For one, it is unlikely that Gupta knew any details as to what or who was the top actor in the whole affair. Second, Yadav is known to have been operating outside of his remit, working with certain characters in the underworld, for his own personal profit, at least on paper, he was NO longer associated or employed with the Government of India. I don't think if we will ever figure out who had ordered Yadav, for the agencies across the world are often known to keep the official records clean, for plausible deniability. The murky manner in which crime and intelligence operate will make it difficult to figure out anything. And USD 100000 is NO big deal for the underworld to have access to.

No, Nikhil Gupta has not been granted bail. After being extradited to the United States, he appeared before a US Magistrate Judge who ordered him to be held without bail until his next court appearance. Just FYI Guptaji: Encryption would not have made a difference even if it was foolproof, because Nikhil Gupta was communicating with undercover agents who could have recorded conversations at their end. Also, while transmissions might be encrypted, once a message (text or voice) reaches the speaker or the screen on someone's phone as the case may be, it can be read. Encryption on WhatsApp, Signal, Telegram etc only works during transmission.
