In the UK, you have a personal tax free allowance of about £12,500 (550,000) baht PA. In Thailand you have a personal tax free allowance of B 150,000 PA, making B 400,000 liable for income tax at varying scales of 5%, 10%, 15% etc until you reach the DTA. So a UK pensioner retired in Thailand would end up paying tax on a proportion of his income that was tax free in the UK.

Let's put the taxation issue into perspective. Thailand population around 70million. From the Revenue Dept 2023 figures there were 11million tax filings of PIT. Of the 11million filing 8 million were filed for tax reimbursements. That leaves a tax base of 3 million people paying PIT. Thailand has over 60 active DTA's. Thailand tax system is based on voluntary filing meaning nobody from the Revenue is going to be knocking on Mr Smith's door at his View Talay Condo because he has not filed a tax return by the due date. The Revenue enforcement team has limited manpower and capacity - they are going after the billion baht guys. Mr Smith can sleep easy. A saying from where i am from leaps to mind - Everybody calm your tits.

I can't help thinking all these possibles and variables will end up losing the Thai gov serious money as people look elsewhere to spend their life savings in retirement etc.

It is NOT a criminal offence to be in Thailand for more than 180 days (that is be a tax resident) and to not have a Thai TIN. It is ONLY required that you have a Thai TIN if you are a tax resident and have income over the tax threshold - which is THB120,000 if single or THB220,000 if married. It is bad enough that there is not clarity on many items from the Thai authorities, but matters are only made worse by supposed tax experts making completely false statements.

No problem for most of us, 180 days in Thailand is plenty, there's always Vietnam, Cambodia, and the Philippines for the other 185. It's obviously a bigger problem if you have a Thai wife, own a condo or a business... but then that was never recommended lol.

@@chandlerbingbong The wrinklies are on pensions, so no tax to pay. The real problem the wrinklies will likely face is a worsening exchange rate - the west is heading into an economic collapse imo, and it's going to hurt our currencies.

As suggested in some comments (like 35% tax) are way off the mark. Thailand has always pushed for retirees to live here if they tax them on their already taxable pensions there would be a mass exodus. No doubt it will affect many foreigners here but not those retired in my opinion.

Jasmin cafe is great. I found it via google whilst in Pattaya last month. Only downside is it's really small and you often can't eat inside . You have to be seated outside where there is no air con. 10/10 food though!

I love raining season in Thailand, but wow 😳 they have ripped the guts out with that building. As for the retired ex pats they will be thinking is it worthwhile retiring in Thailand and move to countries which doesn't have tax laws like Thailand have adopted and why have the hassle when you have officially retired for ex amount of years, considering the majority of elderly ex pats are not computer literate and why should they be they are supposed to be living out there days waiting for the grim reaper to come knocking. I'm going to a veterans funeral tomorrow afternoon who was on DDay landing and the south of France landings and as well as Hong Kong he was 99 years old his own family didn't even know what he did in WW2 his coffin will be draped with the Union Jake with standard bearer's every veteran will be with medals and regimental beret lining the entrance to the church, just like my father ( i had to drag out of him what he he did over when i was in the Brigade of Guards) whilst he was in WW2, Korea and Palestine wars his statement was at the end "no civilian should see what he has seen or have done". We were evacuated from Libya they were shooting at us I was with my mum when my dad was fully armed with a 303 rifle that looked pretty much pissed off he ran over to the defensive position organised his men and took the fire fight to the Libyans we didn't see him for a few weeks we landed in Cyprus he followed on we didn't know if he was alive or dead at that point. This is why the British citizen really need to know their history before saying we are the aggressor if it wasn't for the likes of my father plus all the veterans who are still alive and our fallen comrades who gave the ultimate sacrifice defending the UK European citizens from the Nazis and a small percentage terrorists of islam because not all Muslims are bad Muslims.

What i dont get is most uk pensions are under the uk first tax bracket, ie under the threshold which you start to pay tax, so you pay zero tax on that pension. Thailand has a much lower personal allowance, so in theory anyone on a uk pension under the uk personal allowance should fall into the bracket of owing tax in Thailand. If that's the case those people simply wont live in Thailand

Just not correct, Uk private and company pensions are taxed at source (usually 20%). UK personal allowances are irrelevant for consideration by the Thai Revenue Department.

