was never gave warning or signed any paperwork’s. they actually told me I was doing great. So then they told edd I resigned which I gave no letter they terminated me and told them I made tons of errors I was never told about and gave them documents which I never saw. Sounds very similar to my case. I am very dumb that I signed paperwork that stated I was being terminated due to poor performance but in person kept assuring that it was due to covid related slow down. I just signed because it was really upsetting to 1. being let go in general is always upsetting. 2. my employer started to cry ... ?? because she never let anyone go. 3. they were lying to my face and it was clear they just wanted me to sign the paperwork. and i did because i am too agreeable when it comes to employee/employer relationships.
