Warranty VS Representation A warranty is a true statement. There is nothing that should/could be wrong about it. Warranties are mostly used in Property and Casualty where you just NEED to be correct, like “I drive a 2002 Toyota 4Runner” there is no reason why that wouldn’t be true and there is no reason why I would lie about it. A representation is a believed to be true statement, but it’s not guaranteed to be true like a warranty is. Life and Health insurance use representations because it’s possible for a person to be wrong, and not know it. For instance, I am filling out a life application and it asks me if I have cancer. I say no, I don't. Never been diagnosed, no issues with my health to think I could have it, so I am fully believing my answer is correct when I say, “No I don’t have cancer.” Three months later after my policy is issued, I go to the doctor because I have these crazy headaches. The doctor finds a brain tumor and says, “Based on its size, it’s been growing for the last 6 months” So technically, I did indeed have cancer in my body at the time of the application, but I said I didn’t. But we would not consider that lying. I didn’t know, I believed I didn’t have it, and thus the policy would still cover me if I died from the tumor. Now, CA takes these a step further and has Implied and Express Warranties. Express means “written” it’s documented, you can look at it, there is no debate about it because we can refer to the document/policy and see what is written down. Implied basically means “assumed.” Which very much falls in line with Representation, you assume it to be true.

Insurance terms and related concepts, and policy provisions and contract law are two of the simplest chapters to study since they have the least amount of material to study, usually about 20 pages in total for both chapters. It is very easy to grab many points here, then it is to grab them in any of the other chapters. If you have already studied and failed these are most likely the chapters you need help on. What I encourage people to do is focus on dwelling, homeowners, and flood. In TX, For your state, this is what you want to focus on to secure a pass. With the life and health exam, there are separate chapters that make up the content when you look at the exam breakdown. What I like to do since I know and understand the information within all of the chapters, is to focus on the content that is the same between life and health. This way you get to double dip on your learning, and not be overwhelmed with all the things you have to know. So first, we focus on the things that overlap. This would include completing the application, and field underwriting. Both of these chapters almost look identical between life and health. I teach completing the app which is also known as field underwriting at the beginning of my 4-hour life boot camp. As part of this boot camp, you will also learn the main two life insurance policies and the differences between them, which they love to test you on. While there are different provisions in life and different provisions in health, many of them will overlap.
