What is you're a non-dom and your home tax residence is in a tax haven country (St. Kitts, Cayman, Vanuatu, etc.,) ? Is it just a territorial tax while in Malta?

My question is a not so silly one, would a parking ticket or a minor traffic infraction like an expired vehicle registration or inspection, or something like a failure to yield ticket cause one to fail the criminal background check? I could understand a failure to disclose the infraction tripping one up, but the percentage of people in highly policed countries where car travel is a necessity ie the US or Canada who likely have such infractions seems high.

No need to overreact - such things only appear on criminal record checks once they become criminal (i.e. found guilty and charged by a judge or magistrate and sent to jail). Simply put, the only things that appear on such records are serious crimes (financial or violent) that are considered felonies regardless of whether or not you get sent to jail. Anything you get jailed for will also appear. The occasional minor traffic infringement or cancellation of a vehicles registration shouldn't appear on such a check. Note that there is a difference between "infringement" and "criminal" - consult a legal dictionary or a lawyer for the official definition.

@@matthewnirenberg I am a lawyer & the question is how is Malta defining a crime because in the state I live in, your parking tickets and traffic infractions show up on driving abstracts and other records checks. A violation of any law you are charged with could be defined as a crime.

@@jeremyleonbarlow I'm not a lawyer but due to the Schengen Agreement, Malta would have to be in line with the EU. I would recommend that you inquire with either a lawyer in Malta or with the relevant authorities in Malta if you can't find the relevant information on the EU's official website. I've never heard or seen minor traffic infringements appear on a National Police Record Check in AU, NZ, CAN or EU. Everyone says to declare such things if asked though as failure to declare can be an offence on its own.

Can maltese citizens travel and live,work to microstates like monaco which are european countries but not in the EU or schengen zone?

@PatRisberg the answer is a bit more nuanced than a simple yes or no. Maltese citizens as members of the EU do not need the French embassy to sign off on their residency in Monaco the way third-party nationals do, and can deal directly with Monegasque immigration. If a Maltese citizen sets up a local company in Monaco they can likely obtain a work permit and residency permit via that route, but Monegasque companies that earn money from outside Monaco have a tax rate well in excess of the US corporate rate even, so not a great choice for doing business internationally, but if you want to start a local shop or service, it's a 0% rate although the VAT is not exactly consumer friendly. Like most other non-Mongasques in Monaco they can also apply via the self-sufficient route and they are eligible for a work permit via an employer who is in compliance with Monegasque laws for issuing a work permit for a foreign employee. The question of whether or not one can live in Monaco is really a question of whether or not one can afford it. I mean a small studio apartment is selling for over €2 million at the low end of Monaco real estate. The cheap rents are in excess of €5k a month. If the Maltese citizen has the coin, they can just as easily live in Monaco as any other non-Monegasque and unlike their fellow EU member state citizens of France, their double tax treaty with Monaco does not subject them to tax in Malta if they are a Monaco tax resident. Now I would not flirt with tie breaker calls by living between the two countries because the tie goes to nationality, but a Maltese citizenship with a Monaco residency permit is quite attainable. And if you have the coin to buy Maltese citizenship, you probably have the €500k to put in a Monegasque bank and rent or buy a property in the principality. Andorra, San Marino, and Leictenstien also have more favorable treatment for EU citizens in terms of residency or work permits than third-party nationals. Liechtenstein in particular if I remember correctly is highly favorable.

@PatRisberg Monaco does have a few embassies mostly in Europe and a General Consul to the UN in New York and an embassy in Washington, DC, but as regards third-country ie non-EU nationals the French Embassies handle approval of visas for Monaco Residence prior to Monaco Immigration becoming involved. But for EU and EEA nationals they don't need to deal with Franc and can deal directly with Monaco immigration officials in the Principality. My understanding is that their embassies aren't involved in the process. I could be wrong, but I've done a fair amount of reading on the subject.

@@jeremyleonbarlow if I am ok financially..but just want to live in monaco, and work outside of monaco..can I do that visa free or residency permit free?

@@SneakyFacts_1208 you are going to have to park the money in the bank. You will need to pay whatever fees associated with it too, but it's your money earning bank interest, so I mean you are not really losing anything. It's not like a super high yield bank account, but they are paying an ok rate the last time I heard.
