It's really difficult for a African like myself when a African leader conducts themselves like this, because it creates this notion that we agree them but alot of time we don't agree with the grand standing, sensualism. If we play around with terms like racism it will eventually take away the seriousness of the issue, because it's being used by black leaders recklessly and they know is a open wound for black citizens and it will be easy to gain popularity through using the term, they are using wounds that are very deep & historic to gain popularity, what a shame

If you rebroadcast or rediseminated it then that complicates things but you may be able to say that you did so to defend your reputation. You would need to concentrate on the original hurt you suffered. Libel and slander come under the head of defamation, they are both arrows from the same bow, but weighted differently. Slander you would normally have to prove the damage you suffered, libel damage is assumed, so long as the libel as be disseminated to more than just a very small number of disinterested people. It is up to the defamer to prove the truth of what s/he said and that was was said was not defamatory or was an opinion based on the facts. Under the circumstances that doesn't seem to be a relevant defence. If he cannot defend his words and there clear and ordinary neaninghe should fail in his defence. That's of course if the jury has not been brought or intimidated by anyone and are not influenced by an affiliation to a political party or person that skews the outcome. Of course part of your attack on the politician could be that it was him who was in fact being racist, which could encourage him to settle. I assume SA has a constitution that allows freedom of speech. It would be embarrassing if the politician is found to also have acted contrary to the constitution. I'm based in the UK so the law my be different in SA in the deeds but I suspect it is largely equivalent to your law. It's not criminal in the UK, it would be a civil matter started in the High Court.

I never saw anything racist about the video in the first place. In addition, you quite correctly state that accusing one of being a racist without justifiable grounds is indeed unlawful in most democratic countries. 'Racist' has become a get-out-of-jail free card for any politician that either disagrees with a point of view, or wants to shut down an opinion that threatens them. It's completely unacceptable for a mayor to be abusing their position so freely. I do not believe he understands satire; otherwise, he would understand how important it is to use symbols of national importance in satirical expression. Your use of the national anthem was brilliant, as it juxtaposes the apparently senseless (and now possibly unconstitutional) decision-making of NDZ against the values of freedom that we hold in this country. The true irony is that the dear mayor seems to have put himself squarely AGAINST freedom in a satirical piece aimed at promoting freedom. Keep it up, hope Zapiro picks this one up!
