Ever wondered how exactly the government of Germany works? Well whether or not you have, here's a roughly 8-minutes explanation of how the system works in Germany.

The video was overall quite good, but you could have focussed a bit more on the Bundesrat, because it actually plays a very important role. F. ex. the Bundesrat could block every law the Bundestag passed. The Bundesrat is more the representation of the Bundesländer and every prime minister of the Bundesländer sits actually in the Bundesrat ( or sends someone else to represent him and the Bundesland :) ). Then they also have a pretty cool voting system in the Bundesrat. Oh and I am not very sure if you can compare the Bundesrat to your house thing in America. But overall great video😀👍 But to be honest most of the germans don't even know what the Bundesrat is doing and where he sits. 🙂😃 Yeah and then the Bundesländer. Very important they have big powers not only in the Bundesrat. They can pass there own law, which only counts in the Land. For example in one country (Hessen) there is still the death penalty, but because the law of the federal government is more important then the state law, the law is not used. They kind of forgot to take it out of the constitution of one Bundesland 😃😂

Minor additions: Regierungsbezirke dont exist in every state and the amount of power they have varies from state to state Kreise are kind of the equivalent of counties in the US Bundestagswahlen are every 4 years, not 5 Bundestagswahlen and "Bundesratswahlen" dont coincide, since the Bundesrat is made up by the states representatives, which are elected at differing dates *might have mentioned the importance and make up of the bundesrat more, but I understand why anyone would leave it out, even most germans dont know what the hole thing with the bundesrat is about Just thought I'd add this here, thumbs up tho! German politics ain't easy and u did a tremendous job trying to untangle this mess ^-^

5:14 Careful there: they need 5% to get a seat in parliament, so the legislature. This doesn't necessarily mean that that would get to form a government together with others.

It's a bit more complicated actually. The 5% rule isn't actually for getting seats at all, but rather for getting additional seats if the seats assigned by first votes turn out to be a smaller proportion of the total number of seats than your proportion of second votes. If you have gained a seat by first votes alone, you do get to keep it therefore, you don't have to give it back just because you haven't earned 5% of the seats yet. Also, if you gain 2 seats by first votes you also get the opportunity to take additional seats, if I remember correctly. Finally, it's a silly rule that should be abolished because it essentially gives Germany a 20-seat parliament that they pretend to have more seats by splitting seats and giving out fractional seats. The threshold should be 1 seat, whatever that happens to be, no more, no less, adjust the number of seats accordingly, do not set the threshold independently.

It's actually not that complicated. The first vote is for voting the representative of your constituency, the second vote for how many seats a party shoud get in the Bundestag in total. Any candidate who wins the most first votes of their constituency is guaranteed a seat in the Bundestag (first-past-the-post system). The second votes of all voters in Germany are added up to a popular vote and the 660 regular seats of the Bundestag are split between the parties accordingly (proportional vote system), but votes for any party that did not get at least 5% of the second votes are not considered (at first). There are 330 constituencies in Germany. So those 330 directly elected representatives will start filling the seats of the party that they ran for. If there are still free seats left for the party, the party gets to fill those with members from a ranked list of candidates. If there are more directly elected representatives than the party received seats, additional seats are added to the Bundestag so that it becomes mathematically possible for every party to have their directly elected representatives fill all their assigned seats. If a party manages to gain at least three seats through directly elected representatives, the 5% threshold rule is not applied for them, and they will get all their seats from the second votes as normal (even if they are less than the 33 seats that make up 5%). The 5% rule is also not applied to any party that represents certain ethnical minorities (currently only one in Schleswig Holstein's state parliament representing he Danish minority in that state). And it's not a silly rule. It was established after bad experiences with the Weimar republic's Reichstag where the German parliament had so many fringe parties that the governments had to be formed by extremely fractured and instable coalitions that spent more time with internal fighting then getting actual governing done.

Some interesting facts: 1.) Schleswig Holstein is the only state with an exeption for the 5% rule. The party of the danish minority has guarateed seats. 2.) States have the right to reunite with another state if the population agrees in a referendum. It happened yet two times. But a seperation is prohibited. Frankonia tried the secession of Bavaria and Oldenburg from Niedersachsen. 3.) After 378 years of seperation the allies formed again one Hesse (Hesse-Nassau + People's State Hesse). But the terretorries right of the Rhein were used to form the state Rheinland-Palatinate. The city of Mainz lost some of there quarters like Mainz-Kastel. But they still plan to reunite one day. As a consequence both don't name their streets equal. In case that they'll form again one city.

1.) Is wrong, in Bremen a party has to reach 5% in Bremen or Bremerhaven. The "Bürger in Wut" are in the Bürgerschaft with just 3%, because they got more than 5% in Bremerhaven.

