After satisfying remainder… When uncertainty of person or uncertainty of whether condition happening (meaning conditions exists that must be satisfied to get conveyance BEFORE the natural termination of prior estate) -> Contingent remainder If no uncertainty exists who or when the conveyance is happening and its conveyance depends on condition (AFTER receiving conveyance) -> vested remainder subject to divestment If no uncertainty exists who or when the conveyance is happening & if at the time of conveyance, the percentage of receiving estate is subject to change -> vested remainder subject to open

I think the lecturer misstated the difference between fee simple on condition subsequent and fee simple determinable. Although my knowledge is limited, I’ve never seen anyone make the distinction based on condition and duration. My professor and most commercial study aids state the 2 interests are very similar, other than the way the present interest terminates. With few simple determinables, the termination is automatic. Whereas with condition subséquents the grantor must actually make a claim for re-entry. Probably worth checking with your professors to see if they recognize this lecturer’s distinction

Michael is right here. Also know that modernly, courts frown on possibility of reverts, b/c it' so draconian. In fact, in California it's illegal; and a fee simple subject to a condition subsequent MUST have that language in the contract so purchasers are aware. Otherwise, it will not operate.

Yo Mike I have themis - I’m sitting in FL, I did well in my property courses but for some reason now - the material isn’t sticking and so I came to this video and thank u bc I felt I finally learned something. Maybe I need to learn basic property law before worrying about “oh this is the FL distinction or the FL rule. Can I hire you to tutor me because I’m freaking out with no time and 500 subjects to learn with little organizational skills - like outlining or knowing how to structure the day. I just follow what the themis schedule said but I clearly need to talk this out and so are you tutoring new students for July or am I too late? I even wrote out the chart - TWICE but I’m scared bc we’re moving subject to subject and I’m falling behind

I’m lost in “the right of entry” from 28:00-32:00. The transferor has the right of entry even though it’s fee simple subject to condition!? How is that?

If I understand your question correctly, I think the answer is that the transferor's right of entry cannot vest until the condition subsequent fails. In present estates and future interests, "right of entry" is a legal term of art-it does not literally mean that the transferor has the right to enter the land whenever he pleases (for his nonpossessory future interest to become possessory, he needs the condition subsequent to fail).

Yep! they dont get shit because there is no future interest conveyed by the FSA.. A has the option to convey the prop to his/her heirs bc A has FSA, but in that hypo the heirs dont have anything.
