So if I get married, we handle all bills in a joint account but keep our personal accounts, i save like crazy from my income, and she spends like crazy from her income ... i have to give half of my savings to her if we split? Does a prenup protect this?

Hello Siegel. I like your video and your explanation, yet, I am in doubt about the 'equalization" you said that "take a picture of the date of marriage and the date of separation. Does that count the time we lived together before marriage? Me and my husband lived together 2 years before the marriage. Marcia Schnarr, On-Canada

What if I am gifted a house from my family before the date of marriage. (deduction), but then the spouse lives in the home later on (we decide to move into the gifted house). i understand that becomes a matrimonial home now, but can a Marriage contract be made so she is still not able to claim any part of that gifted home to me? Like we live in it together but have a marriage contract that says it still does not belong to her and she is aware of that? Thank you, useful video!

He basically said yes when he was discussing a house you owned prior to marriage. If you both lived in it, it is considered the "matrimonial home". It seems to me "she" is entitled to half of the matrimonial home or its value thereof.

@@sm-bd1bz In such a case it's not the "matrimonial home". From what I understand, if you don't bring it into the relationship, it is not "common property". Since I kept my inheritance separate from our joint assets, she couldn't touch it. This lawyer calls this an "exclusion".

The problems occur when you allow the gov't into your private life. There should be no common-law "marriage". Either you soberly decide to marry or you don't. Just because you choose to share a house/bed with someone is not the same as signing a contract. The gov't has imposed itself into someone else's living arrangements. Words to the wise; no marrying, shacking up, or L.T.R.'s., and definitely don't get involved with someone with kids. You will be on the hook and considered a party to a "contract" and you could lose half your stuff if "she" goes south.

If you don’t like Ontario Family Law, you should live in another jurisdiction. There, you will discover the laws in place for divorce provide you and your ex with roughly the same. No one wins at divorce. The best to be hoped for is that both parties walk away, equally disappointed with their new station in life.

The government wants nothing to do with your private life. The laws of our jurisdiction have been in place since 1783 and everyone within it is subject to them, whether they like it or not. The solution you provide is Anarchy.

Totally incorrect, in common-law you will be SCREWED! I have my own 20 year relationship as an example, ended with Net Family Property for her was $200,000 more than myself. I did not get $100,000 equalization. I got Zero. Nothing. Zilch. Under common-law in Ontario you need to be able to prove a constructive trust for unjust enrichment. It would mean tens of thousands more in legal fees without any certainty you would recover the difference and legal fees. On top of that, if you lose you might also have to pay legals for the other party. So be careful. If you are not married and your common-law spouse has a greater increase in Net Family Property you could be left with nothing. Common-law rules suck, they are unfair and unlike Manitoba, in Ontario you will be screwed!!!

If no cheating or violence involved I beg each of you not to go for separation. It is not worth. Counseling garage. Both parties will come to the street. Believe me. Leave your ego. Even if you have to hold the legs of your wife or husband do it. Nothing wrong. End of the it is your wife or husband. Please i beg you l don't break up the marriage. I beg every one.