That exception to the 5%-Hürde is valid for all political parties representing national minorities. There is one for the sorbs in Brandenburg and Saxony, and one for the Frisians in Niedersachsen. But the SSW for Schleswig Holstein is the only relevant one at the moment.

1) is wrong. Technically, this exception accounts for all states. It's not about the state. It's about the party. The SSW (Süd-Schleswigscher Wählerbund) has been recognized as an ethnic minority party, that's why they benefit from this exception. If you were to found a party in any of the other states, and you managed to fulfill the requirements for parties to be recognized as representing a certain ethnical minority, you'd benefit from the same rule regardless of the state you're in. However, that doesn't mean that you're guaranteed any seats. You'd still have to receive as many votes as are necessary to gain at least one seat. The SSW has managed to do so consistently, others haven't. And honestly, the requirements to be recognized aren't that simple to fulfill.

There are 3 parties in Germany that are exempted from the 5% rule (the 3 Parties are the Südschleswigscher Wählerverband(SSW), Die Friesen, Lausitzer Allianz), but the right to be exempt from the “Fünf-Prozent-Klausel” is given to every party representing a “Nationale Minderheit” in Germany. How you get to be acknowledged as representing one of these groups is a completely different and complicated matter. And there is a second rule that let`s a party ignore the 5%-rule. If a party gets at least 3 seats through the first vote, it ignores the 5% rule. (May one day become important if the CSU doesn't get 5% of votes nationally)

The state-diagram is not correct. 1. According to (almost unanimous) opinion and every ruling of the federal court, the president ha no(!) veto in legislation. Current consensus is, that he must accept legislation that is presented to him, unless the law has to to pass in an absolutely obvious violation of the constitution (e.g. the government gives him a law neither the diet or the council have ever seen). 2. They also don't have any veto in the election of the chancellor. They present a candidate to the diet (and he may present a person of his choosing), but after the diet has elected a candidate he must(!) appoint that candidate. If the presented candidate isn't elected, the diet may elect a candidate of their choosing (never happened) within fourteen days. IF the candidate doesn't pass, there must be another election immediately, and whomever has the most votes is elected. If the candidate is only elected with relative majority (aka most of the votes, not more 50% + 1 Vote), he must appoint him within seven days or dissolve the diet. 3. He also doesn't have a veto for the appointment of ministers, at least de facto. De jure our constitution doesn't say anything about that matter. It's custom that the president doesn't interferes with the personnel policy of the chancellor. 4. He however has great power, if the diet is unable to form a coalition (refers to point 2) ), or a coalition breaks, because he decides if he dissolves the diet and no other person can tell him what to do. How this works is a bit complicated, so I'll leave it at that.

Maybe this is going to little to much into the details, but the "veto"-powers of the President aren't really veto powers in the purest sense of the concept. The President can only "veto" any form of legislation, if he thinks or as reason to believe that this piece of legislation is in conflict with the Grundgesetz (the constitution of Germany). He does not have any discretion to veto it, simply because he has other political ideas or plainly does not like it. That is not within his discretion! Also this power is only "redaktionell" - which you would translate roughly with "editorial". It means that the conflict must either be absolutely obvious or so small, that he sends it back to parliament. After review by the parliament and its scientific services and approved as constitutionally sound, most judicial commentators and the leading opinion in german Law studies suggests, that the president has no more vetoing power. But this is actually really complicated because it really never got this far, that the Legislative did send something back again to the president. Also this power is only called "editorial", because the President is NOT the "guardian of the constitution" (Hüter der Verfassung). That role is explicitly given to the Bundesverfassungsgericht (the Federal Constitutional Court). The "Bundespräsident" has primarily the standing of the ceremonial head of state, but within that is the important function of an integrating symbol for the german people, society and state ("Staatsintegrationsfunktion"). He is meant to be beacon of unity within a system of competing parties, to represent unity and stability by standing above the day-to-day politics and securing stability and soundness of the political system itself! It is really complicated and somewhat disputed in constitutional law research, but that is the leading opinion on it - maybe someone is interested! ;)

this video made me look up the current Bundestag and omfg AfD (also known as the "nazies weren't that bad you guys" party) have 78 seats or over 10% of the parliament this made me rapidly reconsider my plans of possibly moving to Germany in a few years the fact that they're growing and haven't been ousted from the mainstream speaks volumes about the political climate in Germany in comparison, UKIP - the most radical right wing party of the UK, didn't have the baggage of nazi apologia, yet still were completely ousted from the parliament by the public by simply getting voted the fuck out yes, this is the first time I made a comparison between modern UK and modern Germany that is actually favourable to the UK UK may have a worse housing market, worse inequality, worse climate policies, worse urban design, worse workers rights, worse economy overall, etc but at least they're not literal nazi apologists at least they kicked their most racist party's butt even if they proceeded to brex the it immediately after

Well to be fair, I come from a country where it's definitely not the federal government's job to run things like emergency services (although to be fair, my country occupies about 1/3 of the continent it's on)

@@KhAnubis ah don't worry, I just remembered the whole debate about it when I saw it, plus I'm an emergency worker myself and it's just frustrating to know that so many fundamental concepts and so much equipment isn't standardized across Germany or, god forbid, even Europe. Same thing with our school system where my Abitur (sort of like a high school diploma) from Bavaria will be counted differently from that in other places, like Bremen.

