There are all kinds of ways that your case could be settled. It depends on what state you live in. To get the best answer to your questions, talk with a mediator or lawyer in your state. They will be able to assess your chances of succeeding with your goals best. Also, remaining in the house and being permitted to keep all of the equity are not the same thing. Please think about which of these you mean before you hire anyone to help you. Also, the constant cheating will probably not get you a lot. If you stay with a person after they have cheated, the courts often view that as "condoning" the cheater's activities. Not fair, I know, what pretty much how it goes. Best of luck to you.

I am not a mortgage lender, and I cannot give legal advice on this platform, but having a co-borrower on a refinance loan, in order to qualify for a new mortgage, is a solution that some of my divorce mediation clients have done in similar situations. It worked for them. Before you do that, however, you will want to inquire as to whether the mortgage is assumable (if that was not already done). With an assumption, the interest rate will not change, but your name would come off the loan. It is a little different process, and also requires qualification, but it is certainly worth looking into. Thank you, too for saying my information is "fantastic". Your spouse can always sign a quit claim deed relinquishing his or her ownership rights to real estate. This would be true even if the mortgage loan was in his or her name. The lien is attached to the real estate (not to a person or couple). No matter who owns the home, if the mortgage bill is not paid, the loan company will snatch the house. It will be important that you have the quit claim deed prepare and filed by an attorney who understands how to properly file that quit claim deed with the county in which you live. Also, that attorney should look carefully at your divorce documents to be sure you are in compliance with the court order. In my experience, it is usually clear on the face of the divorce documents what is to happen next. For example, all of my settlement agreements state with crystal clarity that one spouse must sign a quit claim deed (in a case like yours) and it also states a deadline for that signing.

Mortgages are attached to the real estate. This is true whether it is a VA loan or a regular loan. If your husband signs a quit claim deed, giving you full ownership of the house, he will still remain liable on the VA loan. Also, you always want to check with the lender. They may not allow a deed transfer until the loan is paid off.

That is a very important question. You will need to talk with an attorney or mediator in your state who knows all the rights questions to ask as they relate to your particular situation with that house. You will need to be very careful. Sometimes, just adding a name is not enough to guarantee you rights. Also, your description of your husband makes me skeptical that you should do anything that involves real estate and signing documents, etc. without the assistance of someone who knows the divorce laws in your state in case your marriage ends up going down the tubes.

In most states, whether an asset is on the table for division, in a divorce situation, is related to when the asset was acquired. If it was acquired during the marriage (and before separation in some states), that asset belongs to the marriage and is on the table for division. If all or a portion of the equity was paid down using non-marital funds (which does NOT include your income, but might be from money earned pre-marriage, inherited money, money received as gift), that portion will belong only to the spouse who made those non-marital payments. It is not about whose name is on an asset. However, in my state (and others, I am sure), a judge could not order an asset that is only in one spouse's name to be sold. But, the judge could order that the person whose name is on the deed to pay the other person their equity share.

Sorry. I do not know Ohio law and cannot answer your question. Probably, however, all of those mortgage payments that you paid during the marriage will be considered marital contributions. Not your individual contributions. Your argument will probably be that you made a greater contribution to the marital estate. BUt, that is not the same as saying that it is YOUR money. Money earned during the marriage usually belongs to the marriage ... but that does not necessary mean that everything must be divided in 50/50 (except for a handful of states).

Mediators can never advise. They can provide information. If you are in Virginia, give me a call: 571-220-1998. If you are not in Virginia, I suggest you call a lawyer or mediator in your area. Please also keep this in mind: working your butt off does not count for as much you think it should. The strongest factor that gets considered when you get divorced is when was the asset acquired. If it was acquired during the marriage, you can count on something close to a 50/50 split, even if you did all the work. Maybe a little better for you; but not usually enough to justify the attorney's fees.

Going through this right now. No matter what you did for her and your family, she is entitled to half the value of the house as well as all of your assets regardless. You will have to buy her out at half of what the current value comes in at, and most likely alimony on top of that. That's if she doesn't put up a fight for it. If you have young children together, can change it as well. If you try to keep the peace with her through this process, it may be your best chance. The laws are totally driven to screw the guy over. Do your best to remain calm and civil through this. It will definitely help you in the long run. Stay strong! Never get married again without a prenup!