Clear as mud. Retiree’s want easy. Thailand might want to re think this. People don’t like taxes as is. Possibility of paying twice on a fixed income won’t work.

@@NDTViThailand 1st £12500ish is tax exempt in the UK and u know what these coconut heads are like so they'll want their cut NO DOUBT. If govt persist with this they'll drive pensioners out so Pattaya will need to change or become even more ghostly, and a LOT of aging ladies are going to be without a sponser anymore. Interesting times. Worrying thing is that the Shins have always had it in for whitey and pretty sure they dont care about white pensioners or their live in ladies so u can guess the rest

There are sections in the Double Tax Agreements which you have to go through as you in theory can be a resident of 2 countries at the same time by reason of that 180 day rule. Depending on the answers to those questions will determine who is the taxing authority. If Thailand is not the taxing authority they have no right to tax "remittances" as remittances by their nature are not income in themselves. I think it's going to wind up in the too hard basket once they try to administer it.

The DTA determines who is the taxing authority. That just means which jurisdiction has the right to tax first. Thailand has every right to, and does, impose tax on foreign sourced income remitted into the Kingdom.

@@MrMeldarionx correct, savings, inheritance, gifts (subject to limits) are all non assessable and can be remitted tax free into Thailand. Income however is taxable so you would need to provide proof of the source of any remitted funds.

@peterpower7840 this is why I say that the administration of these policies is going to be interesting. If you are not deemed to be a resident for tax purposes, even with the 180-day rule via a mechanism within the DTA, then only Thai sourced income can be taxed.

From Canada's DTA: Pensions and other similar remuneration, whether they consist of periodic or non-periodic payments, for past employment, arising in a Contracting State and paid to a resident or the other Contracting State shall be taxable *only*. in the first-mentioned State" *Only* means the Thai government can't run a train on a person who has already been bent over by his home government.

Great information, including on the weather in Pattaya. It seems to be a fantastic place. In the 7 years that you have lived there has your life been adversely effected in any way by flooding or poor air quality especially during the burning season?

Not at all. The weather can affect business from time to time but this can be said of anywhere in the world. Pollution can happen in other areas especially Chiang Mai but here we live on the coast so it gets scattered with more wind off the sea. I'm not saying it doesn't mean others aren't affected in other areas, but it really hasn't affected me living here.

Pity they don't bring back Multiple Entry Visas with 60day tourist Visa. Used to be the way one time. I do know you can have a Multiple Entry with Retirement Visa but this new layer of restriction on top of the rest just seem to make me feel why bother with the place.

​@@chrisgoody2shoes218 Well you get a passport and citizenship of the UK. You also get your pension, which isn't a God given right. It's a benefit just like universal credit or job seekers allowance. Maybe you meant a private pension not the state one. Either way, you also get to vote and have some say in how the country is run. You get consular services when abroad, and you get to wear union jack shorts and talk down to foreigners. 😁 try getting any of that from Thailand.

This is gonna backfire on the Thai goverment, Retirerees with money will either pack up and leave or leave the country for 6 months a year resulting in big losses and whos gonna send over 2, 3 or 5 million to buy a condo when your gonna be taxed 30% on it, Condo sales are going to slump big time.

According to the U.S.-Thai DTA my three U.S. sources of unearned income are exempt from double taxation by the Thai government. Therefore, if there are no places on the Thai tax form to list that exempt income (I've checked), what's the point in submitting such a form? Any suggestions?

If you do not remit assessable income then there is no requirement to file taxes.

This might be a dumb question and I heard them say you won’t have to pay taxes unless you stay over 180 days , but when he said that you might have to show proof of your taxes when you go for a visa extension, does that include the 30 day extension that you go to immigration for after your 60 day stay ?

Not if you stay no longer than 180 days. The 60 days on arrival plus 30 days only adds up to 90 days. Basically you can stay for 6 months per calendar year without producing.

