Sir, can we quote legal provisions / Sections etc. in the written statement?

@JeetSinha Жыл бұрын
No, we should not quote legal provisions in the Written Statement. It is limited to the facts pleaded by the plaintiff. If the plaintiff in the plaint has raised certain issues or cliams under certain laws. If that law is not applicable to given case due to any reason, you may mention in the fact. General rule is you cannot mention the cases, provisions or legal documents as it is well within the wisdom of the court. You need not to prove the law as defined under sec. 56 of Indian evidence Act.

If the defendent has knowledge of some facts which are not mentioned in the plaint , how can he incorporate those facts in his written statement. Is it permissible? Can he also mention the law points quoting relevant provisions of law ?

Yes you can plead new facts which is not mentioned by the plaintiff. However, in written statement you don't need to mention case laws
