Assalaamualaikum brother. I had a query for one of my tax clients, I thought I should ask you first before asking the legal experts at FBR. As you respond to comments promptly and always give good detailed answer alongside making such great videos. So, capital gains, the holding period starts from date of purchase, ok. But a property inherited from father, after father's death, has to be added on the same value as it costed the father, states in incomes tax ordinance 2001, though a lot of consultants add on zeor or fair market value (FMV) and somehow not everyone gets a notice. But if a person has received a significant value land/plots and FMY above 12 crore, cost was in few lacks 12-15 years ago. The person intends to sell the property as soon as possible, maybe within one year. Thus this will attract the top rate of CGT that is 15%. Now the problem is, if we add properties on FMV, which is against the rules, but somehow we add, the FBR may send a notice. Ok second option is if we add on cost to father and then sell in couple of months, the gain will be nearly all of the sale proceeds (e.g. one plot costed 3 lacs and now is worth over 2 crore). So high gain means high CGT, I mean good few lacs. BUT if the holding period is calculated from the date of purchase of father then the gain will be totally exempt. I couldn't find details in the Ordinance on calculating the holding period of inherited properties. If the law is fair, when it requires to transfer the property on cost which was paid by father then ideally the holding period should also be allowed from the date on which father purchased the property. Please advise or share your guidance. Many thanks.
