Violation of Legal Right: The plaintiff must demonstrate that their legal rights have been infringed or violated by the actions of the defendant. This could involve interference with a recognized legal right, such as property rights, personal rights, or contractual rights.
Absence of Actual Damage: Despite the infringement of the plaintiff's legal rights, there is no actual loss, harm, or damage suffered by the plaintiff as a result of the defendant's actions. The plaintiff may experience inconvenience, emotional distress, or other intangible harm, but there is no tangible loss or financial damage.
Examples of situations that may be considered injuria sine damno include:
Defamation: If a person's reputation is unjustly harmed by defamatory statements made by another party, the injured party may suffer injury to their reputation without necessarily experiencing any financial loss or material harm.
Nuisance: If a property owner's right to quiet enjoyment of their property is disrupted by a neighbor's noisy activities, the property owner may experience inconvenience or annoyance without suffering any measurable financial loss.
Violation of Legal Rights: Any situation where a plaintiff's legal rights are infringed or violated by the actions of another party, even if no actual loss or damage is incurred, may fall under injuria sine damno.
While injuria sine damno may not result in quantifiable financial damages, the plaintiff may still be entitled to seek legal remedies such as injunctive relief or nominal damages to address the infringement of their legal rights. The principle acknowledges that the law recognizes and protects certain rights and interests of individuals, even in the absence of tangible harm or financial loss.