Yes I noted in post production. Basically I accidentally hit some buttons without realizing. The camera (which is new) thought I was using two mics so two channels were open. School boy error I need to keep my eyes on in the future.

So if I tell tax office in Thailand that i brought over £11000 from uk which is tax free in the uk it will be taxed in Thailand so my allowance is no longer tax free

My sole income is pensions now and i'm taxed on part of them in uk, i dont want thailand taxing them to, I wonder if there is a workaround for this problem, maybe wise transfer into thai persons bank account monthly instead of your own bank account ?

I really cannot see them taxing already taxed pensions this would create a mass exodus. Only a few commenters have said this but no one knows. I do think it's a case of proving it at some point but not double tax.

@@NDTViThailand the law is clear, UK state, company and private pensions are classed as assessable income (Thai Revenue Dept Code Sections 40/41). If you are a Thai tax resident and remit assessable income above minimum tax thresholds then it will be subject to Thai taxation. This has been the law for many years, nothing new.

@@John-G Just for you I will repeat what i have already said with more clarity. UK State, UK Private and UK company pensions are all classed as assessable income by the Thai Revenue Department. If remitted into Thailand they MAY be taxed if you are a Thai tax resident at time of remittance AND that remittance is above minimum thresholds. The UK Thai tax treaty explicitly excludes ONLY UK government pensions. What constitutes a UK government pension which is tax exempt when remitted into Thailand can be found in HMRC briefing note INTM343040.

I know people compare prices to their own countries but for me it is irrelevant. If you want to make it relevant I'd say Thai food in the UK is ridiculously expensive. For example how much would you pay for a Thai green curry in the UK eating out compared to here?

Guys - you say US citizens will have no problem but think about what the T government will want you to provide to prove you paid USA taxes. Do you really want to have them receive a copy of your US tax filing? It may have far more personal info on other monies you have than what you want to show. And it’s entirely at their discretion. Thailands new tax laws is going to be advantageous to its neighboring countries and a loss for Thailand. Many people will do six months in Thailand no reason to get a retirement visa or do a 90 day report. Then just move onto one of the neighboring countries for 6 months.

If all the talk is to be believed, the Kingdom seems determined to do all it can to shoot itself in the foot by talking about implementing another hoop for retirees to jump through. One of the things I thought about is those like myself who brought in 800,000 Baht for the retirement visa. Who in their right mind would do that now if it meant they ran the risk of being taxed on that money? That said, the vast majority of voices online about this potential issue are tax professionals. My visa extension is due in March, and I'll be listening to the actual experiences of expats who renew in January and February just to see how the land lies beyond the theory of tax law.

There are changes coming in all areas since the new government. Example for bars that I was told yesterday by an official. The new license next year will require two separate toilets. This will be costly for most businesses so the goalposts are constantly moved.

There is a Double Tax Agreement (DTA) between the UK and Thailand. I think what you mean is that there is not specific DTA on UK State Pensions which is correct. Therefore, a person could be liable for Tax in Thailand on their UK State Pension. Someone who only has the full UK State Pension (£11502 per year) as an income wouldn’t pay tax in the UK as it is currently below the personal allowance (£12570). They would however be liable for tax in Thailand and based on the current tax rates and assuming an exchange rate of 43 baht they would be liable for 27500 Bhat tax for the year (or 2300 Bhat per month). This is straight forward but things become more complicated when someone has income from other sources such as Company Pensions, Rental Income, Investments, Tax free Savings etc. And for that they need to see a Tax expert.

Listening to others, the law has not changed, but they are planning to enforce it. Thailand has a tax on worldwide income system, like the US. And you automatically become Thai tax resident after 180 days. So it doesn't affect tourists, but they will soon need to plan for the introduction of (ETA) Electronic Travel Authorisation (in 2025?) It will be like Covid, sending various bits of paper as JPGs to Thailand to check. Thailand is struggling ,like the EU, to introduce it without causing chaos.

For us American Government pensioners/military retirees/VA Comp expats it's zero problems. Just file, show you have your money from one of those sources and you're protected via the DTA with the USA which allows the US to only tax those earning and, if Tax Exempt, they remain that way.
