Mr. Liner, thank you for discussing the sections of this form, and providing practical tips. Very helpful, coming from this retired teacher. Reading thru these video comments, I'm impressed that you've responded to questions. IMO it means you care (even though I imagine you're incredibly busy). I've watched dozens of KZbin videos, read articles about my conditions, etc. I'm investing time and energy into my application, I want to do it right the first time! Thank you!

@@LinerLegalLLCCleveland Here is my situation I file for unemployment in 03 2020. Received unemployment from 04-2020 to 06-24-2021. I became disabled on 05-2020. I filed my SSDI application on 09-28-2021. Do I have any issues with SSA due to my unemployment? Also, should I be awarded SSDI benefits do you think this will affect my back pay? 64 years old and I live in Texas.. Thanks.

My husband has been sent this form 14 months after applying. Had no clue it would move this slowly. I'm hearing it is due to a huge back log in cases so don't expect it to move quickly. He is doing his best to be prompt in responding and wait patiently.

I felt insulted by some of the questions and probably failed it miserably. Waiting on my initial response in about 2 weeks. Wished I’d watched this video first I was approved and I can assure you I butchered the questionnaire but I was honest. My medical records and my doctors had my back.

bs1820 We hear that a lot! SSA lacks a lot of tact in the questions they ask, and many of these questions seem repetitive. However, glad you found the video helpful!

Michael Liner ha.. quick response Thank you! I actually went and found the copy I faxed to them and sure enough had a couple of contradictions in my answers (my 76 year old father filled it out was my first mistake) obviously he was asking me the questions but on at least one answer he checked no but filled out the follow up like he meant yes. I have Myositis DM and PM with interstitial lung disease. My muscle/skin biopsy results were really high according to my rheumatologist. Can those results have more weight than the function report ? Thanks for responding

I can’t advise on any specifics but what I can say is that generally SSA values medical records above function reports, work history reports and all else. So as long as your doctors are doing their part and documenting your condition(s), don’t lose sleep about a small mistake on the forms.

Did my function report but my doctor won't do a function limitations report claims she doesn't do them like really and I have facet joint arthritis in my L3 L4 L5 and L5 S1 mild posterior disc bulging accompanied with biforaminal narrowing and bilateral leg numbness and weakness and bone spur and facet joint disease and degenerative disc disease and lumber hyperlordosis I have one week left of pt then I'm getting a mri done that my neurosurgeon wants I already have had a x-ray and ct done but yet none of my doctors will do a function limitations report and I'm not sure if ssi will still go by my medical records without it

Thank you! I think I did ok filling this out some months ago but I wonder if I should have said I do have issues dressing because it makes me overheat easier. I have heat intolerance and live alone so I don't get dressed unless I go out. Easier to moderate my temp that way. I think I did ok on hobbies... Mostly put down TV, books, video games, DND once a week. I think I mentioned art, though I can't do it as much as I used to. I don't know if they would misconstrue any of that though. There's a big difference between being able to work and being borderline bedridden and watching TV to not die of boredom. and the video games are relatively easy ones. I guess I'm mostly confused on what they expect you to put down on that, because obviously people who can't really do hobbies don't sit and do nothing all day. I hope i filled it out right cuz I have an attorney now to help with all the other confusing stuff.

First thank you so much, my 22 year old son has a fast professing MS and needs badly to be on disability and I’m sure based upon how we originally filled them out he would have been denied 💔. As we are filling them out now I am a bit confused because you said to fill all the answers out for a “bad day” at the start of this video, but then on some of the answers you said to put on a “good day” … will that cause confusion? Sorry, we just received these papers even though my son applied almost a year ago. 😢 Also do we need to state approximately how many bad days he has vs good? Sorry we tried to get an attorney to help but since he already applied on his own we couldn’t find an attorney that would take his case after he applied. Any suggestions would be extremely appreciated.

Question? When you answere these questions. What if your pushing threw the pain because you were taught that in the service.? So can I answer the question (yard work), I am limited to doing yard work because my disability hurts but my training kicks in and I have to finish task at hand. So I work threw the pain but later when I flar up I'm completely done for the day or two. Or if I go to the Gym to maintain my muscles and my flexibility to try and help preventing further problems as I push threw the pain but I do suffer when I'm done but I'm doing it to try and help the disability. I'm realy confused on how to answer. Because I push threw the pain knowing it's going to make me suffer. Is this to much info am i answering it wrong.

