The law about lates not being allowed on your credit reports is found in the UCC. I have used it for years. Furnishers/alleged creditors operate in commerce and are required to abide by the UCC. Basically what this code says, is that if you are late, you are in dishonor. Once they accept a future payment, they MUST treat it as never having been late - "never being in dishonor." THAT'S THE LAW.

Well they have 30 days to respond to you not to complete their investigation. So they will often send a letter saying they are investigating and that will comply with the 30 day requirement.

If they correct the error then hopefully that tradeline is in a positive status and it helps your credit score and the way future lenders look at your profile and credit eligibility.

Hi Naam, You mentioned at 29:30 regarding closed accounts with late payments. I have a timeshare, we fell behind on the payments and the company reached out to us to lower the amount of points we purchased to help with the monthly payment. The representative we spoke to said the old contract will be "satisfied" and we would be opening a new contract with the remaining balance. In essence the old contract will be fully paid off--he said in doing so those late payments will be removed from our report. Is this true? Appreciate the info thank you. Since falling behind, we have caught up with the payment, but the thought of lowering out points, monthly payment, and maintenance costs seems ideal.

You can dispute all late payments in one letter but it's most important to dispute the most recent ones and you can just do those over and over until hopefully those come off. Then you go after the older ones. Either way is okay.

As a co-signer, you are responsible. So, you're going to have to dispute the lates on your own report. Hopefully they will remove them off your credit reports because they can keep them on the reports of the person you cosigned for. You may have to really go hard after the pretender lender as to how it was funded in the first place because the truth is, it's against the law for banks to lend their money from their assets or their depositor's assets and it's against the law for them to lend their credit. What they do is lend you YOUR CREDIT from your signature on a negotiable instrument, exchange it through the Fed Reserve and fund your account that way. So, they failed to disclose that via the contract and the contract is void because they failed to provide full disclosure, failed to provide consideration and fail the element of Equal Risk, required for a valid contract.

I cosigned for a vehicle for my brother. He quit making payments and my credit tanked. I tried to repossess his truck and the finance company said I had no legal right to do so. I told them where the vehicle is and they refuse to go get it. Please tell me there are legal steps I can take without filing bankruptcy to repair my credit. Everything I have is 100% on time payments except for his truck

Yes , you can repossess the truck because you are the co-signer meaning If he can’t make the payments you are liable for the that truck they’re lien to you . If that was me I would report them

My brother has traded the truck for another vehicle. The tow truck company that has the truck has removed the vin. I tried getting the cops out there and was told it's a civil matter. The prosecutor also said I can't report it stolen because my brother traded the vehicle. Basically, if you co-sign in Arkansas you're screwed

@@wormjad1973 I'm so sorry for this situation. Now you may have a repo come on your credit report unless he actually sold it and whatever he had received for it went to the "lender." They will at least put a charge off on there most likely if they didn't get full payment. You'll have to dispute this like a charge off and require full documentation proving the accounting or if a repo, dispute the accounting and proof they followed all the laws regarding repos for your state, which require specific notifications by certain deadlines. They usually don't follow everything correctly and also, if they did a repo, then they failed due process because its a civil disagreement that has to be settled in civil court. You can't just take something for non-payment. They have a burden of proof required and a judgment and order from a court. They don't follow the law because people don't understand their rights and they get away with it. Oh, and a tow company has no right without consent from the registered owners to take a vehicle. Just FYI.

I had a three-year car lease with Kia, it closed in 2018, for some reason one agency has: - 100% payments made, all green checks but say 1/0/0 for 30 days late. second has: - 2 red X for late 60-90 days 98% payments 3.) 1 red X 30 days late. it’s 5+ years old, going on 6…idk why it would have ever been reported late as it was the final 2 months before I brought the car back to lease again. The account was always paid…anyway is it even worth trying to dispute this as it’s so old an only 1-2 payments out of 36…

Yep. They make the accusation, they bear the burden of proof. You need to dispute requiring a full accounting, and when I say full accounting I mean a fully audited GAAP accounting. It's in the federal code.

To me, goodwill letters admit that you in fact did make the payment late. With that information, most companies won't remove past late payments. Consumer law typically takes care of this.@@biggthirsty2089

It's only legit if they can prove it and that requires a full accounting and a letter of verification, sworn under oath or per federal code for an unsworn verification signed and dated under penalty of perjury!
