It is safer, but local municipalities can't regulate the airspace. Only the ground. Even official no drone zones can only regulate takeoffs and landings according to the FAA. TFRs are an example of the FAA restricting the airspace over the area.

According to the linked ordinance, The park does not restrict take off, only landing is prohibited. Nor is there any specific restriction on operating the drone from within park property ... The key concept is that the FAA opinion that states/localities can control specific aspects of drone use, including take off and landing. Since most drone pilots are ground-based, the state can control where the pilot operates. Tennessee has no state laws wrt drones as of Jan 2024, so only local ordinance or facility policy would be of concern. The limit in this specific park is on aviation in general, and it is a prohibition on intentional landings. Either the Sargeant is unfamiliar with the ordinance, or he is a drone genius who understands that some drones will automatically return to the take off point on loss of signal (which would constitute an unauthorized intentional landing per the ordinance). Not betting my money either way ...

I had the same situation except with campus PD. I was parked on their property while flying over an adjacent golf course COMPLETELY out of everyones way by an old landscaping shed, I mean you had to look for me to find me. The Douche Canoe in security golf cart circled me mad dogging and eventually called the Sgt. on me. The SGT was cool, but I said to him “you know I can just park across the street and fly this whole area right?” He didn’t like that very much. Long story short, I now dedicate one battery EVERY-TIME I fly just to that Douche. I cruise out, find him circling in his little campus cart, and hit him with the spot light for about 20 seconds, wag my props, then fly away. This was several months ago and I have given him about 10 visits since then. Its spiteful, and petty, but it makes me feel GOOD!

My favorite example of this is a UK KZbinr who got some great footage of Stonehenge. He waited until after hours, so there were no people there, took off from outside their property, and flew over. But, then, I just saw some drone footage of Maiden Castle (despite the name, it's a hillfort; nothing but a hill with piles of dirt), and I'm pretty sure they were on the property there. Both Stonehenge and Maiden Castle are property of English Heritage, which like the US NPS, bans all drone operations on their lands, even when the site is just a pile of dirt.

Parks should designate "No Karens Zone" for drones to take off and land. The biggest thing, I think, about drone restrictions is fear of "aggressive" activities. They have created skate parks to get the kids off the sidewalks (mostly) and give them a place to play. Not much effort to designate a small portion of a parking lot or field as "drone zones."
@Greg__K

Exactly. I remember when my town started designing and building the first couple of skateparks. It was so nice and less stressful knowing you wouldn’t get harassed for just skating. People are going to fly regardless of any set of rules, so you might as well give them space to do it.

This was a great video, funny video. You two guys work so well together. I'm all about saftey and it is ridiculous that you are put in jeopardy because they don't want you to take off or land in a safe place. You are still able to fly and see the whole park anyway, so what is the sense of making you have to fly from an unsafe area? What is the difference of cameras all over in the park, which I'm sure the park has then a drone flying around? They both are recording footage of everthing. Yes. You as the one to keep your eyes on the drone in the area as Keith was doing is probably. I have been the spotter my self and you would be amazed at how you keep it insight. Most likely not. A lot of the codes that parks put into place have a "launch, land, and operation" provision built-in that prevents you from launching/landing as well as operating drones. Which they're allowed to do unfortunately because it doesn't dictate the airspace. Just where you operate the drone -- which regulates you, not your drone.

So once again he is still in FAA violation. Part-107 Visual line-of-sight (VLOS) only; the unmanned aircraft must remain within VLOS of the remote pilot in command and the person manipulating the flight controls of the small UAS. Alternatively, the unmanned aircraft must remain within VLOS of the visual observer. • At all times the small unmanned aircraft must remain close enough to the remote pilot in command and the person manipulating the flight controls of the small UAS for those people to be capable of seeing the aircraft with vision

@@shadowofchaos8932true but it does in fact say the drone has to be in visual line of sight, not that you just have to say it is. Of course they would have to prove the drone was not in VLOS. In this particular case while it looks like the drone was too far away to see without superhuman vision the fact is you can't really judge distance from a drone camera. I know I've been able to see my drone at a distance where I couldn't see myself on the drone video. So all that's left for this particular video is to prove Kieth doesn't have x-ray vision and didn't run over to the tunnel to watch the drone go through. I saw a range test video where a guy kept saying he could still see his Mavic Mini at just over three miles away. I will never be convinced he saw it that far away but if I was a prosecutor the burden of proof would be on me, not him. The guy was flying over open desert and never over 200 feet which kind of shows the VLOS law is pretty ridiculous in most cases anyway.