It's my brothers case I filed on his behalf for SSID (he's 62 so also filed his retirement too, and that went through okay) my brother suffered a major stroke 11 months ago. I filed just after. My brothers home now he got out of hospitals and associated stroke rehab and he's been home since April. He's unable too communicate either verbally or written...! He has a multitude of both stroke and a cardiovascular issues HE'S not ever going to be employable in anyway shape or form... IT'S quite apparent. It's insane; from literally impossible too Obtain his medical records due to hospital doctor / patient confidentiality rules law's whatever...? To (and I'm not exaggerating) obtaining a primary care physician within our reach (? Half a dozen medical offices) and what or how does it go ? "I'm sorry Sir but we cannot discuss with you these kinds of things due to establish confidentiality rules 😳 😣 SSA for my brothers claim when I first filed this claim there wasn't anything discouraging or I'd of hit the brakes ? I think this needs an appropriate legal firm ? The case worker and I seem to be getting the claim started okay my brothers condition was then and today obvious he's suffered injuries so substantial that the stroke impairments have left him absolutely house bound with 24 7 supervision from Yours truly. Care is with me cooking cleaning dressing hygiene bathroom the whole deal. And this where I have had to and I don't want to say ? Where I had to make a decision he's coming home to our little rented house Because That WAS and IS the only decision. I'm fully disabled myself from a cranial nervous system disease like m.s but viral in origin a real life halting and seriously painful illness. Up until my brother had that stroke (had that stroke in an emergency room while there for an unidentified painful issue in his lower quadrant. Blood clot in his spleen broken apart resulted in brain STROKE) HE WAS caring for me.....good grief. I made myself physically move it (my busted up potato couched body) and facilitate those kinds of things that'd need to happen in order (nothing's orderly about me) to bring my brother home. Despite that agonizing HELL on earth pain compounded ten times over for doing what I had to do (cleaning and readying our house) to bring him home...? Not withstanding of course if he'd died first before discharged. He wasn't expected to make it out of there and an antiseptic s. h. of a skilled nursing facility locked down under SARS 2 COV 2019 pandemic protocols was, and from the hospital staff Constantly an obstacle course of hoops too jump through (which quite frankly I couldn't, and didn't) with the BAR seemingly always set HIGHER than I could possibly clear. Not a community collaboration event between myself and that hospital and without any advanced health care directives, living wills pre established ? It was me (a physically disabled with a multitude of neurological impairments emotional issues with a substantial loss in cognitive intelligence n what not... retarded.) Against an organised private for profit hospital with armed cops and an effective legal department. My brothers HOME and THAT'S how we'd both have wanted IT and that's how we're keeping it. We're still alive we'll continue and we'll THRIVE To the BEST of our abilities. Current disposition of my brothers SSID CLAIM...? Stalled (not approved nor disapproved) and FROZEN IN A BLOCK OF Federal ICE. Note that his original case worker mysteriously vanished a couple months ago were told and along with literally everything we'd had up to that point though it wasn't much IT'S GONE?. ☎〰📞🐴Wilbur ? WHAT ARE YOU GOING TO DO ABOUT IT.....❓❔❔❔ I don't know Ed.......🎄🏡⛺🎄🎄 🎄🎄 Thanks for Sharing, Yours truly Mr B Parker and BROTHER G Parker👅

Thank you for the video it was very helpful. I thought that a Doctor or physical therapist had fill out one of these forms. Do they or do you do it yourself because it says on the papers that i have to be signed by a Doctor and they want me to go back to physical therapy again and I've been on and off throughout my life like 5 or 6 times but my orthopedic Dr. Said that physical therapy would have to be done within the last 6 months and physical therapy is just a way of soaking up you're money because how could like 6 to 12 weeks make things all better. Honestly everytime that i went to physical therapy i always felt worse coming out than what i did going in and that's the truth. Physical therapy isn't going to put a protruding or buldging discs back into place especially when you have so many of them in the neck and back on top of other things. It's all about the money because you've got a copay everytime you go and when they want you to go 3 to 4 times a week for 12 weeks that adds up especially when you can't work and don't have an income coming in . But they said they don't feel comfortable feeling out the report unless you do it and medical records themselves should prove everything especially when you've had injections that didn't work and so many times of physical therapy that just made you feel so much worse coming out and i think that's ridiculous. What do you do about that? Because i know that form is very important please and thank you.

Thanks for the question! I understand that PT can be painstaking and time consuming. The bottom line is that it’s important to follow doctors orders. However, if you communicate to your doctors that you have tried PT 5-6x in the past without improvement-and in fact have only gotten worse-it seems to me that they probably would not keep sending you and SSA wouldn’t expect you to keep going if there isn’t a documented benefit.

@@thedisabilitylawyer Thank you for answering my question i appreciate it very much and i will follow up and talk to my Dr about it because i explained to her what i told you and she said that if they wouldn't just do the report for me then she would try and find someone who would. The problem is i go to a clinic and this is the third time they've changed the insurance and you never get to see the same PA or Doctor but it should be in my records. Thank you so much!!

I hate that I have to be made to feel like a faker or malingerer. I have stage 5 renal failure, a transplant that failed, Im relisted, now they say I've had a heart attack after reading the stress test. I have a metal urinary stent to keep my transplant ureter open. The anti rejection med have attacked my bone marrow. I have hundreds of medical records from surgeries and go to the doctor 2-3 times a month. And LTD and SSDI are hounding me about possibly putting to work in some sweat shop sorting nuts and bolts for $8 an hour. Good grief. You wanna talk about anxiety, I'm not even trying to bring that jive up although I'm neck deep in it.