That all depends on the law of your state. In Virginia, where I practice mediation, it is fairly easy to pull non-marital money, which was used as the down payment on a marital residence, out of the equity of that house. You will need to check with the law of your state to determine whether your commingling of non-marital with marital assets has "transmuted" (a legal term) your non-marital money into becoming part of the marital estate.

Question!!! My ex husband was living in the marital home for five years after our divorce. I won the house in court and was ordered to pay him 20K in equity. I sent my lawyer the 20K for him to pick up but he must first sign the quitclaim deed with my lawyer in order to pick up the check. He refuses to pick up the 20K check because he doesnt want me and our two children living in the same city as he does. He told the judge that he still lives in the home but he is actually remarried and living with his new wife in her home. What recourse do I have to make him "move" out of the home or to get him out so that me and my children can move in, since the house was awarded to me?

If there is a court order granting you the marital residence, you need your attorney to enforce that order. Often this is done with a contempt of court petition (often called a “rule to show cause”). I have a feeling there is something more complex in your situation, though, as the facts do not quite add up. Your husband’s motivation and/or desire to keep the home would be irrelevant to a judge after he or she ordered him out of the home. You need to get crystal clear on what the court documents say (by having your attorney - the one that is holding the $20,000 - explain to you what the problem is.

She has no answers and does not know how to answer that question. For some reason, my ex feels as if he can keep a few items in the home then the judge will not put him out. Do you know if this is true? I'm headed to court in the next two weeks because my lawyer has filed a motion for him to sign the quitclaim.

Once the judge saw the divorce decree, he stated that my ex was only entitled to receive $20K in equity of the home. My ex was living in the home at the time and for the last five years. Nothing else was done during that court date. My ex claimed to the judge that he still lives there, in hopes that the judge won't put him out. Anyway.. 5 months later, I sent my lawyer the $20K and my ex and his lawyer refuse to acknowledge the money or anything. He won't pick up the money or sign a quitclaim. My lawyer tried to call his lawyer but won't return phone calls. I need to move into the home ASAP. Can the judge make him leave my home?

If you are just trying to figure out how to get your case settled, you should call a mediator. These professionals will have their own way of doing things. (1) Use cash from a savings or investment account. That is easiest. (2) Borrow money at zero/low interest rate from a family member. This has a lot of drawbacks, but can work nicely for some people. (3) Do a cash-out refinance. This will be expensive, though. You will paying at the new interest rate and your mortgage will be bigger (because it includes the spouse's buy-out). (4) Pay in periodic distributions. This kind of feels like alimony. It is an agreed amount every month/every quarter/every year until paid off. It can be with or without interest. (5) Trade for retirement assets. You can do this, but you need to understand that retirement money is usually pre-tax and real estate equity is often tax free. That means that your retirement assets are worth less than the equity (because you have to pay taxes upon their removal from the retirement account -- even if you are old).

No answer exists, because it's extremely rare: What if neither party wishes to sell the home? I think the answer is, and what the judge would say is, then you'll have to be divorced but live under the same roof. Only IF one party wants to move out can the judge force a buyout or sale.

A lot of this will depend on the laws in your State. You will also need to be clear on where the money came from for the down payment. If it can be proven that that money came from your pre-marital earnings/savings, you will have a better chance at retaining that portion of the equity (the amount of the down payment, not usually the closing costs). If that money came from income earned during the marriage, that will be a much tougher road. The adultery might play a part in your husband receiving less of the marital estate; but usually that doesn't count for a whole lot (except in terms of the attorney fees trying to show a judge that the adultery came out of nowhere, versus it was an accident waiting to happen considering the marriage was already broken down -- don't get mad at me. I just report what I see!). The DV is a whole other level, though. I would never mediate with a couple where there was DV. You need an attorney and the legal system/police to protect you. You cannot sit in a room with a violent person, say what you need to say in the mediation, and expect to be safe upon returning home. Get a lawyer. Good luck.

