Housing leases are the absolute worst and get people stuck! They should make it to where you can leave when you move in and there are pest issues such as roaches and bedbugs . I hate this ! I feel like these scumbags lied to me and are money hungry .

You can definitely terminate due to roaches- take pics and notify them- typically if they don’t cure within a week you have the right to terminate. Check local laws and a lawyer can help

I asked the manager at two different times before I moved in if there had ever been cats in the apartment. Each time I was reassured absolutely no cats in this apartment. Thus I signed a 6 month lease. Each night for 2 weeks I have been very sick with asthma because of the dander. My daughter and I have tried 6 times over to clean the rugs. I bought an air filter did not work, again had a chemical spray put on it. To no avail. I want to leave asap and then move out by the first of next month. Can I break this lease and pay no penalty.

I can't pay my last month which is June rent in a few days. I have not been able to work due to COVID. I work in the school district and it's been shut down since March. I also have a lot of issues here my place has flooded 3 or 4 times and in March it was really bad like major sewage issue. Well, they blamed me but I never used wipes and they have said it's from wipes since I moved in. 6 months after moving in is the first time it flooded and they said it's from wipes. April they charged me for the plumbing repair I have been back and forth with them about it and they didn't care. I also have not had bathroom lights since 2015 they never fixed it. In the winter I freeze and in the summer I sweat. I've never been comfortable. I have chronic pain issues so moving was something I couldn't afford or physically do. Now I have no job so what can I do? I never broke a lease and I'm scared. How will I ever get another place after breaking a lease?

My apartment complex is infested with rodents. Mice and rats. They prevent me from sleeping - due to the constant noise they make at night. This prevents me from getting rest for work, therefore giving me a difficult time to make a living for myself. Also they have destroyed some of my belongings. And also, of course, the mouse droppings - which are proven to cause humans to fall ill if inhaled through the lungs constantly. Is this a uninhabitable apartment? Any help you have please let me know. And yes I’ve contacted the landlord several times and he has FAILED several times at removing the rodents. Also, the rodents are in ALL units, not just mines.

Do as much as you can. People say the apartments Will have roaches and you just have to get used to it but I’ve lived in 2 apartments both more than a year and I have yet to encounter a cockroach outside. So obviously your complex is/was doing something wrong

I need advice. I signed a lease to move into an apartment in 3 months ( i signed the lease 8 months ago). My grandmother is the one designated to pay my rent and she decided she doesn't want me to live there anymore. She gave me the ultimatum of moving in with her or moving in with my boyfriend. Hi James that’s a good question and one I’m sure many people face with job transfers and better opportunities for employment found outside of your current living area. Being unable to pay fees upfront doesn’t abscond you from the liability of having to pay them. However given the financial difficulties that you will be facing with the move they are liable to help mitigate your loss. In regards to fees for break lease or advertising depending on how long is left until the end of your lease agreement the break lease fee can be negotiated to what would be classed as a “fair price” for balance of tenancy remaining. You can also ask for these fees to be signed off and taken from your bond so that it isn’t money out of your pocket now. Ensure as well that your tenancy is being advertised online to secure someone to take over your agreement as early as possible and also discuss with your agent a rent price to bring it under market online to rent it quicker and you pay the balance of the rent loss to the end of your agreement. For example if your rent is $500 per week and you had 8 weeks remaining on your agreement and they rent it at $450 per week now rather than keeping it on the market at $500 per week; you would pay the balance of $50 loss rent for 8 weeks totalling $400. This is a better outcome for you than paying another week of rent with it on the market at the $500 instead of $450. Your agent then has the ability to work in a rent increase back to the $500 after those 8 weeks with the new tenancy to ensure their client, the landlord, isn’t out of pocket. Hello. We have been at our current apartment property going on 3rd year. Since inception, we have had roof leaks through the light fixtures in two areas of the unit. The apartment staff have contacted roofers for repair, they repair, it will leak again. This has been constant through these years and has gotten worse now. The repairs have not remedied the situation. Would these be grounds to vacate our lease?

This is a tricky one as it could be a fault of the contractor or the agency for not following the correct procedures. As it is an apartment I would anticipate this is a cost that is covered by a Body Corporate and could be looking at an insurance situation if there is a fault with the roofing. If it is still currently happening you will need to follow the correct procedures as this isn’t immediate grounds for break lease. Ensure that you put in writing with supporting evidence that it is still an issue at the property and give a time frame for repair. If they fail to address it in this time frame you have grounds to breach the managing agent/ landlord and they must have it rectified or booked to be rectified within the breach time frame. Failure to do so can give you grounds to terminate based on an unremedied breach but please be very aware of the rights of both parties because if the agency/landlord is taking steps to repair this isn’t grounds for an immediate termination. You are welcome to under the current Residential Tenancies and Rooming Accommodation Act to break your lease following the standard procedures of paying a break lease fee, maintaining the property and paying rent compensation until such time that a new tenant is secured for the property. Do you need to complete another form when the original lease already has this clause in place “Rental of the premises shall commence on (starting date) _______________ and shall expire on (end date of lease) _______________. Should Tenant(s) vacate before expiration of the term, Tenant(s) shall be liable for the balance of the rent for the remainder of the term, less any rent Landlord collects or could have collected from a replacement tenant by reasonably attempting to re-rent. Tenant(s) who vacate before expiration of the term are also responsible for Landlord’s costs of advertising for a replacement tenant.” Landlord is aware of tenants intention to leave as soon as new tenant signs a lease. Is that clause enough to protect the tenant from further liability once landlord finds new tenant and a new lease is sign. Also how would one know the rental has been rented if you moved in a predetermined date.

