What dude said about missing names on the court paperwork AT 18:52 is ABSOLUTELY CORRECT. I have over 10 years in law enforcement and I can tell you that according to the constitution anyone accused of a crime AND ALL PARTIES INVOLVED have a right to face their accuser. If he and others are being accused of, OR accusing someone of a crime they are REQUIRED to have the interview (testimony aka give their side) process. These interviews, and the information gathered from them are documented. If others are not given interviews (unless theyve died), their names not included (even if theyve died), then those documents are fraudulent. One thing the government is not going to do is submit incomplete, and/or incorrect paperwork. Period.

What was originally said in the dd5, to warrant a signed affidavit(under duress) recanting a previous statement is considered relevant conduct and suspect at the least.

Bimmy dd5 statement and indentity was omitted unconstitutionally by the prosecution during the original discovery request on behalf of the defendant. That’s why the appeal was filed under newly discovered evidence and the violation of the Brady rules and law. The defendant was entitled to all the dd5 documents at the time of the request, unfortunately the prosecution was obscuring Bimmy dd5 documents per request. Somehow the defendant discovered that those documents existed and were not afforded to him per discovery (Brady) law. That’s where the appeal derives from. It’s apparent that the prosecution didn’t use Bimmy dd5 statements to obtain the conviction of the defendant. However, them failing to afford the defendant an opportunity to receive,review and challenge ALL DISCOVERY(i.e dd5 specifically) it violated the defendant Due Process which is constitutionally guaranteed in the court of law. Finally, Bimmy affidavit does support the facts that a dd5 does exist, although the prosecution unlawfully failed to provide it to the defendant per request as if it was a non -existent document. Bimmy affidavit is a recant sworn testimony refuting what was in the dd5 associated with his statement.
