It’s feels very rambling in places which doesn’t help. They’ve obviously tried to answer a lot of questions that they get which is commendable but doesn’t make for an easy to use guide

Hello any advice would be appreciated. I made a DSAR to my bank and they haven't responded for over a year. I have reported them to the ICO who have now written to them and given them 28 days to respond. The letter says that I can get compensation for this. do you know if there is a standard compensation matrix ?

Hi, there is no compensation matrix as such. The ICO cannot force a company to provide compensation, it is down to the company to decide to pay you for a breach and how much they wish to offer. I would work out roughly what you feel you have lost in terms of time, inconvenience, postal charges, calls etc. and then make a request for that amount and see what they come back with. Banks are usually pretty good at paying out f you make a good case.

If i took a contract phone out in my name and i pay the bill from my bank account, but somebody else is using it will i still have grounds to see all the information?

That very much depends on what information you are asking for. As the account holder and bill payer, I’d expect them to provide you with details of the account, bills, numbers dialed, amount spent etc. but the messages sent for instance would be a different story. These would belong to the user of the device rather than the bill payer.

@@iSTORMDiaries I've managed to go to my local nick to present ID and they have been up to today very fast in response it's surprising . I was originally sent two blanket word docs saying they have no information at all . Then I mentioned that I found that , somewhat impossible . I messaged them back and explained this and now they are looking to be willing. Thanks Rob

Gets a bit more complicated in policing as we also have SAR's via Law Enforcement Processing (Part 3 DPA) which doesn't allow extensions for complex requests.

My SAR rejected because third party rejection. So law protects narcissists who smeared you and criminals. Law needs changing.
