Picture this. You're at home one evening when you hear a loud commotion outside. You look through your window and see a group of menacing - looking individuals approaching your house. There's no clear indication that they’re law enforcement because they’re not in uniform. Fearing for your safety, you grab your legally owned firearm.
Suddenly, the door bursts open, and these individuals start shouting commands. You have no reason to believe they are police officers, given their aggressive behavior and inability to announce themselves properly. In the confusion, one of them opens fire, and you're hit in the shoulder. In pain and fear for your life, you return fire, trying to defend yourself and your family.

A drug dealer used stand your ground and won when the police served a no-knock warrant. He started shooting at them with an AK. I think he killed 1 or 2 cops before he surrendered. He was found not guilty due to the circumstances. So, ya, if they do a no-knock warrant, you could be justified in popping rounds at them if you dont actually know they're cops. This whole door-kicking shit is really stupid, man. Like the ATF killed that airport guy in arkansas over selling guns for a profit. They did that on purpose. dude was really rich and would have taken them to the cleaners. They knew the guy would start shooting and they would be justified in killing him.

I don't believe you would ever win a self-defense claim in court against a police officer even if their shooting at you was illegal. You are going to prison either way, but if you un-alive a police officer--really your only option--you are treated as royalty in prison.

A guy was able to successfully win a case of self defense against a police officer in court, but that case is really more of a unicorn than anything.

Technically... yes. Realistically... HELL NO!!! There are Laws on the Books vs Law in Action. Basically, the law says this will happen but what will really happen is something totally different. EX 1. You have the right of free speach. If you use it and an officer doesnt like it, he arrests you for disorderly conduct. EX 2. You have the right to be safe from unreasonable searches and seizures. This wont stop an officer from putting his foot in your doorway, preventing you from shutting it without incurring a battery on a peace officer charge thus resulting in a search of the immediate area for officer safety. EX 3. What happens if a cop decides to violate your 4th amndment rights while driving? If you dont give consent to search your vehicle nor does he have a warrant the officer can have you car impounded via an arrest even if he knows the charges will later be dropped. He can claim that your vehicle is unsafe or unfit for the public roadways, etc... and have it impounded. But this impounding of your car warrants it subject to a "Vehicle Inventory Check". Which is a search of your vehicle. What happens when he finds no drugs but finds money and confiscates the money, maybe even the vehicle itself under Civil Asset Forfeiture? You should be safe under the 4th amendment right? EX 3. You have the right to legal representation and a speedy trial. It is common to see accused sit in jail well beyond the legal time period, especially when they rely on public defenders. There are ways around this though. I know of a man that had a case but the prosecution was running out of time.They only had 1 week left to put him in front of a judge or drop the charges. They conspired with his own attorney to drop his bail from $60,000 to $5000. He paid the bail of course not knowing that it would reset the clock. He was later found guilty of the charges. He is supposed to have legal representation that will fight for him but instead, his attorney was in collusion with the prosecution and set him up. He lost his freedom, money from that attorney and money from the bail he posted. Even though these are rights violations which should leave recourse for citizens by stripping qualified immunity, attorneys usually won't take these cases. They know that the officer will have paid representation that will slow down case progress to a crawl. Attorneys know that their client isn't going to be able to financially afford this. So many attorneys won't even take these cases as it is of no financial benefit. The police are essentially the soldiers that enforce the will and rule of your city and state politicians; governor, mayor, etc... They will never side with you against their enforcers. A cop could be stomping you into the inner core of the earths crust. If you do so much as touch his boot with anything other than your tounge to tell him how much you love that leather print, you will be charged and prosecuted with extreme predjudice. I know of only 2 cases of citizens using lethal force against police and beating the charges.

The officers could have retreated instead of firing through the window at the homeowner. They gave her no chance and they saw her in her home with a gun. Its legal to be armed in your own home. So they were not on imminent danger at any time, so where is the justification for force?

It's a very unfortunate situation! If you want to keep on living. You have to return fire! If you can. I have more than several encounters with the police. Most of them tried to scare me. " I finally got you". 5 minutes later. Had to let me go. Every black man looks alike type stuff. I no longer live a life of crime and Gangsta stuff. It's always going to be a stupid reason to go back to it. Be safe and stay cool.

I am not anti law enforcement whatsoever. But when “in multiple instances” they raid the wrong premises and the victim defends themselves and either gets convicted or worse passes doing so law enforcement just states it was a mistake. Yet the person defending their family still either go to jail or the morgue and the officers still walk the streets.

The fact that this video was made should tell the government that something needs to be done about the police are abusing people's rights more and more with little to no consequences. A female cop walked into a black mans apartment in Texas and killed him thinking she was in her apartment and she only got 10 years in prison and the judge just had to give the poor woman a hug after sentencing. Now flip the script there and have a black man mistakenly walking into a female cops apartment and him killing her thinking he was in his apartment, how many people can honestly say that the man would just get 10 years? If he even lived to see a court room?

NO! At least not in Michigan in 1987. We were going to be a hung Jury most likely until Judge Hathaway's instructions. It pointed out laws and one was that NOBODY can resist an arrest with force against a Police Officer in the "Line of Duty". That completly changed the deliberations (made it easier actually).

I agree with your message, but do more research. Your 1st story is already wrong. It was a friend of the home owner staying while she was "out of town" was locked out so she did break in. Admittedly she did with the home owners permission. Was saw approaching while armed and fired upon. Should have been handled differently, but you give self defenders a bad name when you report a completely wrong scenario

Police are not required by law to identify themselves. When a bunch of guys bust into you house with guns drawn, whether they be cops or thugs, and you're overwhelmed you don't go for a gun unless you have a death wish. You be polite and offer them milk & cookies and live to tell the tale. 😃