@@chrissytheconqueror7049 same thing in the USA for example. There is alot of things that are both? For example. Education is primarily/mostly a state thing, but there is a department of education on a federal level, but it doesn't really do that much. It does appropriate funding that Congress sets. Or healthcare. Ever since the Obamacare, the federal government has gotten much more involved, however, there were many state specific aspects. Like states could choose to or not to expand medicaid (free health insurance for people in poverty, although I think the specific line is different from state to state, and so are the state-based exchanges where one could get healthcare)

@@chrissytheconqueror7049 Standardization can only do good up to a certain point. It's important that things need to be similar enough that they don't harm the cohesion of a country, but different enough that local areas can still provide the best services to people.

@@chrissytheconqueror7049 Europewide standards? We will get there. I am sure. The latest innovation in this field is Advanced mobile location service. Whenever somebody calls 112 their exact location will be automatically sent to the emergency services. So you guys know exactly where to find the injured, even when they're located in the middle of nowhere. This technology will be deployed EU wide by 2020. Germany officially joined this week.

to answer the title-Question: slow, sometimes deciding the exact opposite of what would be neccessary. Btw. CDU/CSU are a Union of *conservative* Parties and until now still the biggest party. That explains, why our Government isnt as effective as it could be.

yeah. and SPD has only ruled 3 times as a leading party, made all shitty and let the real politicians do there job again after that, working with the shit they forced through. but luckily the "Die Linke" is succesfully proving way to often, that they're a bunch of idiots who dont even like its own members and "leaders". Same with the B90. And the AfD is just a big fat NOPE. I do like the FDP under Lindner, though... but in an Era of radicalism, Liberalism is dead^^

@@Mizuran in a more better World, they would work together and each party concentrates on what they can do best. Greenparty for Environment, CDU/CSU for economy, SPD for Work, Left party for social stuff. In their core-Topic, they are good, but the problem is, that they try to cover to much topics - even the topics they are bad with. The Pirate Party for example would be great for digital topics, i cant understand why digital Topics are in the Departement of Transportation.

@@Mizuran its a better idea than one party trying to cover many topics and doing everything bad. the only exception is CSU....they only have 2 departements right now ...i think. Tranportation (Scheuer) and Department of the Interior (Seehofer) - and both are terrible in their job xD

6:58 small misconception about the Federal Convention: It consists of the Entire Bundestag, appointed Representatives of the State governments and on top of it all each Bundestag Faction also receives a proportional amount of additional mandates they are free to hand out to "ordinary" people at their own discretion. Usually you'll find a mix of Celebrities, Intellectuals and Journalists within this group.

Yes, that is possible. It actually happened to the Linke party. Also of you get at least three seats for your party, the 5 percent threshold doesn't apply to you.

Sitting in the Bundestag and "being in government" are different things, Die Linke hasn't been in Government on the federal level since 1990, but they still sit in the Bundestag.

Word usage differences. When we hear "government", we think chancellor+ministers. When Americans hear "government", they include every policeman and probably every member of congress. Confused me no end when I first happened across it.

I’m sorry to correct you: The election period is for FOUR YEARS, not five…. Here the translated paragraph of the GRUNDGESETZ, the German “constitution”: Grundgesetz for the Federal Republic of Germany Art 39 (1) Subject to the following provisions, the Bundestag is elected for four years. His electoral term ends with the assembly of a new Bundestag. The new election will take place at the earliest forty-six and at the latest forty-eight months after the beginning of the electoral term. If the Bundestag is dissolved, new elections will take place within sixty days. (2) The Bundestag shall meet no later than the thirtieth day after the election. (3) The Bundestag determines the end and the restart of its sessions. The President of the Bundestag can convene it earlier. He is obliged to do so if a third of the members, the Federal President or the Federal Chancellor so request.

Great explanation, thanks ;) first English video about this that pronounces (almost) every german word right. One thing I have to correct you: The Bundestagspräsident "the speaker" is not higher than the chancellor. The only Situation Schäuble is higher than Merkel is when the Bundestag "parliament" comes together
