Considering investment is being done in US, and their culture is that everyone is suing everyone, it's a good idea to protect yourself and personal assets, rather then saving few bucks in accounting cost.

Method #1 Individually purchasing: 1.1 Can you outline what good liability insurance should cover? 1.2 Do I need liability insurance in Canada and the US? 1.3 What are the go-to/most popular liability insurance companies? 2. Method#4 US LLP: 2.1 Is this still a good method if you are a Canadian Citizen working in the US? 2.2 Can you still hold an H1B or TN visa while having a US LLP and US C Corp? 2.3 Why do you need a US Corp ( instead of just an LLC or LLP?) 3. Do you have advise on obtaining a loan with a US LLP?

Thank you for your questions. 1. Third party liability insurance for landlords should cover injury claims made by tenants against landlords. I suggest at least $2M of coverage. 2. If you are investing in the US, then you need a US insurance policy. However, if you are investing in Canada, then you need a Canadian insurance policy. 3. Yes, a US Limited Partnership is a great method for Canadian residents to hold US real estate investments, even if you have a US work visa. 4. There has to be a General Partner, and so we appoint a US-C-Corporation to act as a General Partner of the partnership. This protects the investors from personal liability stemming from the partnership. 5. Generally speaking, you have to have made a down-payment of 20% of the purchase price before lenders will consider offering a mortgage for the property. I suggest that you contact lenders in the area where your property is located.

If you own multiple properties in the US, would you create: A. 1 US-LLP per property with 1 US-C-Corp as GP (For example, 10 properties w/ 10 US-LLPs and one common US-C-Corp GP) or B. 1 US-LLP + 1 US-C-Corp as GP per property? (For example, 10 properties w/ 10 US-LLPs and 10 separate US-C-Corps GP)

Limited Partners (Canadian individuals or Canadian corporations) of a US Limited Partnership can claim foreign tax credits in Canada for the American taxes they paid. The purpose of appointing a US C-corporation as a General Partner is to protect the limited partners from potential liabilities stemming from the partnership.

What if I just wanted to purchase for my personal pleasure but didn’t want to rent it? Would an LLP still be the best option? Moreover, how does capital gains taxation work? Would it be best to purchase the property outright or take a mortgage (I’ve been told my entire life that mortgage interest is tax deductible - is that available if it’s your only property in the US but not your primary residence/your home in Canada).
