They escaped indictment _as charged_ but the judge dismissed without prejudice meaning the department of justice can come after them again but with the charges drawn up differently. They're not off scot free yet. Give the DOJ some time, they've gotta do some more rigorous due diligence now.

Did you listen to the part where he explained the ruling though? It was dismissed without prejudice (meaning they can refile) because the case law underlying the prosecution's case had been struck down by the supreme court, meaning that the whole case would have to be redone. The judge is completely in the right here. It's a shame that it'll take a long time to go through all this again but hopefully it will be refiled.

This can be somewhat legit if the person giving the advice already bought the stock and was planning to hold longterm. That’s exactly why so many successful investment gurus can be successful, because they tell people to invest in things they already invested in; making them look like geniuses because the price always goes up. @@bingledingus420 Because it expands the scope of fraud statutes so much that practically any conduct involving a transaction can be viewed as criminal as there will always be informational asymmetry between seller/promoters and buyers. Secondly, it absurdly reduced the elements of fraud from deception and loss of value to just deception since mere exchange of money was enough satisfy the second element. It's really about limiting prosecutorial power and preventing them from straying too far from the text of the statute with such novel legal theories. Besides people should be wary of influencers hawking financial products and investments on social media. Caveat auditor and caveat lector apply to social media. Finally I find most of the victims in these social media influencer pump and dump scams particularly unappealing. They're just as greedy as the scam artists themselves.

Meaning, they operate outside all the regulations that govern the financial industry, despite the fact that they are clearly providing financial advice. Yes, it should not be legal. Well, the thing is, the person investing knows this is a pump and dump, so he thinks he can be part of the dump and dump on others. But now everyone investing is thinking the same, leaving everyone on edge about who will dump on whom. So, the best way to overcome this is to dump first, even though you made a low margin-better than nothing. Slowly and steadily, the time between pumping and dumping will decrease, and then these pump and dumps will happen in seconds, leaving bots trading amongst themselves.

I’m guessing not a lot of the top comments watched the full video or bothered to understand its content. With the way that the judge’s ruling was presented here, yes, I actually agree with it. “Right to control” is not a real or implied right in the way that they say it is. This is just a way the government can take more power away from individuals, by saying you’re too irresponsible to conduct your own risk management. Government does this ALL the time- claiming that the individual has too much freedom, power and responsibility to be able to handle, so it, itself will relieve him of that burden by taking control. It’s misleading, deceitful and false. They didn't necessarily make all of their money from their followers. There were other (almost certainly retail traders) buying and selling those same securities at the same time.

The Supreme Court ruled that the "right-to-control" theory is invalid because the right to information isn't a "traditional property interest". The court's opinion, written by Justice Thomas, stated that accepting the theory would mean "almost any deceptive act could be a crime". ⤴️. it'll be a while before a can get my head around this decision
