How To Hire Freelancers and Employees Overseas (5 Steps)

Throughout my career as a small business owner, I've hired and worked with hundreds of freelancers and contractors around the world and in this video I lay out exactly what sites I use to hire great talent and the process for doing so.

Great information, but are you having freelancers create any intellectual property and how do you get them to relinquish the material once complete? How do you get them not to use it for profit?

Good stuff. My question is kind of open-ended so maybe better as it's own video but once you've hired someone what happens? More specifically: 1) What all do you have them sign? 2) Is there any complicated legal issues with paying them and with them being overseas? 3) Do you still just pay them through PayPal once they're working for you? 4) Do you just offer the same hourly rate for everyone who takes the test and pay for however many hours they claim it took them?

Hey paul! great question! 1) What all do you have them sign? Overseas is much different than US. US contractors I personally have them sign 1. W9 2. Non-Solicit 3. Contractor service agreement 4.Liability form (if in person) 5. NDA Overseas I have sign NDA & Non-solicit, Contractor agreement and that's it. That's just me. I don't know how much US contracts are enforceable overseas though so i would talk to a lawyer on any clarity on this as i'm not a lawyer, just sharing what i do not giving legal advice. 2) Is there any complicated legal issues with paying them and with them being overseas? Again- i'm not a lawyer, i'll share what I do and my understanding. Not that i'm aware of. In fact it's much better to my understanding when it comes to the legal side vs US contractors. The IRS can try to claim a US contractor should be an employee where that isn't the case for overseas. Paying them is very easy depending on where they live. 3) Do you still just pay them through PayPal once they're working for you? I don't like paying anyone with PayPal other then for test assignments. PayPal takes too much in fees. Overseas I typically use transferwise. Some countries are worse then others though with payments and Wire transfers or Payoneer are the only viable options. I've had consistent issues working with Ukraine and Colombia tends to be annoying as well (My dev agency we have a whole team/office in Medellin Colombia and do everything with wire) 4) Do you just offer the same hourly rate for everyone who takes the test and pay for however many hours they claim it took them? I will set a budget and pay based on skillset & also based on what is negotiated. Everything is up for negotiating as long as the value is there and the budget is there as well. I can see what rates people are charging so it makes it easy to get an idea of what rates look like for certain skill levels. The more you understand the position you're hiring for the more you'll know the market rates etc but I believe in paying people what they deserve

Overseas freelancers I typically use transferwise. I also use Brex for international wires which is FREE. For us freelancers I use gigwage. In regards to legal - there's not much legal paperwork (or really at all) that is needed. For US different story- I send a w9, non-solicit/non-compete, NDA and contract agreement, which I also send all of that to overseas as well. Taxes overseas doesn't matter- but does for US. Hope this helps!
