The Remington M40 Mike purchases is not an NFA Firearm, you could literally purchase that gun in any gunstore. And at the time small person to person purchases like that were still legal in the State of New Mexico (aka the "gunshow loophole"), Mike did nothing illegal in that scene when purchasing that rifle.

While the rifle WAS illegal, it wasn't a NFA firearm. you can buy the gun (Remington M40) OTC at a gun store, granted you pass the background check. It would only be an NFA firearm if the barrel was under 16 inches.

@@clartydebbie well back in 2016 we were cadets and we were going to the summer training camp (where everyone is always carrying their weapons < without ammunition > and doing training with those). then one night, 15th of july, our commanders called for an assembly and chose some people. they took their weapons thinking it was another drill, and left the garrison to go somewhere (we didn't know where then but it was the bosphorus bridge). the military (i mean the actual military, not us cadets) held the bridge. my friends were just there for the whole night, sleeping under military vehicles. around morning, civilians started to attack soldiers, and because no one really intended for a coup and nobody was going to attack their own people, they got lynched by their own people. two of my friends died and the rest are still inside. why am i not? i guess just luck. the commanders didn't really liked me so they didn't choose me.

I feel like some of these crimes could be negotiated and be brought lower for example the first where he kills the two cops. He couldn’t turn to the police as they were all corrupt and they were plotting on killing him. Those same police also killed his son. I feel like that crime would be lessened by circumstances.

It wasn't like he was running up with a baseball bat where escalation of force would apply, it was an entire vehicle about to be used as a ramming device. I'm no lawyer but the intent to kill with a very large deadly weapon makes self-defense with a gun sound extremely justifiable.

Not an NFA FIREARM. It was a simple bolt action rifle. Also, IF it was an NFA item, the illegal possession of such also carries a fine of up to $250,000. If you’re going to go through the trouble of getting all of the crimes and sentences together, do the same with the facts.

The serial numbers were removed and it is a criminal offense to possess a firearm with altered serial numbers.

Came here to post this, glad someone beat me to it. I didn't see any suppressor on it or anything else that would render it illegal under the NFA itself. Other than the serial number being obliterated, as from what they showed he files the numbers off of everything he sells in both shows, it wouldn't violate that law at all but instead be a violation of the Gun Control Act of '68

The main thing I've learned from these videos is how seriously the law takes kidnapping. Would never have thought it was 9 years, 50% more than Mike would get for second-degree murder in this case. Watch the two clips from 6:56 and see the contrast.

It's not that they take kidnapping seriously, it's that in New Mexico second-degree murder is treated like a joke. Maximum sentence for SDM is 15 years there 🤣

Also im pretty sure just because someone seems “defenseless” after the fact of them trying to kill you doesn’t mean that you finishing the job is murder. Because they engaged in attempted harm of your person to ensure your own safety is still self defense.

It definitely gets more gray once they are down and injured, but the cartel member specifically had an SMG next to him. Without video evidence showing him completely incapacitated you would likely not be convicted

Him instructing someone to lie and him lying to the investigators are not crimes. That’s a falsehood many cops will tell you to extract a confession. Lying only becomes a crime when you do so under oath, and that’s called perjury.

Both were premeditated to draw them in, self defence only applies to an imminent attack, Mike put himself in both situations on purpose to kill them

1:40 That's not an NFA item as the barrel is clearly longer than 16 inches, but it IS illegal to purchase and possess as it has a defaced serial number.
