See dying declaration m koi age mentioned nhi h , or minor ka bhi admissible hona toh chahiye if it is true and voluntary , kuki minor ko civil or criminal laws m liable ni krte due to their incabability to understand prr, yhan koi relevance nhi h uss logic ka . Kya bologe ki minor tha isiliye ye ni bta skta ki kisne mara? prr in a judgment it is held -A dying declaration of a child is inadmissible. In Amar singh v. State of Madhya Pradesh,1996 Cr LJ (MP) 1582, it is held that without proof of mental or physical fitness, the dying declaration is not reliable. c) Inconsistent declaration: Inconsistent dying declaration has no evidential value.
