I feel like securities fraud is not prosecuted unless it defrauds big entities. No state pension funds nor Wall Street brokerages follow these guys for investment advice. It doesn’t take an MBA to see their posts are for casino entertainment in which they’re the house 🤷‍♂️

Or they go after smaller folks like janitor who was accused of making $$ by stealing secrets from financial company he worked for because he boasted about making $$ from his stocks by overzealous employees in that firm. He was acquitted and those employees were found to be lying (but didn’t get chatged) but lost his job

They escaped indictment _as charged_ but the judge dismissed without prejudice meaning the department of justice can come after them again but with the charges drawn up differently. They're not off scot free yet. Give the DOJ some time, they've gotta do some more rigorous due diligence now.

No, it's a PART of it. There are channels like Patrick Boyle's and "The Plain Bagel" that offer FINE, sound, and even insightful advice, and even make fun of channels that show off cars and watches, etc. The problem is experienced investors GET this of course but noobs may not.

Technically there are "finfluencers" that are licensed to give financial advice and they're generally honest including Richard Coffman, Patrick Boyle, Ben Felix, and Keith Gill.

these guys may be awful, but there are A LOT of people who should know better. They see cars and material items and get greedy. People are largely dumb, and off they think they can get rich quick they will fall for whatever scam. Then they cry for bailouts. They are already back to trusting these guys and will be asking for another bailout shortly. 😂

Did you listen to the part where he explained the ruling though? It was dismissed without prejudice (meaning they can refile) because the case law underlying the prosecution's case had been struck down by the supreme court, meaning that the whole case would have to be redone. The judge is completely in the right here. It's a shame that it'll take a long time to go through all this again but hopefully it will be refiled.

@@robertmurphy3014 That is why I suggested a class action lawsuit since it would be cost prohibitive for individuals to file a lawsuit. They made millions of dollars and their viewer lost millions so the money it there for a class action lawsuit to be worthwhile.

There won’t be a class action. And this case highlights the problem with individual federal judges making rulings. The defendants also were in Texas, were many federal judges are notorious for letting scammers and theft go free.

Using insider info is a sketchy crime, especially when you’re referring to things politicians know which isn’t actually insider info. But Pump & Dumps are obvious fraud. This can be somewhat legit if the person giving the advice already bought the stock and was planning to hold longterm. That’s exactly why so many successful investment gurus can be successful, because they tell people to invest in things they already invested in; making them look like geniuses because the price always goes up. It’s only true fraud if they were lying about holding longterm to trick people into buying with the intent of selling as their suckers were buying.

The issue is not scammers. The issue is the widespread desire of obtaining money without producing something that is truly beneficial to society. Imo biggest issue is lack of social experience. Anybody with decent social skills nowdays can do whatever with lot of people. In the U.S. fraud has been legalised. Congress insider trading. The largest companies on the S&P are engaged in vendor financing and capitalising their losses through accounting shenanigans. Then there's payment for order flow and marking trades short when they were executed as longs. The list is endless. How can they go after this group when they allow far worst to happen and deliberately look the other way.

@@bingledingus420 Because it expands the scope of fraud statutes so much that practically any conduct involving a transaction can be viewed as criminal as there will always be informational asymmetry between seller/promoters and buyers. Secondly, it absurdly reduced the elements of fraud from deception and loss of value to just deception since mere exchange of money was enough satisfy the second element. It's really about limiting prosecutorial power and preventing them from straying too far from the text of the statute with such novel legal theories. Besides people should be wary of influencers hawking financial products and investments on social media. Caveat auditor and caveat lector apply to social media. Finally I find most of the victims in these social media influencer pump and dump scams particularly unappealing. They're just as greedy as the scam artists themselves.

The net net of this case was that the Judge ruled that these guys can do whatever the fk they want so long as they aren't working in finance. Meaning, they operate outside all the regulations that govern the financial industry, despite the fact that they are clearly providing financial advice. Yes, it should not be legal. Leave it to the pro-business d-bags of the Southern District of Texas (SDTX) to once again undermine anything that might remotely resemble consumer/worker protection. Why do you think it has become so popular to use the SDTX for corporate bankruptcies to escape debts? Texas lawmakers love a good scam.

Well, the thing is, the person investing knows this is a pump and dump, so he thinks he can be part of the dump and dump on others. But now everyone investing is thinking the same, leaving everyone on edge about who will dump on whom. So, the best way to overcome this is to dump first, even though you made a low margin-better than nothing. Slowly and steadily, the time between pumping and dumping will decrease, and then these pump and dumps will happen in seconds, leaving bots trading amongst themselves.

They are conceptually similar but I think the big difference is that these are social media posts. From reading that article, it looks like they didn't go into the podcast. Maybe they would have a better case with the podcast since it seems they talked about ripping off people.

Well, the outcome (charges dismissed without prejudice due to legal theory invalidated after the charges were brought) isn’t as dire as it first seemed. I hope the govt figures out how to charge these bloodsuckers!

If the followers bought penny stocks at one price and then after the influencers sold their stocks the price dropped, did they not lose money as a result of the influencer's fraud and from which they made a profit? And they therefore lost money?

I’m guessing not a lot of the top comments watched the full video or bothered to understand its content. With the way that the judge’s ruling was presented here, yes, I actually agree with it. “Right to control” is not a real or implied right in the way that they say it is. This is just a way the government can take more power away from individuals, by saying you’re too irresponsible to conduct your own risk management. Government does this ALL the time- claiming that the individual has too much freedom, power and responsibility to be able to handle, so it, itself will relieve him of that burden by taking control. It’s misleading, deceitful and false. The government CANNOT asses your risk better than you can. 100% agree with the dismissal, and I’m glad the DOJ just now has to do bring normal charges the old fashioned way.

They didn't necessarily make all of their money from their followers. There were other (almost certainly retail traders) buying and selling those same securities at the same time.

The Supreme Court ruled that the "right-to-control" theory is invalid because the right to information isn't a "traditional property interest". The court's opinion, written by Justice Thomas, stated that accepting the theory would mean "almost any deceptive act could be a crime". ⤴️. it'll be a while before a can get my head around this decision