That is terrible! There isn't much "good news" to be found in your comment, but with Stage 5 renal failure you should at least meet one of Social Security's listings--meaning they should approve you without further inquiry into your work background after a review of your medical records.

Currently waiting for my hearing with ALJ.... Been ahwile and wanted to see if the system updated and it said Appeal Review... Medical Decsion Made ..... How could there be a decsion made without doing the hearing first?

I filled out a form the best of my ability and had suffered the worse any woman could ever imagine and they are still taking me in for testing.And social services knew I was in need of financial benefits and they only gave me food stamps and medical insurance. I feel that I have been sabotage by the system and had been homeless and called 211 a few times before I was helped. A few months after, I started to suffer fibromyalgia. I was born premature so I was born disabled. When a human has experienced a disability and then cures they would still need trauma treatment. And it's a civil violation to have lead a civilian on in the scene where they think it's ok to settle in order to be a part of a community and are still in dangers because the suffered already. The system promised them that the ground they live on is a safe haven and they still suffered harm. To be immune to a disease or more than one disease is disability on both parties so the situation should be handled with patience and compassion especially if it is God who created or is planning to create us as human beans and his or her love for us is going to be unconditional. To live a miracle can happen to any of us and it's not right to hate, we should just try our best to be happy for one another and wait our turn. The check is never enough to live comfortably anyways.

Thank you for your video! It's extremely helpful. Now here's some silly (or maybe not so silly but may be helpful to somebody else). My 18 year old daughter has a moderate intellectual disability and I am her legal guardian and rep payee as she is transitioning to adult benefits. Here's where I am SUPER lost- The Adult Function Report request letter is addressed to me for her- so as I fill out the first report, I am filling it out on her behalf. She doesn't understand any of this and functions at a five year old level. Here's my question- the THIRD party report- can I complete that as her third party family member even though I am completing the SSA-3373? Or do I need to find a teacher, aunt, or somebody to complete it?

I love this question! You can probably fill it out, but getting another 3rd party to fill it out (a teacher sounds like compelling evidence) can only further support the need for benefit continuation.

@@LinerLegalLLCCleveland Wow! I am blown away by how fast you responded! Thank you so very much! I am like is it a conflict if I am completing both forms? I am annoyed that the letter is dated 02/16 and I received 02/24 & told it needs to be completed and returned within 10 days of the date of the letter. Ugh. Had to leave a message. It's definitely anxiety inducing. I had really hoped that my providing a neuropsych eval to SSA indicating she has an IQ of 46 would have been a no-brainer but I get that diagnosis doesn't mean anything - it's how it affects the ability to work. It's really difficult to fill these out! Again- thank you sooo very much!

@@JBFletcherDidIt We really can't give legal advice over KZbin, BUT an IQ of 46 should be an automatic continuation of benefits if its supported. You could do both yourself (there aren't rules about this, per se), but especially given the diagnosis I think a teacher's observations would be particularly compelling. Great question Shawntay! Because how you are functioning is an individualized assessment we are unable to answer the questions for you, however we are able to assist our clients with the questions and ALWAYS review the forms before they are returned to SSA. I hope this response helps.

The reason they want to know your hobbies and interests is they could use that question to trick you. They would ask you about things the hobby entails and then cite to you some examples of jobs that have similar functions. Next thing you know *DENIED* . Also A vocational expert at your hearing may try to use that hobby to say that if you can do this here are a zillion similar jobs, thus killing your case with no hope of resurrection!!

I've had judgements when I was appealing them trying to take away my child disability of them contradicting themselves with job suggestions. I said I could not do repetitive motions and lifting. They suggested assembly line work. I can't work with customers. They suggested I be a health inspector.... Also can't drive and inspectors are expected to. I can't remember the third suggestion but they more or less decided I could only do light work with half a dozen exceptions and the said examples violated the very exceptions they outlined. And I've only gotten worse over time too, so that judgement was like... 5 years ago? Obviously I'm a lot less capable now. I just hope my lawyer helps. The one I had then ghosted me and stopped practicing and never filed my appeal. Only hobbies I mentioned this time around was watching TV, reading, drawing, d&D, and video games. All easy things to do while I'm in pain and in bed. I think I mentioned I couldn't do art much anymore due to arthritis. Pretty sure I mentioned D&D was once a week. I know they'll try to twist it somehow though.

Christine Boswell-Sexton absolutely! It will make for a very long form, but it will surely give SSA a great window into your functioning. Just be sure include how many of each type of those days you have in a week/month.

@@thedisabilitylawyer Cool. Is narcolepsy with cataplexy a listening level disability? I think it falls under mental health ones under .1, but I'm not sure.

Christine Boswell-Sexton No it isn’t. The closest impairment they evaluate narcolepsy with cataplexy under is actually a seizure disorder (see: secure.ssa.gov/poms.nsf/lnx/0424580005).
