Hi Jamie - got a bit of an unusual question: So, with Toby's music, from my understanding, derivative works such as covers/remixes need to be published through a music licencing group, including fan-games and other works. A question I have as an aspiring dev that's hoping to licence a song - say for example, an original game IP unrelated to Undertale had a cover of Megalovania for the final boss theme. What would the rules and process be for that, given that the game would likely be making money independently? Would it have to go through a different process? This question is mostly in relation to licencing and copyright in general, but KZbin as well. Thanks!

@@droidy365 Afaik most of the discussion centered around how it intersects with KZbin, for example if you just make the game itself and put it out, if someone else uploaded gameplay footage of your fangame with no officially licensed OST released, that creator would be "caught in the crossfire", so to speak. So I think the takeaway is that the Soundtrack should go through the licensing process by the developer and have the due-dilligence done to say "THIS specific song in my game's OST is derivative of Undertale, so let's split the royalties", and because it was officially published on streaming services the Content ID system on KZbin will have an easier time distinguishing so people that make content of your fangame don't have to deal with as much hassle.

For something like this, ESPECIALLY if it's something you're commercializing, you'll need to have a license in place with whoever administers the rights to the music (speaking broadly for anyone who is asking this question about games we don't work with). The cost of such a license will depend heavily on a few factors such a projected audience size, revenue, etc.

Question to jamie: How much of a song's melody has to be the same for youtube Content ID to act up? For example, if I made a 4 minute song where 30 seconds of it had a megalovania motif, would youtube Content ID think its a remix/cover of megalovania? If it would, then that seems really dangerous to me. Because of the way making melodies works, its very common for composers to subconsciously reference or even straight up copy melodies they've heard before.

That was a lot of good information, thank you to both of you for making this happen! I have a question that I don't think was entirely addressed. There are lots of Undertale fangames out there and not all of them have their music properly licensed. Based on what was said, it sounds like in these cases, Materia's policy would be to leave content ID claims in placed on videos of fangames with music that isn't licensed. And video creators certainly can't control whether a particular fangame licensed their music. Is there anything creators can do to avoid claims from unlicensed fangame music, other than removing/replacing the music altogether? And is there a way to find out whether a specific fangame has properly licensed their music? My worry is that because unlicensed fangame music is such a landmine of potential copyright claims, the uncertainty behind which fangames have a license for their music would still discourage creators from making videos about fangames despite Materia's stated policy of embracing fangames.

Holy fuck, thank you Jamie for that AI discussion. Too many people nowadays seem to be so oblivious as to what damage AI art is causing that it’s insane. People losing their jobs in turn for stolen content that’s at a way worse quality than it would be with actual human beings. If AI should be used for art in any circumstance, it should at least be used ironically and not seriously like these companies want. I would much rather have AI do my laundry and fold all of my clothes than have it try to make a bland composition of music that has no soul or creativity.

I don't know how often you read suggestions, but i have a challenge run idea: Whenever you get a encounter, you have to spin a wheel, the 2 things it can land on is spare, and kill, if it lands on spare, you must spare that enemy (Unless it cannot be spared, such as Undyne the undying, Sans, etc) if it lands on fight, you have to kill that enemy, the goal is to get to the end of the game with killing the least amount of monsters possible (Also, the wheel could be at the corner of the screen or smth) also, fleeing is banned

It happened to the same video the exact same way 3 times & it was a different pair of employees each time. I just ended up having to manually redo the entire video with different music. Took me half a day. Why Toby hasn't fired them is beyond me. They're the only ones who give me this trouble. None of the false claimants they were hired to prevent have done this because they all have the common sense to back down when their claims are disputed.

Over a month ago I had a very annoying issue with undertale music which I hoped would be brought up here in this video. I personally reached out to both KZbin and Jamie, but my issue couldn't be resolved, and never was. I uploaded an unlisted test video of the music I made, but used somebody else's Undertale cover in the middle of this audio. This cover in the middle was identified as the original OST (but KZbin obviously said that it's some random cover, but not even the one I actually used lol) and I couldn't dispute the claim because Content ID is just simply dumb. Jamie told me that even they don't have the power to do anything about it, because I used somebody's cover, not the OST. That means, you simply *can't use fan made covers in your videos* because they will get claimed as the OST and nobody can fix it. I contacted KZbin, but obviously it felt like talking to a 10 year old and they didn't fix anything either. Funny thing is that the guy who made this cover doesn't have any claims on it, because I talked with him too. I really hope something will finally change one day, because right now doing fan stuff is simply impossible. If I wanted to use somebody's orchestral cover in my animation, it would get immidiately claimed and could never get resolved. That way I just lost all motivation to even make this video. BUT, there's still hope - after reuploading the same video it magically didn't get claimed, so I guess it's completely random and based entirely on luck.

the more time goes on the more i believe copyright as a concept should be abolished..it does basically nothing to help protect smaller independent artists and exclusively serves to help uphold the power of coprorations. i don't think someone should be able to own an idea and say no one can use that idea for the next 100+ years, that just seems detrimental to creativity, as all art is inherently derivative. so my words don't get twisted, i want to clarify that i do believe in thoroughly crediting people who influenced your art, but ironically i think copyright often discourages that.
