What if you have an LLC and want to choose the S Corp selection for tax purposes. When you enter the name of the company it won't let you enter the LLC part of the name. Should you enter the company name without the LLC part?

If you started a new business as an S Corp, you have 2 months and 15 days to file form 2553. Hopefully you did that already! You can obtain the EIN anytime, but you will file as C Corp if you did not get approval to be an S Corp. check out the IRS instructions here: www.irs.gov/instructions/i2553

I just created an LLC in California but wants to be treated as an S-Corp. I know I need to file form 2553, but need the EIN. When I file the application you show in the video, I cannot include the "LLC" in the legal name. Any advice?

I recently appied and it sayed don't apply for the EIN while I was waiting apporval for my LLC. After 2 weeks it was approved and the email stated to go ahead and apply for my EIN. Hope this helps from FL.

www.irs.gov/instructions/i2553 These are the instructions for form 2553. No, you are not required to file 2553 before filing for an EIN. Your company can become a C Corp first and then elect to change to S Corp. Just observe the required dates in the IRS regs. If you want to start as an S Corp, the check out example 1 on the IRS instructions. Let me know if this helps.