When we sign the lease we were told no to worry about the dinning room ceiling its from an old leak and it was fixed and they will repair the eye sore crumble bumpy look which they have not. Then we saw black mold where the leak came from upstairs they said they will replace and fix and what they did was cover it with a molding. I been getting sick days after moving at my apartment I was thinking maybe the carpets in bedroom so I take something over the counter for it after 4 moths the leak started again and the maintenance said it was to shower head he changed it which I know it wasn't the Leak continue and I asked the maintenance to come look at it again he said it was us the water the water bouncing off our body and wetting the floor that is not true he said if it's not true then it would take weeks to have it repaired because it have to air out the walls and Floors. still months later i became worst and hospitalized after a bad respiratory attack. After tests I was told it's black mold and to check everything at home I couldn't recover and became worst. As we investigate the house the one guess bedroom not being used ac vent was shut and with the forced air definitely was pushing black dust against the ceiling bingo that's the mold it's going through out the house. I have 6 months left and if i stay here anylonger it can kill me, What should I do?

I have hard well water, I wasn't aware of this prior to moving in. The water is causing me boils under my arm and rashes on my body. I am sure of this because I have never had this until I moved into my place. I have medical documentation and my physician is willing to write a letter if need be. In situations where there is a mould problem you need to make sure you are following the correct procedures in getting it actioned. If you give the RTA a call they will also advise you of the following. Ensure you have issued a Notice to Remedy Breach to the landlord and agency on the grounds that the property is un-liveable. You need to prove that the mould spores that are forming are dangerous to your current health, photos show the evidence but not the result. Ensure you arrange for a mould specialist to attend and assess giving you a report on what the problem is and what needs to be done. A lot of mould companies will assess and report providing a quote of removal/rectification for free. Ensure this report is in writing and given to the agency/landlord along with the Notice to Remedy Breach. Under the Residential Tenancies and Rooming Accommodation Act 2008 refer to Division 3 Action by Tenant section 301 for further information on breaching landlords and section 325 and 328 regarding requirements and time frames for notices. If the breach is unremedied you have grounds to issue a Notice of Intention to Leave under Section 302. Refer further to section 327; 331 and 332. Good luck and make sure you take the required steps to try and enforce rectification before you can take grounds to vacate. thanks for your questions, hope this helps!

Hi, I share a lease with my roommate and we've lived in the apartment together 4 years although I had lived at same apartment since Jan of 2012. I had accepted to share my apartment with my friend (the current roommate) in July of 2017. Now I want to search for an apartment for myself and not have any roommates. I feel Im done with roommates. I've learned that having a roommate is a mistake. I had asked my landlord if our apartment is month to month rent since we have not signed a new lease over a year now and he said, that it is month to month rent. I did some searching for a new apartment for myself and found the apartment that I like. problem is, its ready for move in date of April 1st 2022, but we're at the end of the first week of March 2022. would this be too soon of a notice for both my landlord and roommate? Because really it's supposed to be 30 day notice for both my landlord and roommate to find another tenant or if my roommate wishes to stay on his own. what would be the best thing i should do or how xan I not miss this opportunity of getting the apartment I like by april 1st 2022?

Thank you for your question! Before breaking your lease I would be asking just a few more questions. Were the bed bugs from the property that you moved into? Or did they come in with your belongings? Have you also tried arranging for a pest control company that specialises in Bed Bug Removal to attend and exterminate the pests? Depending on who is at fault having already been in the property or bought in during the move you can negotiate on the price of the exterminator but I would be exhausting that avenue before breaking lease as it is not classed as an un-liveable situation under Queensland Legislation unless it can be proven in QCAT that extermination did not work.

I lived in a house this year with girls that made me feel unwelcomed and I was going to sign with them again but change my mind and now want to get out of the lease. I signed the lease but one of the terms of the lease is your have a parent co-sign and notarize it and send it back to the land lord. Well neither of my parents have signed as co-signers or notarized it and they haven’t sent it to him. So basically our copy would be the copy to have all the signatures(aka the official copy). Since my parents never signed the lease would that make my lease not complete and voidable?

My roommate is trying to break our lease because of the virus and did not pay rent for the month of April. I’m concerned how this effects myself because besides me not being able to afford it on my own I don’t have any other grounds to leave besides hardships and had been blindsided by the fact he’s trying to leave. My landlord stayed at least 60 days in advance is required but he’s trying to vacate immediately. If you are wanting to break lease due to failure of something being repaired you need to ensure you are following the correct procedure. So firstly is this repair needed because it is causing a structural issue and endangering your lives? If the answer is yes then you need to breach the landlord in order to action for them to rectify the problem. Ensure you have in writing that you have reported this and supplied photos of the issue. If they fail to remedy the breach you can then follow through terminating your agreement. You are welcome to contact the RTA for further information on this process or visit their website.