If you were in my office for a mediation, I would have many questions before I could even begin to answer that question. The laws are different in all states. Even if you were in my home state (Virginia), though, I would still need a lot more information before we could determine the classification of that house (marital property, your wife's separate property, or hybrid property (some of each).

What if the house is paid for and we have very small children. This is our case, I want to keep the house wich is is my half. The reason for divorce is lack of communication even though we speak the same language, my husband don’t really talk to me only when he wants to and we have two kids under 3, he bought the a paid for house months after we got married, he is a great dad and loves his kids but I feel very lonely and neglected. I am sure many people read your post and consider it petty to get a divorce over lack of communication and feeling lonely as this happens in so many marriages. I recognized that this is not the usual communication and loneliness issue. I truly understand your pain as I lived it for decades. It was as if I was single and invisible. He would always promise to work on himself and us but after a week or 2 he would fall back into silence and extreme avoidance. I stayed to keep the kids in a 2 family home and then some years as he kept promising to change. After decades of giving it all I had and getting nothing in return One day he just announce he has no interest and has not had any interest for years. My dear get out while you are young. It will destroy you and your children.

In your situation, you would need to determine if your spouse is claiming all or a portion of the equity in your home as his separate (non-marital) property. If he is, that would make your negotiations more complicated, but you could do it. You and your spouse would need to agree on what percentage of the house belongs to the marriage and what percentage belongs to him alone. Then, you could do a buy-out of your spouse's agreed share of the equity with a home equity line of credit (HELOC) or you could source the money other places (loan from family member, savings). Sorry you are lonely. Many people are. I hope you find your peace soon.

If the house is free and clear (no mortgage or lines of credit against it) and the divorcing parties both refuse to move, a judge will settle the dispute. Either one of you will be forced to move or, more likely, there will be a forced sale of the marital residence. In Virginia, there can only be a forced sale if the house is deeded in both parties names.

@@GraineMediation I think you are not correct. No one can be forced to move out of their property. In fact, divorced people can live together. It is possible one party may claim abuse and the courts could rule against the defendant, and so he would be kicked out of the home for a while and have to move into an apartment or elsewhere. But even in this case, he could keep his half of the home. Indeed, he could force the party living in the home to pay rent, or he could rent out his half of the home.

In some instances you can simply have the other person's name removed from the mortgage loan. It is called an "assumption". Check with your lender to see if this is available. Otherwise, you will need to go through a full re-finance, which means that you will pay the current interest rate. It is so hard on people these days. I understand.

Hello. I’m curious, in either scenario where the spouse staying in the home with the kids, how would they pay the other spouse their portion of the equity that would be theirs? I am a stay at home mom. I would really like to stay in the home, but cannot qualify for a loan yet. My husband really would like to sell the house so he can have his portion of the money, however moving for me would be very problematic. First, we have two boys that really need their stability (one has an anxiety disorder and the other was adopted out of foster care). Also, I have not worked in 8 years and my name is only on the title if the house not on the loan, so getting approval from even an apartment will be difficult. Lastly, our mortgage here is way less than most rentals 1/3 the size of our home. It would be a terribly stupid financial move. I do not want my husband to struggle. What would you suggest?

Usually, when one of the spouse's wants his money, the judge will order a sale of that house. You can buy time, though, with arguments about best interest of the children (staying in the home). We make these types of arrangements a lot at my mediation firm. The unemployed or lesser employed spouse is able to stay in the house, as the children's primary custodian, for about 2 years (common time period) before the house either has to be sold or the parent in the house has to figure out a way to buy-out the other parent's share of the equity. There are a lot of details that need to be worked out (such as how the expenses will be paid and how the fair market value of the house will be determined for the buy-out). Hope that helps.

Hi, I really enjoyed this enfo but my house and property is paid for and my children are all grown. I haven't worked in years and I recently applied for disability. He draws full benefits from Ss Disability. He us abusive both verbally and physically and I'm going to file for divorce on grounds of inappropriate marital conduct. He's also been cheating on me. We bought our place after we'd been married for three years. My name isn't on the property but my name is on the double wide mobil home with a permanent foundation and we have three vehicles, several pricey antiques, and artifacts and tools . What can I do to get atleast half of everything

I have very serious doubts about the first time I hired *usespy online* to help get electronic evidence.