I got some complaints from my HOA neighbors that I was peeping into backyards and concentrating on the pool area with my drone. Total hogwash, but they made me produce my FAA license and insurance before they were happy. I like to explore when I get into the air and am always fascinated by what’s around me that is invisible from the ground. Kens and Karens are everywhere.(Not meaning you, big Ken.) Always remember to cover your bases when you fly.😊

Not sure where you all are flying, but Portland, Oregon in the US has a no fly rule over their Metro parks too! I sent them a message informing them that they can’t regulate the air space above their parks, that is the sole domain of the FAA. Nice to see others know what they are talking about!! 😊

Seems more like "pick and choose". Absolutely, FAA controls the airspace, but there is no way he complied with LOS (line of sight) requirement during this flight.

Of course the rules are about discouraging people from flying drones in the park or over the park. I always try to look at things from the viewpoint of the other side. I may or may not agree, but seeing their side may help me to understand and perhaps craft an argument that may persuade them, or find a way to do what I want that doesn't annoy them. The thing is, many of the general public is either annoyed by the sound of the drone, is worried about being hit by the drone, or fears some impingement on their perceived sense of privacy. Flying farther away helps with those.

Can you give any insight on the particular position you picked on the road side launch and recovery area you selected? ie... How did you figure out that was a "good" spot and how to articulate that to police if they did stop for you. Like For me, can i just pull my truck on the side of the road like that, and L&R like that for example. Like what denotes Public vs. Private or an easement etc, if that applies.
@shadowofchaos8932

In most places it's based on local or state laws. In Michigan, a road easement is 15ft from the center of the road to the outside of the road.

I read that the FAA requests pilots of all aircraft to maintain a minimum altitude of 2,000 feet over all National Parks. I know this video isn’t a National Park, but what do think about the FAA setting that altitude minimum over National Parks?

I’m kind of blown away how good your signal was flying through the tunnel as well as flying below tree, lines and hills when you went into the park obviously, you did the ham hack to unlock other channels, but is there a hacks to unlock different power levels like the old air units. I’m new to the 03 I’m used to the older air unit with the 1200 Milla watt hack. Can you give any tips as far as power?

So as long as you take off and land outside the park its OK to fly IN the park. Does this apply to national parks etc as well? This is a warning I got on Air Aware "This is a wilderness area. Drone use (commercial and personal takeoff and landing) is prohibited within all wilderness areas".
@volvo945

You failed to demonstrate to me that flying from outside the park is arguably less safe than take off and landing from inside the park. Just because you say it’s so doesn’t really convince me. I saw no unsafe situations on this video.

Watch you all the time. I realize that you step up to the line a lot. I was under theimperession that the PIC must have VLOS on the drone and that a visual observer cannot replace that for the PIC. The VO is just to assist as the PIC looks at screen for telemetry, etc. Please advise me....
@KenHeron
@KenHeron Жыл бұрын
It would be dangerous for a goggled pilot to have VLOS at all. This is an oversight (pun intended) by the FAA that needs to be corrected. In the meantime, I prefer to conduct flights in a safe manner. Hopefully, the bureaucratic machine will catch up to how things work in real world situations.

First off: I enjoy Ken's content. Biggest two in Canada would be flying over people and being within 16ft of them (excluding folks in vehicles -- they don't count -- and assuming Ken would have our advanced cert. If not, would be a 100ft buffer.) I don't know for sure if he broke any regs in the US but the flying over the pool area made me uncomfortable as a fellow drone pilot (in Canada). A good general rule is you want to be a good sport and not needlessly piss anyone off. Here at least not everywhere has bylaws prohibiting park use (outside of provincial and federal parks) and if they don't, so long as you don't give folks a reason to complain you're free to take-off/land/fly on park land so long as you respect that prescribed buffer (I just reached out to the municipalities I wanted to fly in and got written confirmation for use of park land to be ultra thorough.). Here, sadly, provincial and federal parks are a total no-go (even airspace wise) without a hefty permit. EDIT: about 3 seconds after I unpaused he said he wasn't over people, but it looks like he ended up awfully close to tell from that far away and limited POV of the drone (based on the YT feed).
